C. EVANS VILLE: FRIDAY MORNTIXG.:::::::::::::::MAKC!I C Paducah & Henderson" Railroad. The commissioners for procuring subscriptions to the stock of this road, opened tho books for the stock at Paducah, Southland, Marion, Morjranfietd and Henderson on the 2d inst., and the urge the claims of tho road in a manner that show they are in earnest about it, and are confident of success. The entire distance will be S3 miles. From tho mouth of the Tennessee, it will run along the shore of tho Ohio to Southland, thence up the south tide of the Cumberland four or five miles, then crosses the river, and take tho vallej of a creek which entcrlocks with tho branch 63 of the Tradewater, from which stream the country is level to Henderson, requiring but very slight grading. From tho Cumberland to Henderson, it will pass through a section of un3qualled fertility as an agricultural district. It will pass through the best portions of the valuable coal beds in Crittenden and Union counties, which contain some ofth, best coal on the lower Ohio river, which by this road would be made accessible to the factories and workshops of Southland and Paducah, which are rapidly increasing in varietr and importance. Paducah will bo the terminus of tho Southern railroads extending through the Western District from tho Ohio river to Mobile and New Orleans. This road would form the connecting link between those roads, and ours leading to the Hast, and together form one of the great through route from the extreme East to the remotest Southwestern extremity of the Union; and plac0 Evaniville and Paducah on one of tho great lines of Northern and Southern travel. The Ohio cannot be crossed, in consequence of the intervening islands and bars, at Paducah. To connect herself with tho Eastern lines on the Illinois shore, a crossing must bo made al.ove or below her; and wherever such a crossing should be made, a rival town would grow up that would sap cr destroy Paducah. It U her interest, therefore, to keep tho line on the other side of the river, and to ferry the Tennessee, as she has no point for crossing tho Ohio. She U als. amhitiom of becoming; a manufacturing city, and the only element of success in this line which she lacks, is cheap fuel. This road will open to her tho richest coal beds in Kentucky, and place them within thirty or thirty-five miles of her doors, by easy imd cheap railroad transportation; and by her other railway connections, this coal 11 i . j- ..-1 i 1 1 ii t : coum ue uisinuuieu iu au wo wn n m tu Western District, and to Memphis, and even further South. Paducah has, therefore, strong inducements to exert himself to push this road forward. Smithland has the same motives to do all in her power to help it along. The companies that own the coal lands, many of which are now worked and are dependent on tho uncertain4navigation of the Tradewater for an outlet, will have a deep interest in the construction of a road that would open regular and valuable markets for them. The farmers in the back part of Crittenden and tjuiuu cuunues auiuug tue inus. icnutj in Kentucky have the means, and their interest would stimulate them to unite in tho enter prise. It would give Henderson; Southern and Western connections that ha cannot get by her Nashville railroad, if it were built. It will give us also a tributary that would be as advantageous to our city as any road we could draw upon the map. With all these intorcsts united, it does seem that it would not beditfoult to build a cheap road of cighty-Gve miles in length; and thero arc, indeed, some grounds for the confident declarations of Pa ducah that the road shall and must be built. Whatever Paducah undertakes, she is sure to accomplish. fjT" The attention of Dealers is called to the advertisment of Messrs. Jewell & Co. who have one of the largest stocks of goods in the city, and are prepared to deal with buyers on the lowest and best terms. Their goods have been selected with great care and judgement, and have been purchased at prices which en a ties them to compete with fellers in Louis Tille and Cincinnati markets. 07" The Supreme Court of Massachusetts has decided, in a case where a boy brought suit against military officers for assault and battery for removing him from the street, while acting under a general proclamation of the Mayor, calling them out to preserve the peace, and sustain the laws, that thsy have no authority to act except under the immediate, personal orders of the Mayor, who must bo present to direct The military being subordinate to the civil power, can not be clothed with any discretion, while the civil law is in force. The cause of suit originated in the fugitive slave case, of Anthony Burns, in Boston when the military were called out to aid the police, in executing the decision of the court remanding him to the possession of his roaster. The t oy intruded upon the military, and was, by order on the commander summarily dealt with, lie sues for damages and under this dicision of the court recovers. 03-It is si?d that thirty milos of the newly chartered railroad from Emporium, near Cairo, tb Vincennes, are already surveyed and located and that this much of the ro.td will be put under contract in another month.

