We j - have aot yeceived a copy, bat take pleasure in furnishing our readers with tbe view of the Indianapolis Journal, whose editor is aa excellent lawyer, as to the valuYof tbe work t !, j . fta twenty-third volume of the Iadiana Reports has just been issued, containing tbe decisions of tbe last November term. It is made up chiefly of tbe opinions of the new Judges, and to the profession will be one of tbe most interesting volumes which have appeared. It is issued under the auspices of tbe new Reporter, General Ben. Harrison; but in consequence of his absence until very recently in the military service, the principal labor in tbe preparation of tbe vg.'orce has, we learn, been performed by J. T. Dye, Esq., who ha executed the task with commendable care. It contains over seven hundred pages, and (in consequence of the opinions being generally concise) an unusually large namber of 'cases. We have not space to notice many of tbe questions decided, but wa are glad to see that tbe perplexing question. Upon whom rests tbe burden of proof ? and Who baa tbe opening and closigg in civil cases? is at last settled by an intelligible and certain test, and to know, after considerable conflict of decision, what sort of opinion formed disqualifies a juror. Many important questions relating to criminal law are also discussed and settled, and some previous decision have been overruled npon grounds which, we are sure, will be satisfactory to the . profession. The volume t peculiarly rich in decisions npon S'ate constitutional law, and we at last have a sound and satisfactory interpretation of the provision concerrg tha titles of legislative acta . We are pleased to observe that tbe old rule has been shaken ibat a contract for forbearance cannot be set op as a defeuce to a suit brought before the period of forbearance has elapsed, sod that a more enlightened doctrine begins to prevail in relation to actions npon covenants of indemnity. Numerous interesting questions are decided relatiag to tbe measure of damages in suits npon v ariose classes of contract; to the liabilities of railroads for injuries to persons and to live stock, and points bald which have not undergone adjudication, so fac as we are informed, in other court. -We notice two interesting decision! relating to married women the first tbat a- deed duly delivered by hatband and wife is not void as to tbe wife merely from not having been acknowledged by her, and that a deed from a husband to a wife, without tbe intervention of a trustee, may be valid One marked .improvement bow first : introduce' ia our reports, and but recently into aay, is a reference in the eyllabus to tbe page pn which each point abstracted i "discussed.
