': sThe first ca?e disposed of was that of Hiram C. Napny, Administrator of the estate of John W. Grant, deceas ed, vs. Dr. Runcie. Dr. Runcie and Grant had been . partners in a mill at Millersburg. ' Ranch) furnished tho money and Grant managed the business. Shortly after having " drawn f 2,000 from the bank for business purposes. Grant sickened and died before all .the money had been, .expended. At the time of his death Dr. Runcie took possession of tho balance of the money, which was his own, in fact.. To recover this money the action was brought by the administrator; Nanny, x. jury wa3 empanneled and a portion of the testimony disclosing the facts above stated, when the ease was dismissed. . . . ; , Tho case, of Jacob Mann, F. F. Vaughn and Allen C Hallock et ah vs. William II. Walker et al, composing the City;Councilof Evansville, was taken up and disposed, of. ; This is the celebrated case brought against the city to compel tho removal of the Fourth .Street or jUpper .Market .House. It waa tried by the court, and judgment rendered for the plaintiffs.; ) Judge- Johnson, in delivering the opinion of the court says :;", It is therefore considered by the court that the ' market : housa mentioned . in the complaint, is a publio nuisance, and the court finds that, by reason of the .maintenance thereof by the defendants, as the Common Council of the City of Evansville, the plaintiffs, whose lots abut on the said Fourth Street,, have sustained damago to tha amount of one cent caeh; and it is therefore further considered and decreed by tho court that each of the plaintiffs recover of the defendants the sum of one. cent as damages, and their costs and charges by them, about their. auitn in this behalf,.;, expended, ..and that the defendant,, in their i official caDacitv "as the. Common Council of the City of Evansville cause, the said Market House to. bo , removed from said Fourth. The case of Franz Cader .and 'Jo seph Albaoker, vs Richard Raleigh et,al.. was also disivssed of. : This Was an action to recover i pay for certain stone and stone work furnished Cnst and others, contractors, in buildiag the residence of the defendant, Raleigh, they having given him notice that they would hold him responsible. The defense set up was that when the notice was served that he, the defendant, had already overpaid the contractors for the work done by them under their' contract. " Tried by the Court and judgment for defendant; exceptions taken and an appeal prayed to tiio Supreme Court. ; Robert Dixon vs. Thomas Whited was also disposed of. This was an action for damages sustained on landing a coal boat. Tried by the Court. Judgment for $57 75 in favor ' of the plaintiff; ; - ' " 1 - - Then came the case of Christian Stciger and Henry Renling vs. Ferdinand Karges. Tried by the Court. The evidence developed about the following facts: Steiger and Renling aro liquor dealers of Louisville, Kentucky; Steiger visited defendant an the capacity of drummer, and insisted on selling him a stock of whisky. Tho defendant declined buying; as he had already sufficient on hand. Plaintiff said ho would send him some anyway, and if he did not like it, he need not take it, but could let it lie. The liquors came consigned to defendant, who had them hauled to his store, where they remain subject to order of plaintiffs. The plaintiffs preferring the money to the whisky the price having greafjy declined brings this action to recover pay, but were disappointed. Buchanan For plaintiffs; Denby for defendant. After hearing the testimony, the coupsel for plaintiffs dismissed the case.i ; Then came up a heavy case James Niel vs. Anthony Thicle involving the enormous amount of $1 70. ' It appeared that Thiele held a Judgment against Niel, in satisfaction of which he agreed to take certain property a ad also tc- pay costs of suit in which the judgment was obtained. In .closing the matter; up, it appeared Thiele got off with $1 70 less costs than had been calculated upon, giving him that much more profit on the property taksn to Satisfy the judgment. Neal thought he was entitled to a drawback to that amount, and brought suit, conducting his own case." Defendant had two witi hesses on bis side, against one for plaintiff, and, as under our statutes a preponderance of evidence wins, Niel lost his cas, but added to his reputation as a counsellor at law. ;' i ' . Colonel Denby defended the easel The Court was anxious to take up another case, but as none was ready except- a dog. case, whieh are pro; verbially prolix,:, the Court adjourned over until morning. ., FxaHT. A fight occurred at a late hour last night, on Vine Street. We did not learn the names of the parties, or the extent of their injuries, -or if they were arrested. ; . . ( SnoT in the Leo. The receipts, at the 'extremely-low prices charged, .amounted to fabdut $40. These mites are unquestionably the cheapest and mot pleasant entertainments that can be devised.
