JDred Scott Doctrine and Practice. It h alleged in tha ' platform adopted at Indianapolis on the 4th instant, that the Supreme Court in the Dred Scott case, decided, that the Constitution of tho United States carries slavery with
it, into the territories where there is no municipal hw prohibiting it. There is no such point made in the opinions delivered by the judges in that eelcbated case as far as we have been able to discover. Such a doctrine might possibly bo inferred from the scope of the reasoning, but it is no whero distinctly stated that we can find. The doctrine seems to have been attributed to the Court, without sufficient ground to justify it, to create a theme for violent party discussion. The doctrine suggested by the Court is, that in all unorganized territoncö, vhcre there i3 no municipal law where nothing but the common law of civilized society prevails the Constitution of the United States would shield property in slaves, as we'd as any other property. That a slave carried into such territory does not acquire any rijhts of freedom but on his return to a slave State, r resume his former condition. ; Whether . . .tl sl ihii:niirf hnvi iniri n own inf iinrtnne IIW V VSW w awa v - - that slavery can bo carried into unorganized territory and maintained there till prohibited by law of the State we do not pretend to discus. It is certainly a doc trino very repugnant to the sentiments of the country, and one which every dem ocrat will be slow to admit. Hut strange aj it may appear to those who now vio lently oppose the doctrine of the Court, that slavery can be carried beyond tho limit of municipal law, it has been in practical operation in another way, under the laws of Congress for more than sixty years, without apparently ever having awakened any serious attention.') Tho ocean, like an organized territory, has no municipal law. The Constitution and tho common law have dominion over our uninhabited territory; and only the Constitution and tho maritime laws of nations extend over the sea. When slaves are carried to sea they go beyond tho jurisdiction of all State and municipal laws. As property they arc held under the shield of the Constitution only. Now, moro than one-third perhaps moro than half of the slaves in the great South West planting States, are slaves and descendants of slaves who hive been transported from the ports of Maryland, Virginia, and the Carolinas to the Gulf Ports, and in the voyages they have made, have been months at sea and carried far beyond the reach of all local laws of slavery, often into the harbors and Days of British and Danish Islands, a breath of whose air breaks tho man acles of the slave. But these children of toil, a3 soon as they reached the port of destination resumed their original condi tion, and no question has ever becu rais ed to dispute tho rights of their masters to their property in theso emigrant slaves. Kvcn the fugitive slaves, whose rights to freedom have been so strenu ously defended at the North havo been taken by their masters over the ocean to the South. In the coasting trade of the Southern States many slaves aro employed as sadora, who perform voyages of many weeks beyond tha jurisdiction oi statute law. we can perceive no destinction between the circumstances of an uninhabited and unorganized territory and the wilderness of the oeean, sor as the rights of slaves are involved. Our domestic slave trade by sea is car ricd on under the sanction of law and very strict custom house regulations. No part of the custom house service has more rigid rules or is enforced more strictly. Slaves to "be transported by sea are required to be entered at the custom house with a full description of their persons, and on their arrival are required to be reported with great particularity, under severe penalties. " AU of this business U carried cn under the sanction of Congress. If the doctrine ascribed to the Supreme Court be not sound, the slave tiadoby sea ia illegal and unconstitutional. But it the anti-slavery party is prepared to aabscribe to such a creed, why do they not go a step further and say that the freedom of the black man is national. They sro ready to oppose every mcssure fettering his freedom, even in the nominally free States. He has no rights as a freeman in Indiana. lie cannot vote, he is taxed for the support of schools, from which ho is excluded and a clause was engrafted in the Constitution by a majority of ninety-fivc t.rotisand, forbidding free negroes, ander pain of fine and imprisonment from coming into tho State. Major & Russell, contractors for the transportation of supplies to the Utah Army have selected Nebraska City as the place of depot and rendezvous. They will start from that point from eight hundred to one thousand wagons.— They will require from six to eight thousand yoke of oxen, and will engage the services of about twelve hundred men, for which they will pay twenty-five dollars per month, out and back. The price which they propose to give for oxen is seventy-five dollars per yoke, which in view of the present state of the money market, is certainly a fair remuneration.— They will require the stock to be delivered at Nebraska City, of the time of which due notice will be given through agents or the press. It is probable that Messrs. Major & Russell will ask sixty, ninety, and one hundred and twenty days on their purchases of stock.
