To the Common Council of theaCity of Evansville: a, We notice by a communication in the Jonas! AL of this morning, signed by , James G. Jone 'Esq., that we are en- '' flounced, with othiers, as Directors of the Evansville & Cincinnati Railroad Com- . t piny. ;This announcement is made under such circumstances es would leave the public to infer that we are in lavor of the subscription of one hundred and sixty thousand dollars by the City to said Company, to aid in the completion of the Straight Line Railroad. We are opposed to such subscription at this time, and utterly deny that we have ever, as Directorsof said company, taken' anr-aotion having in view such a subscription. Wa were made Directors of company, for the-purpose, as represented, of preliminary organization only. NVe learn that bat one !,,,:iseting. either of , Stockholders or Directors, was ever held, . and that was the -meeting' tt which Directors were,' chosen. Since then no meeting, eithet ofStockholders or Di- , reotors bas been Leld,,to our knowledge, and nothing done, either officially or otherwise, to, anthorize the taking of subscriptions: - - ' We are utterly averse to making any subscription by tbe city, until it can be made to appearAhat the residue of the means necessary for the completion of the work, can be secured., When it can be mule to appear that sufficient means can be rAised to complete tbe work, we t will join ia stoking the Council to make a proper subscription on the part of the city We disagree with tfr.'Jones ináthe line of argument actipted by him, in bolding over the city the threat of the probability that the city will fail in the Straight' Line case now pending, and will, therefore, be compelled to pay one hundred and sixty thousand dollars--.tbe amount in controversy, Vl,'s think 'this cometi with bad grace from one wbo was concerned as 'one of the attorneys of the eity, in the earlier periods of the litigation between the city and the Straight Line Railroad Company. c Ye cannot , see bow a Federal point can annul or set.-aside the adjudication , of a State aonrtt except in cases rep.larly before' 4313 appeal or writ. of . , error. t', ,F ' A4 we we're selected Directors for the purpoie of ,, preliminary organiAation only, and , not for the purnose of Eon ducting and managing the affairs of the company ; and as no consultation has ever been held between us, and believ- - ing thet the que3tion has -not been fully and fairly presented to the people, we earnestly pal respectfully request the Council to rescind the order for the election on Monday next, and postpone the question until the policy of such subscription my be fully Aiscnsse-d and idemonstrated. i , . t JOHN J. CHANDLER, t HENRY C. GWAILTHNNT, r WM HEItMAN, t" LIV-Battett.-- " Feb. 1, 1866. In addition to the above .paper, in justice to ourselves we deem it proper to say, that so far 'from endorsing the policy of eatling upon the people, un- ',' der- present circumstances, to vote for the proposed subscription of $150,000, at the meeting referred to, at which we were made Directors,Gol. Jones was informed that we 'were of the opinion that before the people could be expected to sanction such a subscription, the owners of the roadbed would have to make a definite proposition .7, as to the terms upon which they would dispose of it; tbat he was advised by the Directors present, including Gov. Baker, as one of us recollects, to procure and 4? lay before the people such a proposition from them; and that he promised to write tk. them upon the subject. Never , Laving keen or beard of such a proposi Lion, if we had been consulted as to the election which has been ordered, for that, if for no other reasou, we would 'lave refused pur assent. . 5, y otomox. 4; LI JEIENBY g Cht4TEIMET) JOH i J. I mean the hairiness of hauling goods to and from tLe depoL I am told that some of oar shippers bare found it necessary, in order to get proper and' reasonable accommodations from the railroad, to give their hauling to this dray' monopoly. 'I am informed of one instance, in which a gentleman employed several drays and sent them , to the depot to haul , Lis goode into the ' city, and when they got there, the "draymen were told they should not haul the goods, anethe gentleman - bad -to pay them for going out and returning empty, and give the job to the adjunct monop- ; oily., Every independent draymani not connected with this monopoly, is injured by iL , They cannot get employment from their friends, which they otherwise would geL , , am also credibly' informed that the draymen not connected with the monopoly would do the hauling for but lit- . tie river one-half what the monopoly chargeo, and that when independent shippers employ independent draymen, these draymen are not permitted to take their regular turns at the places of loading and unloading, but must wait until they can find Olives which the draymen of the monopoly do not want to occupy; and it is suggested that perhaps shippers who will employ independent draymen, may sometimes find it impossible to hire cars or get thrir goothi forwarded :.promptly, when those who patronize the gentleman, dray monopoly encounter - no - difficulty of this - kind. -Perhaps a whose name. begins with the fourteenth letter of the alphabet, could correct any erroneous impression , that others may ' baste' on ' this subject. VOLUME XVII. , , . plenty of good coal in Sullivan county, which could be conveniently shipped by the ' Evansville Crawfordsville road to this city, and sold to the citizens at about five cents per bushel lona than they have been paying for coal from the Radiant mines. But for some reason this Sullivan county coal can't get over the hill this side. of Princetonas is said.' I bav3 not time or I would enquire of persons employed about the depot and machine hope, whether this is so or not, for it seems improbable that the hill is tbe obstacle. - I have no personal knowledge of these things, as I have had no business with the E C. A Card. Ed tor Joan al : , , In a communication in this morning's Journ21, Cot Jope's places my name in the list of Directors of the Evaneviile & Cincinnati Railroad Company. If I am a Director I have become so without my , knowitedge or consent, which, of couree, cannot be. Sometime last summer, at the request of Col. J., I signed his articles of association as a, stockholder, but upon his notifying me of a meeting for organizetion, I sent him a note stating, that upon reflection, I had concluded not to connect myself with his company and requesting him to strike my name from his subscription list, or if he preferred it, to procure another person to take the stock and I would assign it.' This, as I bad eupposed,' ended my connection with the company, and if after this I was elected a Director, it was witliont my assent; and as I never had any notice of such election, and if I bad bad such nýtice would not have qualified, I submit that Col. Jones' statement that I am a Director in bia Company, is incorrect and unwarranted. - Feb. 1st, 1866. - Ass IGILZHART. To the TaxPayers of Evansville: There is, evidently, not one but several screws loose in the organization of my, friend Jones's Broad Gouge" branch railroad to Cincinnati ; and since the revelations of - ",A , Plain Men" in ye,terday morning's Journal, I cannot possibly see how the compromitie branch of this branch ,road esti possibly be sustainefl. Not having implicit confidence in my own legal opinion, or in that of tbe anonymous lawyer of " Plain Man," I have just con. suited as good legal authority as I know of in town, and that authority backs up the anonymoul opinion and iny own to the fullest extent; so that this f160,000 that Colonel Jones has in a former letter told us would probablv be recovered, if we do not vote the $150,000, ia as good as out of the ring. , I am -not to be intimidated by the Colonel's array ot respectable names in the new company. I have yet to .find the first of.these gentlemen who -is not opposed to his project as now developed. The 'gentlemen named by bina will have the Opportunity of cleaning their position , at the public meeting at the court house; where, also, I propose to give Colonel Jones's position as heretofore defined by himself, and thereby to 'how that I am guilty of Po recklessnets, or want of candor either, iu charging that bis pro-, ject is that of strangers end aliens to thii community, and cannot, if carried out, be productive of any good, bat of great evil, to our o.wn people. ;OHM INGLE, ,711. : NIA:13,Tt110 . 4LBEUBSELAW.to -,ott Tue.4117 morning last. at the tes:dsumt of the Thu.
