Courts a few days since, the case of State vs. James A. Scott, for arson, was tried. The Newark Advertiser, says the prosecutor Rtated that defendant had rented a frame building, purchased a stock of tools and materials, for which he had not paid, obtaining insurance upon them, and then set lire to the building. The counsel for prisoner moved to squash the indictment, insisting that the act was not an indicta

Mr. Ii. supported his position by quotation from numerous authorities. Judgo Pott, sustained the exception taken by the de fendant, and stated that in order to make the charge of burning a felony,' under common law, it must bo the property of another, that much discussion . had arisen relative to the actual meaning of the term "another," and that the British Parliament , in view of the doubtful con struction of the law, had . enacted a spec ial statute, which was also, the case in several States of our Union, bnt that there was no such law in this. State; he also affirmed, the t right of ownership, as existing in the. tenant for the term of Ins lease, and in reply to a suggestion that the lease, was a verbal one, remarked, that a "verbal lease is good enough in this Stae."
