recite the reasons which led the Legislature
to the conclusion that an emergency exieU for the immediate taking effect of this act. The old constitution permitted the Legislature . to put a law - in - force in case of emergency, from and after it? passage.-1 Under that constitution! the Supreme Court decided that : the" Legislature tras the sole; judge of the emergency. The practice was not to declare the existence of an emergen- I cy, but simply to declare the act in" forcei from and after it3 passage. The new constitution diQer3 from the old only in this, that the emergency which exists must be declared in the act. Now, what is this? The fact that an emergency exists, or the reasoning by which the conclusion is gained that the emergency does exist ?: Clearly not the latter. For then it would follow that the courts would have the power to review those reasons and judge of their sufficiency. But the courts have nothing to do with the reasons which induce the Legislature to ptissalaw; and as little have they to do with the reasons which induce the Legislature to conclude that an emergency exists for the immediate taking effect of any given act. To this point I desire to read two or three passages from the opinion of Judge Stuart inj the case of Beebe vs. the State. He says: "The subject, necessity. policy and expediency of. a law are matters of legislation." '.What a law cbould embrace involves questions of policy more properly legislatire than judicial. Whether an act is politic, or expedient, or necessary, is not the question with which the courts have anything to do." " This court has, therefore, no duties outside of the constitution ; and surely none of a legislative character conflicting with the expres3 letter ofthat instrument. Court are not to array their own reason against that of the Legislature. VTe cannot declare an act valid because it conflicts with our opinion of policy, expediency, or justice." It has been said that the Supreme Court ' has decided this point against the view which I have just presented. This is a mistake. This point has not been directly decided by that Court under the present constitution. An intimation ha3 been given in the case of Hendrickson vs. Hendrickson, Cth Ind. E, ' art. 15, which sustains the view I have taken. It is as follows : "The Constitution, Sec. 28, article 4, provides that ' no act shall take effect until the same shall have been published in the several counties of thi3 State, by authority, except in cases of emergency, which emergency shall be declared in the preamble, or in the body of the law.' '.' It is hardly necessary to say that the declaration of emergency hero contemplated could not be taken by implication ; it must be expressly declared, in substantial conformity to the requirement of the constitution. It is therefore obvious that the declaring an act in force at a future day, as in this case on the first day of August, 1856, is no declaration of emergency, but simply fixing a distant : period with a view of giving sufficient time for the act to be published and circulated by authority." I In this view of the subject I ask the authors and friends of this bill why they will persist in retaining an obnoxious and useless recital in the sixth section? ' 'Where is the necessity of placing the gentleman from Floyd and myself in the position of enemies to this bill. For just so surely as you re tain this section as it is, just sosurely will we vote against the whole bill. e are not only willing, but anxious, to vote for a bill. which, by the wisdom of its provisions, will forever shut out all possibility of re-enacting the disgraceful scenes of the last session. v e are wining to sav that an .emergency does exist for the immediate taking effect of this act. For we hold it to be true that the State should at all times have some such law to guiird the disorder which might arise from the death, resignation or incapacity' of it her one or both ot the senators tocontinua in the service of the State. Were any principle nt. stake with the friends of this section in maintaining it as it is, I would not ask thm to surrender it. But I have shown you that no possible good can come to you from retaining1 it. While surrendering it you relieve the gentleman from Floyd and myself from apparent hostility to a measure otherwise right in itself, and likely to be henefi4'ial in its results. The work on-the Victoria bridge at Montreal, Canada, has been pushed forward so energetically that the bridge will probably be-opened for traffic in October, 1859, instead of Jan. 1, 1,100, in accordance with the contract terms. The past 'season 3,281 men were employed in its construction, including 450 men employed at the Canada Works, Birkenhead, in melting the' tubes. Fire steamer, C.I barges,. 