Willard's New Albany speech. Every proposition of Willard's proven false. Delivered at Bloomington July 21st, 1800. CONTINUED. This is the man, covered all over with crime, that Gov. Willard appoiuted Swamp Land Commissioner. Let us examine for a moment his excuse for so doing. He says "I found Mr. Mirkel coming from the hands of his Republican supervisors in debt $101,386 77. He has paid all to the State lave $25,093 83. Was it a wise appointment, by which S75,000 was saved to the county of Jasper.'' Did Mr. Mirkel come to Gov. Willard from the hands of Republican supervisors. 1 think not. Talbott and Collins bad no control over him. It was Gov. Wright who had appointed him and who was his supervisor. Would it not, therefore, have been in rather better taste for Gov. Willard to have said, coming to him from u Democratic supervisor. But to the point. Is not that a rather remarkable excuse of Gov. Willard's for appointing Mirkel, that because a man is a defaulter to the State for more than $100,000, that you must appoint him to office, to give him an opportunity to swindle the State out of enough more to pay the debt for which he is a defaulter. It is clear if Mirkel was not able to pay, before the appointment, that if he became so in a few months atterwards, at a salary of 2 per day, to ay the State as the Governor says some $75,000, be must have swindled the State to that amount. In my judgment a Governor is inexcusable for appointing a public defaulter to oftire under any circumstances. After this man Mirkel's appointment a such Commissioner by Gov. Willard, let ua see how he conducted himself, and in what manner the Swamp Lands waid disposed of under Gov. Willard 3 administration. Th"i3 Swamp Land Fraud Report, in speaking of Mirkel, says: "I'nder tbi.-' law, (passed March 5, 1857) the Swamp Land Commissioner of Jasper county confirmed all ti." old contracts at 1!0 cents per cnbic yard, which had been originally let at from 12 to 18 cents per cubic yard, and the contractors were permitted to tile lists of InistVi to any amount they desired, and the amounts of their respective contracts were swelled up to cover tbe amount filed; and soon idler the taking effect of this law, all the unsold Swamp Lands in Jasper county, amounting to about 170,000 acres, were then absorbed, and nearly all the contractors, without paying any money into the county treasury, by private arrangements with Jacob Mirkel, tbe then treasurer of Jasper count y; obtain ed from him certificates of porch ase, and upon these obtained the greater part of their patents for these lands." I wonder if Col. j Hendricks ever rend this part of the Swamp j Land Fraud Report ? For it does seem to j me, that here is a Democrat, Mr. Mirkel, j whose frauds exceed Talbott, Collins and ) Company, by 51,000 acres of land. Will ha remember his promiso made to the pecpie of Monroe. And how is it possible that Gov. Willard should ever have signed the j patents, that conveyed away all these lands, ; obtained by fraud as they were. Was he deceived by this man Mirkel? If so, why dd he not plead with the Democratic represent- : atives, in 1859, as be did with the Republiean Senators in 1857, and urge them to join with the Republicans, and burst up all these frauds, and regain these lands. Is it because he was opposed to the bill and felt content with Mirkel's acts ? Let us turn to another county and see bow fortunate Gov. Willard has been iu his selection of Swamp Land Commissioners. This same report says: (see House Journals 1859, page 1043), " Your committee find that in Lake county, frauds of the grossest kind have been committed by the present Swamp Land Commissioner, S. It. Child., in connexion with the Treasurer and Dr. Stanton; that said Stanton, by the deposit with said Treasurer of a pretended check or draft, has obtained certificates for all tinunsold Swamp Land in the county, amounting to about 15,000 acres; that after the pretended letlings, the contracts lieing all bid off by Stanton each time at four cents per cubic yard, was afterwards confirmed to hi in at about forty cents per cubic yard
that Stanton has deeded the undivided half of these lands to said Childs ; thai Childs issued to him ditching certificates for $10, 000 on the 28th of Slay last, and soon afterwards other ditching certificate to tbe amount of between ?C,000 and 7,000, by which the pretended check or draft deposited with the Treasurer was taken up, and very little ditching is yet done. I for Here are copies of two of these pretended checks with their indorsements that were ; executed to this man Mirkel, for which j Swamp Lauds were obtained, and which he afterwards paid off, by issuing Swamp Land certificates for ditching, when the ditching never was done. . " Indianapolis, Oct. 1st, 1857. Bank of Bloom i n gton : Pay Jacob Mirkel, or order, five thousand tour hundred sixty-four 58-100 dollars. PnnA M. Kent. Geo. W. Spitler. M. G. Bright, (endop.sed.) " This check is not to be paid in money until January 1st, 1859, but at any time in certificates for ditching issued by the Commissioner of Swamp Lands, of Jasper county, within that time. October 1st, 1857." "Indianapolis, Oct. 9th, IS5T. Bank of Bloomington. Pay to Jacob Mirkel, or order, fourteen thousand five hundred and forty-two 7-100 dollars. Piiineas M. Kfnt " (ENDORSED.) " This check is not to be paid iu money until January 1st, 1859, but at any time in certificates for ditching issued by the Commissioner of Swamp Lands, in Jasper county, within that time." Do not these checks show fraud upou their very face ? Neither Kent, Spitler, nor Bright, ever had money deposited in the " Bank of Bloomington." There is no such Bank, but it is " Bloomington Bank, neither did they ever have any in Bloomington Bank, and at no time would their check have been honored, which they well knew. They were gotten up for a fraudulent purpose, by these parties, combining with this Swamp Land Commissioner, to cheat the State out of these lands. I venture the assertion, yon