The Democracy of Indiana have been j grievously disappointed at the failure of the Union party to take ground in favor of negro suffrage. ' The Evansvillians, in large numbers, had innumerable opportunitiea of see ing Grant where Confederate and Demo cratic ballets rained thickest, as at Fort Denelson, Shiloh, Champion Hills, Edwards' Ferry, Yickaburg, Spottsylvania, and elsewhere. I cheerfully recall ail 1 said about motives, and while I admit that there was nothing "criminal in letting the people see, in the plain common sense language of Judge Pitcher just how this matter Stands, yet for the sake of soma of my good friends (ot whom I have always considered Mr. Chandler one) I would that he had not done it, for it is to be feared tbat the consequence will be a depreciation of the. vaiaa. cf their gas stock. friend at Henderson sends us the fol" towing communication clipped from the Henderson Neves, in relation to the late homieide in a saloon in that dty. Tbisr communication pats an entirely differ ent phase on the affair. The fact that H had bee a in the Federal army was a sufficient incentive to Hon! II W. Pow ell to defend his murdererr " J ' (' ommnaicated-) -' Ma. Editor: On last Monday, Sept 11, 1355, about 6 o'clock, A. M., a mas riamcd Wm. Harris, (a discharged sol dier from the Federal army,) stepped into the restaurant of Mr. Applegate, called for a drink of liquor, drank it, aod, in the language of an eye-witness, laid down oo the counter, either Eve or ten cents. ' The proprietor of the house demanded that he either pay fifteen cents for the drink or leave the honse. Harris did neither. He was a second, ana perhaps a third time, ordered to pay or leivo the honse. At this juncture a yogng man in Applegrate'a employ, as oar-keeper,- named Henry Kokernot, picked Op a pistol, tbat was ly ing on a shelf nnder the counter, walked round into the ; room aad ordered Harris out of doors, at tha same time laying bold of him as if to put him oat by torce. ti arris either shoved aim back or struck him and knocked him back. Mr. vV. W. Cailie, then caught Harris by one arm and whirled him about facing the door and near to it, with his hack to Kokernot, when he (Kokernot) fired his pistol with deadly aim a. Harris, the ball taking effect in the back of hi head, killing bim almost ittaiaut y. ' Kokernot fled out at the back door leaving the bouse. He was arrested the same evening aad lodged in the county jail ontil the next day. A Coroner's inquest was held over the dead body the same night Tba verdict of the Jury I have not seen. On Tuesday forenoon an examination or primary trial was bad at the Court House, J asttces Walker and Lockell on tha bench. Hon. L. W. Powell and L. W. Trafton, Esq , were counsel for the accused tha Commonwealth not being represented by counsel. After bearing the evidence, which was in accordance with the above statement of facts, and tha arguments of defendant's counsel, the Court concurred in the opinion tbat the homicide waa committed ia telf-de feose, and set the prisoner at liberty. . Whether the Court did right or wrong is not' for me to say. '' The gentlemen composing it are both honorable men and above suspicion for corruption though in my opinion, they betrayed a want Of legal acumen. A storm ot in dignation has, however, arisen in this community in consequence of the decis ion, and the manner of the trial. It was certainly the duty of the Coart (whether they knew it or not,) to bare supplied the place of tha absent County Attorney by a pro tern, appointed for the occasion particularly when tha Coart saw two able lawyers employed by the prisoner. A decent respect for tba Tin dication of the majesty of the law, ahonld have dictated that act of doty on tha part of the Court If it had been done, certain absent winessea would have been obtained before the trial was ' entered into. - A fair and full investigation would have shown that the first wrongs were done to the deceased man. He was sold liquor when he had already too much, and men an endeavor to extort more money from him for it than the law al lowed to be charged. For that selling they are liable, and had they succeeded in getting the money they demanded, they would have been amenable to the law for that also. In the difficulty, then the accused made the first breach of tha law. . I now propose to show that though no attorney appeared for the Common wealth, that her case wo most clearly made out. to do which was simply to show that a man had been killed, and who killed htm. No one who heard tha evidence, baa the slightest misgiving as to the killing, or as to who did tha kill ing. It then devolved on the defense to prove tbat the killing was necessary to save the life of the party killing, or his body trom great personal injury. The law says: "To justify the killing, it waa certainly necessary that the detendent ahould have believed, andhad reasonable grounds to believe, tbat the deceased was then about to kill him, or in3ict on bim great bod ny harm, and that he had no other apparent meanaof protection or escape. lI Metcalte, iib. ihe tact that the man killed was in the hands of a police officer a brother in-law to the one who killed him and that his back was to him also, and him in motion toward the door, precludes the idea tbat Kokernot s life was in the least danger, or bis body visible to aoy injury whatever from the deceased. I have paid no attention to irrelevant matter detailed by witnesses, cor to alleged contradictory atones told by the deceased to different persona on the last fa'al day of hia life: for, if true, it afforded not even the slightest pretext for shooting bim down like a rabid dog in the streets. It was a public bouse, so li censed by law, and any man had a right to be there during business hours, if he demeaned himself with reasonable deco rum.