21 Vow'3," and .27 terry and row-boats, 142 ' horses, 3 locomotives, 17 pumping, hoisting, and stationary, enginei, 2 rivet making machines,' aud 2 riveting machines, were cmployod ou the work. The total length of the bridge over the St. Lawrence is two miles, less 150 feet. It is iron nod tubular, and consists of 23 i'pnns of 242 ftet each, and one iu the centre of 330 feet. The spans are terminated on each side by causeways terminating in abutments of solid m asonry, 240 feet long and 90 feet wide. The northern causeway is 1,400 feet long, and that on the south TOO fret. The bridge is being built for the' use of the Grand Trunk Railway through Canada. When completed, it will be Aw. gigantic wovk of the continent. TUESDAY-MORNING.. ...DECEMBER -23 i Mr, Blytbe'si Speech. tV'e publish this' morning .Mr. Blythe'a speech on the Senatorial bill, which was finallylost in the House for want ofthe Totes of Jlr. Davis, from Floyd, aud Mr. Blytho. W were mistaken in the supposition that the bill had lieen passed in the House over the Governor's veto,'and that the U.S. Senators had been elected under it. They were chosen under the joint resolutions introduced by Mr. Cravens,' and passed after the loss ofthe Senatorial bill. The position of tho newly elected Senators will not appear as strong elected in this irregular manner under a temporary joint resolution, as if made under a regular constitutional enactment, designed to fix a rule for proceeding in for the future. ' - Many will lament that Mr. Bly the felt it his duty to assume a position that defeated so important a law one that we have learnt, from past difficulties, to be needed to preserve the constitution from factious outrages and the State from anarchy. It is to be regretted that the two Old Line Whig members could not themselves have been influenced by the considerations which they ad dressed to the Republican members to yield to their demands for a modification of the Sixth Section. The Bill is admitted by Messrs. Davi3 and Blythe to be an essential one for the peace, welfare, and security of the State, one which, ''by the wisdom of its provisions, will forever shut cut all pos sibility of re-enacting the disgraceful scenes of the last sessions." They ask to have ouly " an obnoxious .and useless recital " stricken out one which, "were there any principles at stake in maintaining ft as it i3 they would hot aik its friends to surrender. Theywere willing to say that an emergency does exist for the immediate taking effect of tho act; and they " hold it to be true that the State should have at all times some such law to guard the disorder that might arise from the death or incapacity of Senators." But because an obnoxious and useless reci tal, that involved no principle, wa3 retained, these gentlemen unfortunately deemed it their duty to threaten, and to execute the threat, of voting against and defeating a lawthe enactment of which the safety and peace of the State demanded. II ltconkl navo .been so trivial a matter to give up the Useless recital, there could have been no grave objection to let it pass If it were useless and involved no principle, its retention -was harmless. It was simply a pwee of partizan folly, which a wise legislator, looking to the essential interests and permanent welfare of the State, wonld have overlooked. . There are many, too, who will dissent from the views iu the speech, that the ex paste proceedings of the U. S. Senate, and its decision made without proof of the facts and without a reason assigned for its judgment, is a finality, and that there is no pow er on earth to reverse it . The Senate of the United States, neither in its judicial or leg islative character, is'not supreme over law, the constitution, and right. The power of the Senate, and that of idl of iu co-onli-nates combined, cannot confer the rights and immunities of a U. S. Senator where they have not been legally and constitu tionally contsrred by the people. It is a gross an&violent usurpation to attempt to bestow' them where the people, have not legally granted thoHi. If the Senate can become a mob, by attempting to expel Senator Douglas, or any other constitutionally electM Senator, by turning him from the Senate 'Chamber in disregard of law, the constitution and right, it becomes as much a lawless mob when It receives intoits chamber and clothe3 with the power 'and privileges of Setiatora, men who have never been elected by the Stata to such - honors mid trusts. If the' Senate bo degraded by its. gross violations of law and right, to the character of a mob, whose .acts are to be .disregarded in one cu.se, they must, for the same reasons, be rnuMe-red as nullities iu tho other.There aid ninny good eitüeus who feel a devout reverence-for the majesty aud sanctity of law, and who, like Mr. Blythe, are ready to