can't find a single county in the State, where there were Swamp Lands, but what the management of them abounds with fraud ; even here in my own county, where there was but little Swamp Land, the records show that eleven hundred dollars have been paid out for surveying and ditching, and yet there never has been oue foot of Swamp Land ditch made In the county. How is it possible that all these things can be done? It is a little remarkable that these Democratic Governors, who have watched over the interests of the people of Indiana to well, and whose sworn duty it was to see the laws faithfully executed, could have offered the people to be so wolully swindled. Have the people no remedy ? The question may be asked, why has not the Legislature done something in this matter in ferreting out these frauds and exposing the persons connected with them ? I answer because the Democratic party is opposed to having the investigation ; and during the last Leg- j islature, actually prevented it. Now for the truth of ray remarks, I appeal to the record. During the last Legislature, the j joint Republican Committee ou Swamp j Lands, Mr. Hamilton, of Boone, ami Mr. Greene, ot Tipton, as chairman, lerretedout these frauds as far as they were able, in the time allotted to them, in which report they exiiosed every person that they could find connected with them, without distinction of party, and among the rest Messrs. Talbott and Collins. This report will be found iu House Journal 1859, commencing ou page 1037, Senate bill No. 13 in reference to the:;e Swamp Lands, when it came to the House, was referred to the Republican Committee on Swamp Lands. This committee after thoroughly examining the subject, reported back the bill recommending the striking out of all said bill after the enacting clause and inserting a substitute which they had prepared, fully regulating and controlling these Swamp Lands, which will be fouiul iu House Journal 1859, commencing on poge 873, and among others, inserted a provision to burst up the whole of thee frauds, and regain to the State all these lands which had been obtained from her by fraud und corruption. Sec. 45 of the bill provides, 'The County Commissioners of each county are hereby Authorized and empowered in their discretion to bring suit, or cause suit to be brought in the name ot the Slate of Indiana, upou their relation against any ijJieer, person or persons, corporation . company, for the recovery if any lands ir iii-jii-ey rightfully belonging to the awamp I -i Fund, or for the setting aside of any fraudulent title to any Sn-amp Land, or for the . ;ifortementof any contract for the ditching a'ld draining of such lands." Now let us see OOW the Democrats acted when put to tbe test, and see whether they were in favor of having all these fraudulent conveyances of Swamp Lands investigated and set aside, aud the persons connected with them exposed, and the lands regained to the State. Mr. lurpie, the present Democratic candi- j date for Lieutenant Governor, and who was the leader of his party in the House, moved Iq lay the bill and report on the table ; tbe ayes and nays being demanded, the vote stood 40 for laying on the table and 40 j against it ; every Democrat then in ka j House, but Mr. Rowe, voted with the 40, j to lav the bill on the table, and every Uepublican voted against it but Mr. Colrove, (see House Journal, page 881.) Mr. Colgrovo then moved to reconsider the vote ou laying the report on the table. Mr. Prosser, who was a Democrat, then moved to lay the niotiou on the table. The ayes and nays being demanded, the vole stood 47 in favor of laying Mr. Colgrove s motion on the table, and 44 against it, every Democrat then in the House voting with the 47 except Mr. Rowe, and every Republican hut one, voted with the 44 (see House Journal, page 882-3.) So it will be seen that it , was strictly a party vote, the Republi ,ans all, with one exception, in favor of bursting up the whole of the Swamp Land frauds j and exposiug every body connected with them, while every Democrat but one opposed it, thereby saying to the world that they , wore opposed to theexposure of these frauds, and the men who were connected with them. The people will judye who were i their friends in this matter, and upon what party the res(onsibility of this great iuiqui- : ! ty rests. But this is uot all. Some days i afterward, wheu tbe question again came up : ou the same bill substantially offered by Mr. Griffin, a Republican from Lake couuty, as ; au amendment to Senate bill No. 13, (see House Journal 1009-70,) the question being ! on concurring iu the report, the ayes and noes being demanded, every Republican then in the House, together with four Democrats, voted aye, which was lo sustaiu the bill, and every other Democrat then in the : House but uiue, left their seals and broke a . quorum, thereby again uetVmiug Hie bill. ; Another vote being taken, there were just 1 , euough Democrats who remained iu their j

But at no tine were there enough Democrats who were willing to vote with the Republicans to pa3 the bill. After all these acts no man who is a friend to justice and right, and who is opposed to these Samp Land frauds and the persons who committed them, will longer uphold the acts of tbe Democratic partv, in thus defeating the will of
the people, but will huri tbeui from tiower. It won't do for the Governor and his allies, after these outrages upon the rights of the people, to hold the Republicans responsible any of these frauds, when they were willing and ausious to so behind the frauds of Talbott and Collins, aa well as the frauds of all Democrats who acted and conspired with them, and give back to the estate all that had been thus taken from the people by fraud. It won't do for the Democratic party to say they opposed the bill because it would take away the lands belonging to innocent purchasers. The law protects them, and the provisions of the bill do not apply to them, but to fraudulent titles. (CONTINUED TO-MORROW.) NEW ADVERTISEMENTS.
