John Marshall waa chief jneuoei John Marshall, the mpst eminent jusrist of modern times, whose decisions an- quoted and respected in England. Chief Justice Marshall, the whole court concurring, paid that Congress, and only Congrees, had the power to govern the territories, and gave as the reason, that if Cuhgn s had the power to acquire Territory, she hud the power to govern. The power to buy or conquer implied the power to control. One uniform course of authorities nuwo ttia to have been th oiiniA of the Supremo Court as to the power of Oongress, np to about four weeks before the passage of the Kansas Nebraska Hill. All the authorities ere on one side. The passage of the Ordinance of IT87 under the Confederation, the concurrence in that measure by the first Congress under the Constitution, the laws of 1798 and 1804 forbidding the taking of eluves into certain territories for sale nnder Revere penalties, the refusal to remove the prohibition of 1787 by Congress in 1809-10 on the petition of inhabitants of the Territory of Iudiana, the uuanimoa opinion of Mr. Monroe and his Cabinet, the decision of the Supreme Court, at the head of which was John Marshall, in 1828, all show this to have been the general opinion as to the power of Congress. Washington, Jefferson, Franklin (at one time, with John Marshall, art officer of an anti-slavery society in Richmond), the Adamses, Madison, Monroe and bis Cabinet, Marshall, down to Jackson (who in 1S33 approved a law of Congress repealing certain Territorial laws enacted in Florida, that were distasteful to Congress), all these old sages are to be Bammoiled oa out side. On the other, Douglas and Breckinridge, young geutlemeu sitting on a log in the woods. The greatest heroes and statesmen and jurists of the age ou one j side. Breckinridge and Douglas and their followers got this new light ? Are we to be reviled and denounced because we ciing to the Constitution, as you did up to Six or eight years ago ? Mr. Corwin then alluded to the old Whig party and to Its great leaders, Webster and Clay. They always believed in this power of Congress, and so did their party. He here paid a touching tribute to the memory i!'Clay, and in doing so, we noticed that his emotions nlniost overcame him. He choked rrp momentarily and his eyes became suffused with moisture. Probably aone noticed this except those who wero clone to bim. but his emotion was very app&rcot.

Congress said to the people of thos? territones, uo, organise your temporary govern menu ; enact your laws ; Lmt refer them to us for onr approval." Here we see Congress, so lato as 1850, asserting its right to exercise this power over the territories. Mr. C. then showed the difference between Squatter Sovereignty and genuine Popular Sovereignty. Iu the former case, the Territorial Legislature, representing bnt a small portion of the people of the Government, make a law, but if it does not 6uit the Governor, the appointee of the President, ho vetoes it, and it has to he passed over the veto, not by a mere majority, but by two-thirds df both branches of the legislative asembly, if it is to become a law ; if it fails to obtain a two-tbirds vote alter it is vetoed, the will of the people is defeated, and oh man rales. He then defined genuine popular sovereignty to be that which was vested in the representatives of all the 30,000,000 people of this government. The people of the United Slates, whose blood sind treasure acquired the territories, all should have some say in governing thtm. A majority of the whole people should dcci le the institutions of the territories till they became Sovereign States. Instead of one man the President of the Uuitid States governing the- territories, he would have three hundred do it, as the sworn representatives of the whole people of the United States. The speaker then Vent off on one of his discursive flights, in which wit and eloquence abounded. He refucred to the exaltation of Babylon and to her subsequent downfall, and hold her fate up as a warning to those who grow luxurious and careless of the liberties of their country. He again gave assurance that the Republican party considered the South entitled to an efficient Fugitive Slave Law by the Constitution, and that the party Bays that fugitives shall be returned. Their candidate for the Presidency says so. The South had a law in 1793, 1850 and ever since, which Is as well executed as any other kw. We concede the right to have the law to onr Southern brethren. Here a seat broke down, as numerous others had done from the crowd of people ou them. Mr. Gorwin, iu his quick manner of gettiug off a bon mot, and with his inimitable style of expression, said to those who fell, " Von are humbled now that you may be exalted ia October." He then took a bird's cyu view of tho futnre, and pictured forth iu glowing terms tho glory of our country when its fertile territories shall be filled with teeming millions of freemen. He exhorted his hearers to act conscientiously in ciercieing the right of suffrage. He asked them to swear their consciences. j an 1 act as if they expected to die liefore morning, wucn they would have to rentier an account before God for the deeds done in the body. He ndvised them to make up their minds and declare) according to the doctrines and practices of the Fathers of the Republic. The audience were entirely absorbed in his eloquence, sod were loth to have him cease speaking. Ho had entertained them for over two hours with the most eloquent, able, and entertaining address many of them had ever heard. The foregoing sketch (written partly from memory, from notes taken umlei- disadvantages) gives a pretty fair idea of his maUer, the more augmentative portions of il;but the frequent amusing episodes and digressions, the solemn apostrophe?, the anecdotes told in his incomparably humorous c'-yle, the ironical resnarks clothed in mock solemnity, the dramatic outbursts of patriotic enthusiasm, the burning sarcasm directed at some luckless object, the ventriloquial precipitation of tho voice right at some x!ron singled out as an object of an appeal or joke all this, intensified and assisted as it was by that extraordinary countenance which can almost makeaapeech of itself without the aid of the vocal organs rendered this oration the delight of those who heard it, and one to be remembered with pleasure as long as they live. MeA of all parties were there the ladies were present it was a mixed aodienco, yet the attention was complete and the gratification general. No report can do Mr. Corwin justice. His extraordinary dramatic and physiognomical peculiarities defy the reporter's pencil. He must be seen and beard to be appreciated, as all know who have heard him. After the speaker closed, three cheers were given for Tom. Cor win, the Stur Spangled Banner was performed by the Band, and the audience dispersed to find shelter from the storm. That Kansas should, of right, be Immediately admitted as a State under tho Constitution recently formed and adopted by her people, and accepted by tha House of Bopreaeutativee. Thit, while providing revenue fur tb support of the general government by dutiiw upon Imports, sound policy requires such an adjustment of '.!. imposts as to oncourage tho development of tb industrial intereete of the whole country' and we commend that policy of national exchanges, which seenrcs to tho working men liberal wages, to agriculture remunerating prices, to mechanics aud manufacturers an adequate reward for their Skill, labor, aud enterprise, and to the nation commercial prosperity and independence. 13. That wo protest against any sale or alienation to other ot the Fablic I.suds held by aotual settlers, and against any view of the Feo Homestead policy which regards the settlers ai panpers or suppliants for public bounty , and we demand tbo (sissago by Congress of the complete aud satisfactory Homestead measure which has already passed tt House. 11. That the Republican party Is opposed to any change in our Naturalisation Lawa, or auy Stato legislation by which the rights of citizenship hitherto accorded to immigrants from foreign lands shall be abridged or impaired ; and in favor of glviug a full and efficient protection to the right of all classes of citizens, whether native or naturalized, both at home and abroad. 15. That appropriations by Congress for Biter and Harbor improvements of a National character, required for the accommodation and security of an existing commerce, are anthorized by the Constitution, and Justified by the obligation of Ooveranieut to protect tho lives and property of ita citizens. 10. That a Ballroad to the Pacific Ocoau la Imperatively demanded by tu interests of the Whole country ; that the Federal Government ought to render immediate and efficient aid in Its construction ; and that, aa preliminary thereto, a dally Overland M.ill should be promptly established. 17.
