THURSDAY MORNING .....DEC. 8. Col. Bexto his written a rery for cible letter, addressed to Jodge Uobertsox, of Kentucky, who was a member of Congress and toted for the Missouri Compromise upon the constitutionality of that important act. Judge Robertbon has, himself, been defending the policy and validity of tho measure, which he supported in its-passage and has hJd to be a sacred compact between tl.e North and South, through bis whole life. Mr.BsxTox presents the question in a strong and new light. lie makes a distinction between political measures of legislation, dictated by public policy, the reasons for which the court cannot determine, and matters of civil right dependent upon permanent and defined principles of jurisprudence. The Missouri Compromise wa a political measure, of State policy, the reasons and motires for which were not subjects of enquiry by the court, and belonged to a province of government out of the court's jurisdiction. It was a measure, too, not to be determined or judged by the pro- - I vis.ons o, me consmiuion. wnose operalions are umiiea 10 me auies. insieaa . i j . ii . n. . v i of extending the constitution over the Territories and making it the sole fundamental law of all territory beyond the States, Mr. Benton contends that the constitution of the United States has no force or effect beyond the limits of the States. It was adopted by the States and its powers and. operations are confined strictly to the States. The Terri toiies, according to Col. Breton's views, are subject provinces, without the pale of the constitution, dependent upon the will of Congress. This he contends was the doctrine of the fathers of the constitution, and the principle upon which the Government was administered for seventy years. Incompatible, and contradictory reasons. That compromise act was a political enactment, made by the political power, for reasons, ana these reasons among the largest that ever Influenced human legislation no leas than to reconcile a divided and distracted country, and to prevent oar sacred Union from splitting asunder. As such political enactment the court had no right to jndgo it, even if the Suestion had come-fairly before it which it id not; for tho judiciary cannot judge political questions, neither of right nor Id fact; 1 r these questions depend ujon considerations of policy which the judiciary cannot touch, and not upon the interpretation of phrases, to w hich t..e court Is confined. The same of the self-extension of the constitution to Territories ; it was a political question as to what that constitution should extend; and it was limited by its own words to States; and it has been so acted upon by every Congress, and by all authorities, 'state and föderal, legislative, executive and judicial) from the commencement of the federal government to the present day. And I venture the assertion that there has not been one single member of Conjrress, in the seventy years in which Congresses have been held, who has not voted for objects in the TerritoFfcs (local internal improvements, for example) which they would not vote for in a State ; and upon the express ground that the constitution aid not extend to Territories. The ordinance of 17ST was the territorial constitution, (riven to territories as a sovereign gives a charter to his subjects ; and as such was made in concert with the constitution, as you well say, and indispensable to the forma- . tion of tho constitution; and as such was provided for doubly provided for in the new government : first, by tho clauso in the constitution which devolves all tho "engagements" of tlie Congress of tho confederation upon tho new federal Congress ; and, secondly, by the actor tho new Congress of August 7th, 189 the eighth act passed by the first Congress ander Washington adapting that ordinance to the new constitution, and adopting it in every word which it contained as a law of the government. The Texas Pacific Railroad which was endowed with such princely dona tions of lands, and whose stock has been distributed to the "green ones' all over the country, at $5 per share, has failed and assigned all its assets and rights to be sold for the benefit of iU creditors. Some 25 miles of the road hare been completed from the Eastern line of Tex-
as, near Shreveport, and the grading I two thousand men, fifteen hundred waghas been done and the iron and cross Ions and thirteen thousand animals, and
ties procured for a much longer distance. These will probably all fall into the hands of a few sharp managers, by the sale of the road and its property and right, which is ordered to take place in January next. Ihe enormous grants of land, amounting to about 40,000 acres per mile, made by the State to the road. will prol ably lap?e from a non fulfil ment of the conditions of the grant. A lick of confidence has always been felt in the managment of the road which has deterred honest and prudent men from meddling with it, notwithstanding the! advantageous terms of its charter. It will be an extremely fortunate erent for Texas and the country, if the present proceeding shall result in taking the road from the hands of penniless land adenturers and gif ing the control of the j enterprise to sagacious and responsible men. fyCj A puWie supper was given to lion. Mr. Davis appears to hare a strong hold upon the affections of his constituents. They mutually resist all outside attempts to treat dissensions between them.
