FRIDAY MORNING.. JULY 8 The theory of a perfect constitu tion for a Republic is to permit the widest range of freedom andmoreself control, that in rompRtible with the public peaceand safety, to erery individual citizen; and, next, to leave to the municipal organizations as wide a control of affairs as a regard for the peneral rights of the State will permit. The fundamental idea of civic liberty is to allow every citizen the largest sphere of self government that his intelligence and morality render ate for the Statet to grantThe broadest depository of civic power should be in the munincipa! organizations, hi order that every community or association of men, should be.asfaas possible, unrestrained i n thepecul iar developments ofjt heir particular interests and character ; and to give the freest scope in the pursuit of happiness, the grant of self-government should be as extensive as the good order and rights of other portions of the State will allow. Each grade of municipal authorities should be c lothed successively with all the powers it can be safely entrusted with ; the lower and broader the foundations of government are fixed in the sovereignty of the people and shorter the column and narrower the apex and lighter the capital the more solid and durable the structure. Educate the individual citizen as far as practicable for self-government ; next give as much the power of mM control to the primary civil organization?, as their authority extends, the powers and the objects for its exercise ougnt to be more general in their nature and fewer in number. The excellence of a constitution depends ..on the wisdom and correctness with which it distributes the particular and general powers of government to the various depart men t.4 'uid successive civil organizations. De Tocqueville traces the energy of Amer ican Democracy and its capaeity for selfgovernment to the influence of the primary meetings of the people; and their ability in the management of Slate and national affairs to the education they gain in conducting the affair of the townships and villages. ''When the power that directs the general interests of the State usurps the direction of 'ocal and particular affairs, it centralizes all power and soon assumes the form of a despotism ' Our State Constitution violates all these maxims of democracy, and proclaims a .lo -potic uniformity over a large State in its municipal and local regulations. Regardless of local circumstances, peculiar condiiioos, and differences in habits, taste, education and wants, no one community can have better or more schools, different regulations for checking vice and immorrality, and the promotion of local interests than is established for all others. All are condemned to the level of the lowest; ana the progressive must drag along in the slow pace of the dullest; the moral and refined are made yoke-fellows of the ignorant and debased, in order to establish that degraded ..uiformity of political and social conditions which despotism, either imder the ml of a monarch, or demagogues, delights to enforce. Equality and uniformity of miud, want.s or conditioos are not the characteristics of liberty or of democracy ; the free spirit of Ijoth is the creator of diversity and inequality in the wants and circumstances of men and romrnunitiiv. Freedom develops tinman, frees his energies from shackles to yoke-fellows and master, and gives him lowerto Miape his own course, and form his own condition. The same principle is applicable to communities.
