MONDAY MORNING DEC. 7.1 THE FUGITIVE blAVK CASK, Which has been under investigation and caused a goo-J deal of excitement during the week at Indianapolis, was decided on Friday, by the U. S. Commissioner grant ing a certificate to the claimant of his right to the slave, and directing; the U. S. Diputy Marshal to summon a posse and carry the slave beyond the limits of Indiana and deliver him t his owner. The Commissioner held his functions to be merely ministerial ; that be had no power to enquiie into the slave's rights to freedom, for those were questions for the courts of Kentucky ; his duties were confined to an enquiry as to the personal identity of the slave, and the evidence having established that fact, he was compelled to order him to be delivered up to the claimant. The U. S. Marshal, baring fears that an attempt would be miJö to rescue the black, summoned a posse of forty men to help guard the fugitive. Immediately after the decision of the U. S. Commissioner was announced, & writ of habeas corpus, issued by Judge "Wallace of the Comman Pleas Court, was served on the U. S Marshal, ordering him to bring the fugitive before that court. The Marshal obeyed the writ, and answered " that the U. S. Commissioner had issued his certificate to him giving him tho custody of the negro West or Weston for the purpose ol delivering him to his cUimmt, Austin W. Vallandinouam, in the Stato of Kentucky, and presented his authority from the Commissioner for uavmg vuoMwji ... vp. , for the negro moved to qmsh the Marshal's return a insufficient. The court adjourned till Saturday to hear the argument. Thomas D. Walpole, attorney for the claimant, advised the Marshal to disregard the writ from Judge Wallace, and it was supposed the advice would be followed, and considerable excitement 1 ras caused by the threatened conflict of jri.sdiction ; but the Marshal thought proper to yield obedience to the ma idatcs of the State court, and all difficulty was avoided. . ... While these proceedings were in progress in relation to the slave, his master, Dr. Vallandixoiiam, was on trial before the Mayor for kidnapping the ' negro which had just been adjudged as his slave by the U. S. Commissioner. This case is still undecided. Altogether there don't appear to bo any immediate prospect of a complete termination of the business. If all -eal hindrances fail there will be no resort to force, or any illegal means of rescuing the negro, so far as we can Judge. Burulary. The residence of CiiasEabcock, Esq , was entered on Saturday night by burglars, who show as much boldness as skill in their operations. On the evening previous there had been a family party and the rooms more exposed to view from the streets than usual, with the family plate upon the tables, and seen perhaps by the thieves, they were tempted by tho sijjht to get possession of it. On the family's retiring, tho houso was closed with unusual care, and the valuables carried up to Mr. B.'s sleeping apartment. During the night Mrs. II. saw a figure glide stealthily into the room, and on speaking to her husband, it vanished, lis appearance and disappearance was so sudden and noiseless that both thought it could be but a creature of tlia brain in slumbers disturbed by the strong cotfee and excitements of the evening, and therefore turned to sounder sleep and let it escape. In the morning, several of the outer doors and windows, which had the night be ore been so securely fastened, were found wide open, and at one of the windows were trark.s of the thief, the marks where he had broken it open, and the mud from his feet where ho had clambered in ; matches and a half smoked cigar were left in the hall where he had used them. On examination not a single article of value was missing. The plate, of which there was $1)00 worth, was probaMy the o jeet of the enterprise, and being defeated in that, by the wakefulness of the lady, the thief thought other things unworthy of his notice, before leaving the premises, in wanton boldness, he threw open the windows and doors of all the lower apartments and gave them a thorough airing. Facts like these illustrate in a striking manner the progress of the country. Post Okficb Uobbemes. Thero ip pears at different periods epidemics in peculiar species of crimes. Post Office depredations seem now at least in this St tte the prevailing crime. Wo under stand that eighteen indictments were found at the last term of the U. S. Circuit Court for olTences in this State against the Post Office laws. Only one case was tried, and that was the charge against Dominic Eckest, Post Master at Jasper, in the adjoining county of Dubois, who was arraigned for purloining a letter from his office with a draft for $41, on which he forged an endorsement and passed it. Tho testimony was so conclusive that he phad guilty, and was sentenced to two years' hard labor in the penitentiary. He had previously sustained a respectable character, and Judge IIuxtixqton, in passing sentence, made some eloquent and pertinent remarks upon tho decline of official integrity, and tho terrible consequences to the offender in forgetting the stern principles of rectitude and yielding to the temptations uf avarice. Female Sitf-rage. From 1776 to 1807 the laws of New Jersey allowed fe males the right of suffrage ; and on several occasions it was exercised by large numbers, and in one instance even black females voted. We were in error, therefore, in stating they were sold by order of the Directors. The road, as we understand, had previously parted with all right to and control of them. 27" Five negroes are under sentence of death fcr killing two different overseers on plantations near Natchez Mississippi. In one murder in May last, thrco were cnciiged. They entered tho room where the overseer waa sleeping, aud beat him to death. They also saddled LI, horse, led him to the spot, rode hint over the corpso several times and then turned him loose, to create tho impression that tho murdered man while hunting had been thrown and killed by tho horse. They finally made a voluntary confession. The other two waylaid tho overseer on another plantation in the same neighborhood in Jnuo last, and as he was rcttin.ng home from a visit on a neighboring plantation. The mu'dcrcrs pulled him from his horse, beat bis brains out with a club, and sunk the corpse, weighted with a ploughshare and the pea of a pair of scales, in a pond. Here it was discovered, and clues obtained to the murderers, who have just been sentenced to be hong. 137 About a year since, drafts to a large amount were put afloar in several Western cities, drawn by Wm. B. Breck, a private banker at Rochester, New York, on the Corn Exchango Bank of New York city. Several parties were engaged in tho operation, and the drafts were sold on the same day in tho various cities, and of courso were never paid St. Louis, Chicago and Milwankie bankers suffered to tbe amount of some $75,000. Several of the parties were arrested for swindling, but the one who it was supposed was the custodian cf the avails, Tbos. C. Gilman, of Rochester, New York, made his way to Europe. Week before lust be returned, and as we learn from the Rochester Union, was arrested on a warrant aa a fugitive from justice in Missouri. IIoos. Two hundred and fifty hogs were slaughtered on Thursday at Vincennes, which averaged 135 lbav, which were bought f ,r $t net. Nothing was done on Friday and Saturday. In SL Louis, on Friday 800 head averaging 230 lbs. were sold for f 4 75 net; 155 hogs, averaging 200 lbs., were taken at 4 50. At Terre liaute, there Is no settled price, and as lar as we are able to learn, f 4 seems to be tbe sum offered it may reach $4 50. Sellers want more, and buyers stand ofi.