The Democratic Doctrine upon the Kansas Constitutional question is clearly defined in the following resolution adopted at the National Convention hi

Buchanan adopted and committed himself to the same principles in the following sentence from his letter to Prof. Sillim an and others: The convention will soon assemble to perform the solemn duty of framing a constitution for themselves and their posterity; and in the state of incipient rebellion which still exists in Kansas, it is my imperative dnty to employ the troops of the United Mate, snou Id this become necessary in defending the convention against violence whilst framing the constitution, and in protecting tho hona-jids inhabitants," qualified to vote under tbe provisions of this instrument in the free exercise of the right of suffrage when it ' shall -ac srBMITTCD TO THXX TOB THEIB AFfBOBATlON OB REJECTION. We see no escape from these direct and positive declarations, and the firm adherence of a majority of the Democratic press to these pledges of faith is creditable to their honesty, independence and loyalty to their principles. The Vincennes Sun a devoted . Democratic ihecteXpressei itself as follows upon the subject: We are pleased to ace with what unanimity the principal Democratic papers through out tho country are speaking out boldly their condemnation ot the inexcusable act or tlie Constitutional Convention of Kansas in their refusing to submit the rhiU of their work to a vote ol tb people of that Territory. We can see no ground upon which their course can be rationally instilled- It is at war with the principles of tlie bill upon which the Territory was organized, and would be in direct conflict with tho principles act forth by tbe Democratic National Convention. Kansas.- While the excitement in relation to the "wrongs of Kansas," has been renewed through the country, by the course of the constitutional contention, the people of Kansas hare assumed an unwontoned calmness . and quiet. There is apparently little agitation in the Territory. A contention of dele gates of the free state party was to have assembled at Lawrence yesterday to consider the present political condition of the Territory, and to determine what course shall be pursued in relation to j the bous constitution. The decision of the contention nponthe question of Toting for the constitution will be looked lor with interest. Gex. Pensirica Smith is at Washington, in consultation with the War Depart ment in regard to the Utah war. It is rumoret) that Geo. Joseph Lake, of Oregon, will be authorized to proceed to California to raise tolunteers, and con duct the war against the Mormons. The Hoosicr General would be likelj to finish np with a band of Californians in much less time and cost than tho regular arm. The present expedition has already cost nearly two millions of dollars. It has more quartermasters than the English had in the Crimean expedition. At this rate, the Mormon war will be more expensive than the Mexican invasion. Let tho country watch the army, estimates. 37 It is reported that the constitutional convention of Kauras provided for a complete and extensive banking system. The flan ia one that would be marketable, and the charter would pay those who have the political influence to engineer it through, a fortune. It was probably framed with that view. ' Tbe constitution provides that tbe capital of the State Bank shall be $3,000,000, and that there shall bo four branches two on each sido of the Kansas river. The convention declared the bank charters granted for the banks in Kansas, last winter, null and void, thus giving the new constitutional bank tho entire monopoly of banking. EST Mr. Morrison, the great English capitalist, whose death we recently noticed, was possessed with the idea that he should come to Man t. About two years ago he commenced working as a laborer upon a farm held by one of his tenants, for which he received twelve shillings a week, and this he continued up to the time of his illness. During the last eightesn months of his life ha was a reg ular applicant for relief to tho pariah in which he lived, and received twice a week tho panper's allowance ef two shillings and a loaf of bread.

He waa imrns diately afterward arrested on a process issued from the United States Court, and was eia mined before TJ. S. Commissioner Bea. The negrö declares himself to be a free man. He Las been a steamboat hand on the river, and for several years" appears to have been his own master, and to have been often in different places in this State, passing as a free negro. The U. 8. Commissioner Bea, claims f.he right to go folly into the question of the rights of the master to claim his slave, and required full proof of ownership. In 1849, Mr. Parish was struck with paralysis, and was deprived of his speech, in which state he continued till his deatf-., in 1856.
