I purchased the Journal of Mr. Sanders
upon his written representations that the net profits revived in cash from the ofiice, were from $3,000 to 3,600 annnally. Un Uns representation, without seeing tho concern, I accepted hi offer to hell. On coming to take poisesion of the office, I found there were no general accounts to show the aggregate income and expense of the office; the on It means I had to judge of the results of the business was a statement by Sanders of the receipts und payments of cash on account of the office, which was made to confirm his previous statement. On this statement, the bargain was consummated. This statement Las proven wholly illusory. . I have indubitable proof that I was grossly misled; the most conclusive evidence of tho Tact, that I can present to the public, i, that I have sold a joint interest in the cUllishluent to Messrs. McNeely and Thayer, at a sacrifice of f 1&00 from the price 1 paid Mr Sanders, notwithstanding tho business of the concern and condition of the office have been largely increased and constantly improving aiace iu first purchase by me. Had I known the trne condition of tho office, when I received it, I would not have accepted of It as a gilt, thongh it might hare been worth half what I paid for it. to some other purchaser more practically conversant with the business. Having been saddled with the concern, I have labored most sedulously and laboriously, as all my neighbors know, to giro value to the paper and recover tho loss. My recent sale shows a partial success in this particular. When a für several months trial of the business of the oSee, I found myself sadly disappointed in it results, I proferred to re-transfer the office to Mr. Sanders or any one to whom ho could dispose of it, for $1000 less than he had sold it to me. This offer met no response, aad as my obligations for the balance of tho purchase were put in suit which evinced a determination on the part of Mr. Sanders to make no abatement, and finding that he was determined to insist upon every advantage he had obtained of lue, 1 felt justified in paying him in his own paper,, and I. therefore, bought tip his notes, which had been due for years for property on which he had made a false show, and presented them to the court for three times the amount of his claim, and asked a
set-off. Tnis waa denied uudcr a rule of practice, because the notes came into my nwnhm after sat s lowmniceJ.The above is a simple statement of facts' ot which I have abundant proof open to the inspection of any one who wishes to examine it. As the matter now stands, I owe. according to the decision of the Court, about
$1,400, which he has been restrained from collecting or using, till he answers to a complaint of mine on his notes for $3,700 or $S,S00,iTen five years ago, on which not a dollar of principal or interest has ever been paid. The wrong done, if any, ia in asking Mr. Sandera to pay a part of his own notes with that of mine, for which 1 bare received no value, at least iu tny own estimation.
