T50len ia marriage, and against those parties for beiDg so uuited, oontrary to the State law, were dismissed tyJa3tice "Walker, yesterday. In the case of Mr. McFarland, no ono arpeared for the prosecution. Major H- A- Mattisoa appeared for the defease, and admitting the marriage, the fact that Van der Medo was a white mao, and BoIct a negro woman, he pleaded that the civil rights act of Congres3 bad nullified the State law prohibiting such marriages. That marriage being declared a civil contract, and the civil rights law givicg to colored p-.cple, among other rights, that to make and enforce contracts, all Slate lavs conflicting with it were rendered void. The Court taking the same view of tbe" matter, tbe prosecn'icu was di3 miFSfd. The examination of Van der Mede and wife took place in the afternoon. ' before the same Justice, Col. Chas ; Denby appearing for the prosecution, , he simply referring to tbe State law relating to the case, the facta beiog admitted by the defence, and asked that they should be held Major Mattison again -leaded the i civil rights law with the samo argu ment as in the previous case. I Colonel Denby contended that as a police regulation, the State had a right to pass laws preventing the intermar : riage of blacks and whites, as it had j to pass laws preventir g tbe intermar riage of blood relatives. That tbe argument of the defetce beicg that this wa3 a c;v;i confractt wa9 cot goorjag ,t proposed to give cot equal Tghs t0 a negro, but a right to a 1 bife man t0 farrf a nfr0 womaD' when the right of a negro man to ! m"ry a wJ,te W0IEan was denied, ' This 9 the Proeecution of a white mn and D0 D10' hDCC .the "JJ1 .rights act had no application. He spoke of the difference between marriage and other contracts, and the ' conditions with which it was eur- ' rounded, tbe fact that it could npt bo . dissolved at the pleasure of the parI ties, and that the State had the same . , r ' riages as it had to prevent consanguineous marriages Major Mattison replied that all tbe regulations referred applied as well to black as to white. He did cot ask that a negro Bhould be exempt from any pro" i regulation, but that any man or any woman should have the right to marry when he p!eased, whom P". and w'e J . tll" T endorse tho taste of tho man who . , TT clfose to marry a colored woman. Denby had attempted to make, that this was a prosecution of a white man was mere sophistry. He asked no right for one man that was not cxto make contracts, could xike a marriage contract, subject to the same conditions a white person could. The Justice decided that under the oivil rights act, disabilities under the uifii 1151110 uijauuitK o UUUC1 111! Cloud's Invigorating Cordial We know of no remedy which has grown so rapidly in public favor in the immediate neighborhood where it was first prepared and sold, as Dr. Cloud's Cordial and Blood Purifier. We are gratified to observe that the sale of the medicine has increased so rapidly that Dr. Cloud has felt justified in having new bottles manufactured, from an original design by himself, in which tho medicine will here after be put up. The ingredients of the medicine are Eet forth on every bottle "Wild Cherry, Wild Potato, Blood Root, Mandrake, Golden Seal, Pyrophos, Iron, Simple Syrup, Pure Cologne spts., Aromatics, a. a. Q. S ," so that everybody may know ex actly what they are taking. For diseases occasioned by impure blood or deranged nerve3 the Invigorating Cordial has no superior, as the many thousands who have tested its merits cheerfully testify. Accompanying each bottle is a little pamphlet entitled "Life and Health," which contains a great many valuable hints and suggestions relating to giving medicine, as well as a great many valuable recipes. Wc advise every one, as the pamphlet directs, to read it and pass it to bis neighbor. See advertisement in this morning's Journal. The Other Hotel Tiiief Arrestid.