asseverate, that they will by no act of theirs, weaken the power ofthat law, or tarnish its purity and mnjegty, yet feel no respect for a resolve of the Senate so flagitious aud outrageous, that those who passed it, hud not tho hardihood or ingenuity to offer one plausible reason in justification r extenuation of it. Acts under the forra3 of law, thsvt outrage known facts and the acknowledged rights of the people, destroy respect for all law, and the perpetratow of these assanlts upon its majesty are them selves the most destructive anarchists. The Senate itself has been the scat of rebellion against the' purity and supremacy of the ' law in this iustance. formally condemned, him;" and ' afterwards j reversed its judgment and expunged its own records can now be precluded by a lawyer's , ' ; - , technicality from re-considering a resolution j I adopted without proof of facts, aud upon exparte arguments, which admitted two . pretenders to Eeats, to which it is now obvious they have no legal or righful claim. Every judicial act performed by the Senate doe3 not erect it for tho time being into a judicatory and render ita'dicisions res ad judicata. It is only when assembled p.3 a court of impeachment that it can assume the infallibility of a judicial tribunal of the last resort, and declare its judgments irrevocable. Murder In Posey County. The New Harmony Advertiser says : On Tuesday night TVm. Coswav, accom panied by his son, on returning from Blairsville, stopped at the hou3e of Oscar Farrell in Spnhgneld, and while there, concluded to have something to drink. Young Cosway went out to get ä bottle of whisky and on returning found his .father in a dying condition, his head having been split open apparently with an axe, and Farrcil and his wife nowhere to be found. Medical aid waä obtained, but while the physician was dress ing the wound on the head, the uniortunate victim expired. It was afterwards discovered that the murdered man was shot, in addition to being struck on the bead, as a bullet wound was found in the thign, though young Cosway did not hear the report of a gun while absent, and at most was only about threo hundred yards from the house iu which the murder was committed. It is not known what - provoked the deed. The two men were partners and both addicted to drink ; Cosway, however, was a good natured, inoffensive man, bearing a good character generally, and had been a resident of this county for the past twenty-seven years, while Farrell is quarrelsome, and reported to be a bad man. As far astwe have heard the perpetrator of the bloody deed had not baen arrested. A Hobbiblk Death. An abandoned woman in Indianapolis, who nppeais to bave been a wretched outcast, was takca by some drunken men ou Wedaesday night to a slaughter liouw, and they all went to sleep together on the floor close in front o the furnace used in rendering lard. Sometime during the night, the exact hour not being known, her clothes caught firo from the furnace and burned entirely off her, injuring her so terribly that she died, it is thought, almost instantly. From her knees to her head sho' was shockingly burned. Eer face was also burned till her tongue swelled and protruded from her mouth. The corpse is a horrible spectacle. Her drunken paramours were unable to do anything to stop the burning. The Last Act of the Legislature. The bill for creating a new board of Sinking Fund Commissioners did not reach the Senate after it passed the ITouse; so t Iiis scheme for getting possession of the public money forja political corruption fund is effectually dead, as by a resolution of the Senate the unfinished business of the extra session cannot be taken up where left off nt the regular session. Everything must he begun anew. A bill continuing thn present board of Sinking Fund Commissioners in office until the first Monday in April, 18!S0, passed both Houses. It originated in the Senate, and efforts were made by Blythe, Davis, Turpie, and others In the House to amend it, iu order to remove constitutional objections. It was contended that provision, must be mnde for the extrusion of ha term of theoihVe3 themselves, a3 well as for tho term of the incumbents. 1 The Senate refused to, concur. The House refused to recede. Committees of conference were appointed, and tho House, Blytho and Davis protesting, concurred in their recommendation tu accept the bill in in original shape. A bill vesting iu the assignees of the Branche ofthe Bank of the State of Indiana the right to enforce, in their oivn name, tho possession and enjoyment of all aets of such Branches, aa passed. It wa-: introduced iu the. Senate at 2 P. M., read a hrst, second, and third time, under a suspeuslon of the rules, and passed ; was sent to the House by 3 o'clock, and in fifteen minutes parsed that body.
