The River was rising slowly. ......The favorite Louisville packet "lit tle" Grey Eagle is at the wharf, and leaves for Louisville at noon to-day. She is the "star" packet. ......The D. B. Campbell is the regular Green river packet. She leaves for Bowling Green this evening at her usual hour. ......The elegant passenger packet Dunbar is the regular boat for all points on the lower Ohio as far as Paducah. She leaves for that point at 12 o'clock to-day. ......The Lue Eaves did not get away on Saturday. She leaves this morning for South Carrollton and intermediate points on Green river. The Gen'l White is the regular boat for Henderson. ......The levee presented a busy appearance on Saturday, and a larfe amount of freight was shipped. All the boats leaving had good trips, the Cairo packets particularly. The Charley Bowen went out with her guards in the water. ......Capt. P. G. O'Riley's wharf-boat was towed up to her old position near the foot of Main street, on Saturday, by the Diana. The latter was on her way to New Orleans on her first trip this season. She has been thoroughly painted and refitted and was looking as neat as a bride. ......The little Grandview freighter which is being finished here is nearly completed. Uank Id tin- Supreme Court of the State of Missouri, an opinion was lately pronounced on tbe power of a town or city to assess bank stock anil levy a local tax thereon, which we regard as of some importance. The case was 7 he Mayor, &e. of Lexington M. Robert Auli, President of the Fanners' Bank of Missouri. The Bank was chartered in the winter of 1807-8, by the Legislature ot Missouri, and the statute provided that in consideration of the privileges granted by the act incorporating it, the corporation agreed to pay the State, annually, one per ceit on the amount of the capital stock paid in by the stockholders, other than the State, which was to be in full of all bonus and taxes to be paid to the State by the Bank. By the act of in corporation of tbe city of Lexington, it is provided that the Mayor and Board of Councilmen shall have power, by ordinance, to levy and collect taxes upon real aud personal property within said city, uot exceeding one-half of one per cent, upon tbe assessed value thereof. By ordinance of May 12th, 1SS9, the city imposed a tax upon shares of incorporated companies, excepting mnnut'actui iog companies, the property of i"v alone was to be taxed. Mr. Aull, the i-'roeident of the bank, refused to deliver to tho city assessor a list of the shares of the 3tc.k held in said bank, with the names of the persons holding the same, as provided by the ordinance; whereupon the citv commenced an action against him to recover the penalty ot $1,000, provided by the oniin'mce in such case9. The suit was entered in the Mayor's Court, and, on hearing, tbfi city obtained a judgment for the amount of the penalty and the costs. The defendent appealed to the Circuit Court, in which the judgment of the Mayor's Coart was reversed, and thereupon the plaintiff took the case to the Supreme Court on a writ of error. On hearing of the ca?e in the Supreme Court, the judgment of the Circuit Court was reversed. From the opinion of the Court, which we find in the Missouri Expositor, we extract the following: The city of Lexington was incorporated with a power to levy and collect taxes on real ami persona estate within her limits at Use timeol t lie incorporation of the Farmers Bank of Missouri. There is no hardship in making Uwse who reside or do business in incorporated towns DC cities contribute to defray the expenses incurred for their government, by which conveniences are atforded and a degree of protection furnished, not enjoyed by those who arc not members of a municipal body. These advantages are obtained by means of taxes imposed on the inhabitants of the town or city, and are over and above those possessed by the peo pie of the State at larije. The citizens of the State pay a tax for the support of the Government which protects them. The inhabitants of a city, being also members of the State, pay the same tax for the same purpose, but being, too, members of a municipal body which atlords them advantages in addition to those possessed by the people at large, they, In order to enjoy those advantages, are compelled bjpay a tax to which the State at large is not subject. Under our system of government, there are what are '.-.tiled State taxes, paid by all the members of the community, aud corporate taxes, paid by the inhabitants o' a municipal body. We can not suppose that hese considerations were overlooked by the General Assembly in chartering the bank. In providing that for a consideration, the tank should be exempt from taxes to be pad by the State, it could uot have been intended to interfere with a matter with wheh the State had nothing to do. The payueut of taxes to a city is a matter between the city and her inhabitants. If a town wants advantages not prejudicial to the res of the State, and is willing to pay for then, it is no concern of the State. If we puti construction upon the charter which will exempt the bank from the city tax, we nia.e the State guilty of the injustice of takiig away that tax from those to whom it ightfully belongs. If what the State receive is in full of all I taxes, State and city, void she not hare made some provisions bp which a propor- ; tional part ot the bonus-"! e exacts would be paid to the city ? Witl what justice could the State go into a cit- and take a bonus from a portion of tbe ci 7-ens to be paid into her own treasury, in "onsideration that they should be exempt fi m the city taxes ? How unjust would it be the city.
