(ttr;Tho fate of the Kansas Bill has
again been made doubtful by the dubious conduct of Mr. English and three other
anti-Lecorapton Democrats. Mr. Eng lish has steadily professed himself op posed to the Lecompton Constitutionhas argued and Toted against it. But he, with L. V. Hall of Ohio, Owen Jones of Pennsylvania, and George II. Pendle ton or the First District ef Ohio, all whom have been opponents of tb- H.Ar voted for the Committee of Coi crencc. The views of Mr. English arc set forth in a proposition made by him in a caucus of Democratic members of Congress which was held to devise some means of a compromise between the Lecompton and anti-Lecomp-ton Democrats. The following is the paper submitted by him to the caucus. 1st That it is highly desirable that Kansas should be admitted at once, if it can be done on satisfactory terms. 2d. That our greatest objection is that tho Lecompton Constitution does not embody the will of the people of Kansas. 3d. That for the sake of union and harmony in the Democratic family, and as a choice of evils, wo will waive other objections, and vote for admission on the following terms, viz: 1st. That it be secured to our satisfaction that the Legislature of Kansas will be placed in the hands of free State men we believing that a majority of free State men were elected on tho 4th of January, 1839. 2d. That the bill admitting Kansas as a State bo so amended as to secure to our satisfaction that the constitution may at once, or at any time after admis sion, if the people desiro it, be changed altered, amended, or abolished, so as to conform to tho public will. There was no objection in tho caucus to giving tho Legislature to the Freo State men, but the Lecompton members insisted that the constitution could no bj changed till 1SG1, and they, in the most decided terms, refused to incorpor ate any such provisions a3 proposed by Mr. English, in the bill, and tho caucus broka up without effecting anything. Mr. English subsequently put his proposition in the form of a section to the bill, which he designed to have offered as an amendment, had he had an opportunity, in the following words: Ji it further rcfc;, Th tk KttA rf Kansas is admitted into the Union upon the express fundamental condition that the Lcjflature of said State elected on the 4th of January 1S53, or any Legislature of said State hereafter elected, have the right at any time, to submit the question to a vote of tho peoplo of said State, whether they will or will not have a convention to chanpc, alter, or modify their constitution; and the right to adopt all necessary means for giving effect to the popular will in relation thereto; and the organization of the said State of Kansas nnder the provisions of this act shall be deemed and taken as its assent to and accmieccnce in tho constitution hereinafter expressed. Which he contended would bo incorporating in tolegal form, the language andviewsexpressed by the President, in the following sentence of his message to Congress: Tho Legislature of Kansas already elected may, at its vory first session submit the fiticstion to a vote of the people whether they will or will not have a Couvention to amend their Constitution. anJ adopt all necessary means for jivinjj elfoet to tho popular Will. It is probable that Mr. English will agree to accept the Senate bill amended as proposed by him in caucus. The amendment admit?, in the most odious form, the right of Congressional inter vention to construe or set aside the posi tive provisions of a State Constitution. If it were adopted it would have no force . for no conrt in the county would sustain it. It would serve only as a trap for the people of Kansas, who would have to ac cept the constitution as it is, and then in violation of one of its most imperative provisions, attempt to set it aside under the sanction of an act of Congress. It appears io us that the violation of con stitutional principles by tho amendment would be a3 outrageous a3 the attempt to force a constitution, they had never sanctioned, upon a people. If Mr. English can force the adoption of this nugatory amendment, he will support the Senate bill, and perhaps carry it through the llouse. Missing Crew Tckxed Ur. Somo threo years ago it waa reported in Jsew York that the clipper ship Helena had been lost at sea, with all hands on board. The captain's narao waa Thompson, and Le had a wife and several children in New York. The Helena had a cargo of coolies from China bonnd for Cuba, and it was conjoctnrcd by some that the coolies had risen and murdered the crew. Tho insurance offices paid the policy, and an administrator was appointed for tho captain's estate. But Mrs. Thompson has had unflinching faith that her husband was safo and would return. A day or two ago a vessel arrived at New York, ana reported having passed and hailed a vessel bound for China, which had on board Capt. Thompson and crew of tho Helena.
