Be it ordained by the President and Trustees of the Town of Evansville, That all Steam -Boats, Flat-boats and all other boats or water craft of whatsoever nature name or kind, that shall be within the limits of said Town or within one half mile thereof, that may be infected with Small Pox, or any other infectious or contagious disease, or from which any unwholesome, disagreeable or offensive smell or afiluvia shall arise to the -injury or annoyance of any person or persons living within the corporate limits of said town, be and the same are hereby defined and declared to be Nuisances'. - And any person or persons who shall, bring, continue, or suffer any such boat or water cratt to remain within the limits aloresatd, or who being the owner of or having control ol any such water cralt, shall neglect or fail, or refuse to abate, or remove such nuisance lnstauter 011 being sodded so to do, by . any officer of the corporation of said town, locevery hour that he, she or tliey shall so neglect, fail or refuse, shall forfeit and pay to the said rresideut and Trustees for the use ot said 1 own any sum not more than htty dollars nor less than five dollars with costs of suit and such nuisance may moreover be abated or removed by the corporation niarshall in such manner as he shall think fit and right. Sec 2d. That so much of an ordinace passed January outn itf lJ, entitled, An ordinance concerning nuisances, as requires ten days notice to be given to persons who are by said ordinance made liable to remove or abate any nuisance or uuisances in said ordinance specified be and the same is hereby repealed.
