Mr. Hunter read the list of members ot the constitution. It was headed Wm. Charles' Morris, President, and Kagil, Secretary. On handing the list to Brown, be exclaimed with a groan, that's my signature. With reference to another paper, he said, I have nothing to say about that. .A letter from J. It. Mr. Hunter then read tbe letter from Gerrit Smith about tbe Kansas work, already published. A number of witnesses were examined. The evidence elicited no farther facts. Here the prosecution rested. Joseph A. Brewer called. He testified that be was one of the prisoners in tbe engine bouse with Col. Washington and others. Brown remarked that the prisoners should share their dangers. They were allowed to shelter themselves as well as they could. Cross went out with a flag of truce, another also went out and came back wounded. Stevens and Kitzmi.ler went out: Stevens was shot. ' Afterwards it commenced raina ing very nam. i supposed btevens was dead. He laid near the corner of tbe depot. Heard groaning and saw Stevens moving. Asked Brown to send a man to relieve Steveus. Brown refused to send one, because be would be shot. Tbe witness wa3 allowed to go and assist Stevens into the hotel. The witness returned according to bis pledge in to the engine bouse, and was sent several times by Brown, to request the citizens not to shoot, as the lives of tbe prisoners were endangered. Negotiations were going on between Brown and the' prisoners before the general firing commenced. Brown pro posed 'that he should retain possession ' of what he held, including the armory and ne groes. Washington, and all, seemed to acquieco in thia - arrangement. Cross. wa3 sent out to confer with Beckham aud others on the subject. A guard went witu him who were immediately bred on. After that, Stevens wanted to khoot, but Kitzmiller appealed to him, and they ".rent out together to stop the firing. When thev did not return, Brown seemed to show temper, and there was a change in the ar rangements. - After that Brown said be bad it in hh power to destroy that place in half an hour, but would not do it unles3 resisted. Think a shot from the water-tank . struck Coppe. He then returned the fire, and some one said that man is down.
