We regret we were not in our sanctum the otber day when Capt Dick Miller, late of th765th" Indiana"," called upon us, ss we always are glad to see (ha bravo young men who have perilled their lives in the : cause of their' country, and especially those who, reared in the school of Democracy, had the patriotism and courage to dissolve paxty, ties and even family connections to up , hold the causa of right, of justice and humanity. ' - t . For this noble act of patriotism we are glad to learn that the Union men of Gibson county bare nominated Capt Miller for the office of County Clerk, and we hope every loyal man in the county will rally to his support, and triumphantly elect him. The returned soldiers will, of course, vote for him. Capt Miller entered the service as "a private, and rose to Captain on merit, aod stood by the flag nntil the war was over. - - - - - - ? n -f The Adcltsrt Casb Oscar . Hall and Mrs. Brewer, charged severally and id special with adultery, abduction, Ac, whose case we detailed some days ago, had a hearing before Justice Walker, who,' by tbe eloquence aad logic of counsel, was convinced that it was bo crime to ran away with another man's wife. He therefore discharged the parties. ! , : - The injured husband, we ara told, gave the erring wife a five dollar bil' and gave her permission to go to tbe gentleman in black, a journey it seems she had already set out upon. ' It was further intimated to us that some third party had spirited the frail fair one from her gay Lothario, who procured a hack and started in pursuit ' If it Is no crime for woman to run away from her no-bend with another man, it should be made a crime for tha husband to follow her.
Eet-order's Court. His Recorder's Court was not particularly crowded on Saturday afternoon. Early in the morning, on Pegafass was fined 1 1 and costs for offering to Bel wood that had not been measured. v In the afternoon, a hard looking case of the female persuasion, was presented on a charge of lewdness, being foundtn an unfinished building in company with
a man in the dark. She called herself Malisaa. Fisher, and having but .little money, she. was let off on a promise to leave the city - immediately. : She stood not on the order of her going, but went L. D. Tbe police, howev er, interferred with this little 1 domestic arrangement, . and 5 Recorder Nelson charged him 17 20 for " his lodging, and the polite attentions 'shown him. .' ' . ' ; Anton Rosenkranz charged one Tave ner Gore with having' committed an asi eault and battery upon bim and his wife, having, as he expressed it, struck the late ter with a "brickaliue," and made a black face on her shin, in corroberation of which, : the . madatua loosed her"garter and exhibited tbe bruised limb, and the mark of tW."bricketine.?i" Gore ' was not ready for trial, and the case was con tinned until two o'clock to-day - s V Dissolved. The1 bnsi ness of the Court of Common Pleas 'was finished on Saturday, and the Court ad jour ned finally shortly after . noon. A large amount: of business 'was transact ed, mostly of a civil character ''Among the n'ost interesting items to tbe citizens ot vanevUle, was tbe optn ion delivered in the case between tbe Evansille Gas Light Company and the City of Xivansvilie, involving tne .righf of the'( former to collect its present price f'orgas.,- This case was 'submitted on Saturday to the court oil demurrer, and His Honor,' Judg Pitcher," decided that the contract between the Company and tne city was void,, : The following is his opinion on this point: 1 J vl By the ordinance of the city, which, I accepted by the Company, is the . con. tract sought to be enforced, the . city grants to the' Company the exclusive privitegt of laying pipes for conducting (fsa under an tne streets ot tne city tor fifty' years, , and the- Company agrees during that time for' the prices therein provided vr supply 10a cuy ana us inhabitants with gas. " Upon a careful ex amination of the Charter of the city, and its various amendments, I nnd . no grant of power which authorizes, or purports Mo authorize, such a contract . . I very much doubt whether it would be competent for tbe Legislature to confer such a power upon a municipal corporation, or even to exercise it itself. ' How ever that may be, it not only does not seem to have attempted to do so in the present 'instance, but even - the ordinary power on' ' the - subject Which; is "common to the general law for tbe :r?orporation or cities, and man of the " special acts of incorporation have looked into, such as the power "to construct ana establish eas works, "to provide for and regulate the lighting of i He streets, Sc., 1 nnd entirely wanting in the charter of the city of Evansville. 'And without an express grant of some sucn power in ner charter, the con tract is, i tumir, beyond question, void. Municipal corporations are held strictly within the powers granted in tbe enactments under which they act as corporations. Their powers must be clearly and expressly granted. ' City of Lafayette v. I was employed by Mr. R. as his deDu ty on tbe 12th of August, 1865, at a cer tain salary, to commence from tbe 1st day of October, the commencement of Mr. It s term of otlioe. Un Saturday, tne za aay oi septemoer, tne day of the Union County Convention, and while said Convention was still in seseion, Mr. R. came to me and said; "There seems to be some objections made to my appointing you as my deputy," and upon my asking who it was that bad made ob jections, he replied, ."Mr. Biacb, in presence.oi otners, tola me 1 ought to employ tome one else." I replied that I thought I was qualified to fill the position, having served in that capacity already for five years, and could not see tha reason why objections could be made by him; and tbe following was Mr. R.'s reply; "I was elected by the Republican party, and that party would ' like to see the office carried on by Republicans. I do not want to act a traitor to my party, and therefore ask jou to withdraw My answer ws that, if his party wished me to withdraw. I would do ao Mr. R re. The above was the card Inserted in tbe Evansville Democrat " As every body will see, I neither affirm nor deny that Mr. BiAch said: " jio Democrat should bold office in the Court House; or something similar." That question still remains open. n - Mr. Biacb ia his article of Saturday says, his reasons in speaking lo Mr. R. concerning my appointment as deputy Treasurer, was to secure tbe position lo some disabled soldier, ate Now Mr Bisch cannot boast aa - being
