O'Biiea had shot a woman, on" W.aluuf ' Street,., near Ninth, the ball entering the middle of her forehead and killing her instantly. The City Marshal,', supposing he had a first-class case, scattered his force in all- directions, while himself and Deputy took horses and .started in pursuit of the reputed murderer. He was soon picked up, but on visiting the house where it was reported the marder had -.been committed1 it was found that no shqoting had been done. It appeared, however, that a controversy had existed between- the parties in regard to some furniture, . which had; been decided yesterday morning, before one of the Justices of the Peace, in favor of the woman, and that O'Brien, on returning the furnitvre, had assaulted her, and had struck , her in the mouth, knocking out one or two teeth and cutting her lip. He was taken before Recorder Nelson and had a hearing on a charge of assault" and battery with intent to kill. Lewis C.Stinson appeared on behalf of the State, and Col. : Denby - for .the defense. The woman testified that O'Brien had drawn a pistol and snapped it at her, and had then struck her, with the results indicated. Another woman testified that he said he was going to make an end of her, and had drawn a revolver four shooter when she ran away and saw no'' morei The case was submitted without argument, and the accused was held in the sum of $300 to answer. Two citiaens testified to the previous general good character of "the accused, which fact, the Recorder remarked, had induced him to fix the bail at.$300,-instead of ?500.
