To the technical argument of Xiblack that the formalities of law had been complied with in the formation of the Lecomploa Constitution, and that Congress had no right to go behind the record, or make any Inrestigations in regard to it, except to enquire if it were republican In form aad had emanated from a legally constituted body, Judge llovey replied in a manner that pretty effectually demolished his opponent. Judge Niblack said that a largo , portion of the people of Kansas had refused to vote, and were thereby estopped from complaining of what had been done. Judge llovey admitted the doctrine to the full extent claimed by his opponent, that if- they had a chance to vote and had not exercised it, they were bound by what had been done by others. Bat he proved conclusively by Oot. Walker and Secretary Stanton's declarations, and by the joint resolutions passed by the Kansas Legislature, that more than one half of the people of Kansas had been deprived of all chance to participate in the election of delegates to the convention. They did not and could not, and by no fault of their owncast a vote for a single delegate to the convention. They could not, therefore, be bound by its doings. Xiblack said those who opposed the convention were the rabble and outlaws and their acts being illegal had no authority, and Congress was not bound to regard their pro ceedings in any shape. The rabble in this instance, llovey said, was composed of ten thousand majority of substantial citizens; the law and order men, according to Niblack's theory of Democratic rights, consisted of two or three thousand pro-slavery men and office holders. Walker the repetition of it in Walker's and Stanton's speeches to the people of Kansas, all of which received the approbation of the President ; and last ly, the assurances given by the members of the convention themselves, that the people thould have a full and fair opportunity to vote upon the constitution ; and how were those pledges fulfilled ? The constitution itself was never submitted. The proposition was to voteor tue constitution with slavery, or vote for U without slaves; ra either ease - every vote most be ron it, with all its abominations. Xo vote was allowed to be cast against it. In either form the vote of every one must be to adopt the odious and repugnant thing. The submission of the slavery clause was but a sham and a pretence. The constitdtion made slavery as it existed in the territory perpetual, and declared there was no power ia the State to disturb it. The clause that was submitted, only related to the future introduction of elaves from other States. By the terms of Ihe instrument Kansas was made inevitably a slave State.