You and the public will pardon mc for a few more observations on this contract, and then I shall leave it, and take a very brief view of its enect. and inlluences on all par tie to the instrument. I am informed, on good authority, that when you maile public Uttings of the gradua tions. &c, of the first division, on the 15th of rcb. 1851, to John Gavi.-k, John kel.oj, Fairchi'ds & Co., and other good reliable men, who were to be paid three fourths part in cash and one fourth part in the stock of the road; and who, by the large contract on the 11th of May following, all became sub contractors to Willard Carpenter & Co.; that tne contracts witn tnem, reserved ten per cent, in cash on the payment of all estimates, which ten er cent, was held till the com plction of the work, as a security fur its faith fu! completion, and delivery. It is, moreover, the common custom, to reserve from ten to twenty per cent., in the payment of all such contracts, till final delivery of the work. But this contract contents itself with rescrv ing, until the completion cf each division, the sum of eight and a third percent, on this con tract price,and that, not in cash, nor in bonds, but in tho stock of the road. Whv, in this respect, the established custom f the country, were departo.1 from; or why. any reserratiun at all, was made, ' I am not prepared to determine. There is one-ohjection on the faco of this instrument, which 1 had thought of noticing, hut it is a small one, and only leaves the contractors an advantage of about twentv-six thousand dollars, should they even bo willing to avail themselves of it, and therefuro I shall pass it as too small to deserve attention, where there aro so many objections of higher char acter. The next unpleasant feature in that con tract deserves particular attention; and it is not patent on the bee of the paper. It is a mat ter of public notoriety, that whilst the plains of Vanderburgh, Warrick, Gibson, Pike and Davis counties are favorable to the construct ion cf a cheap road the hills of the rountie, immediately beyond olfcr obstructions which will make tho road through them much more expensive. Now, the first division lies over these plains, whilst the second division cross es those hills; whereby, the preparation of the first division lor the rails, will cost less for the same length of road by, a t I am informed, some hundreds of thousands of dollars, than the preparation of the second division. Now, tins contract, though made before all the line was finally located, or estimated, was made with the full knowledge of tho fact which I i.ow state. And, this contract .provides' that the nrst, or cheap division should be first fin ished, and paid for without any reservation, before the second or dear division should be begun; and p tys just the same per mile for the first, as for the second division. I have been in the pursuit of knowledge under difficulties. and must crave indulgence, if I should ask nn pertinent questions. Just hete I feci impell ed to ask whether it is true, that tho average cost of grubbing, grading and bridging of the line, from the Ohio and Mississippi road to Indianapolis, as shown by your experimental surveys, was not lound to be at least lour thousand dollars per mile greater, than the cost oi tne same work on tne nrst division, or a .a 1 . I . a from Lvansville to the Ohio and Mississippi railroad; and further, whether it is not true that the most expensive of all that more costly preparation, is on the second division? I think 1 happen to know, that such are the facts. I may be in error, if so, I beg your pardon. But if 1 am correctly in lor med, may I ask wheth cr the contract of an agent which pars tho aatno for mmoothinis- ihn tilain tb.it it Hna fori 7 " o V - ? leveling the hills, and takes, tho plains first, providing at the same -time for stopping at the pleasure of the contractors, whenever certain imossiblo provisions, on the part of the cor potation are not complied with, all things con sidered, is just an P equitable, and binding on the principal, especially, where the party get ting the apparent advantage was an agent of the same principal .' Hut even this contract, is not so bad, but what there are two or three safe and salutary provisions in it; short and subordinate to be sure; but still both wise and just. It is therein provided that tha real estate and city bond shall be appropriated to prepare the road for the rails. And that the mortgage bonds of the road shall be appropriated to buying the rails and other track materials, and paying duties, freights, &c; and for those purposes only. This was wise; for it does not allow the squandering of all the available subscriptions of tho road on the completion of the first Division, and it so far adheres to your original policy, as to appropriate our subscriptions to preparing the road for the rails. I will call your attention to a still further wise and just provision; premising in view of a late correspondence, that you wot of, that in your case, as in that of 'the honest old "counsellor of Naples," "the latter end of "your commonwealth has forgot the begianlg." I quote from your contract with Carpenter & Co., which, after agreeing to pay the contractors $15,000 per mile in real estate bonds, goes on to say that they may at their "election" (option) "receive at par the bonds of the cities of Kvansville and Lamasco, now held by the party of the first part, to the amount of $230,1)00, with the agreement as to tht tlisprjstil of the same existing beticctn said cities, and said party of the first part, in lieu of a like amount of real estate bonds." What agreement, pray, existed between the company and tho city of Kvansville relating to the disposal of these bond, but the agreement that $1UO,OUO of these bonds should not be used on this aide, but on the other side of the Ohio and Mississippi Kailroad, for the purpose of insuring, that Willard Carpenter & Co., should not take advantage of the extraordinary provisions of this contract and stop when they should have completed the first and easier Division of the road? But alas, our wearied eyes, no sooner rest on these redeeming provisions, these green spots, than the arid sands of the surrounding desert threaten to overwhelm even them. She has petitioned the court for letters of administration, and her counsel say thev shall be ready at tho -proper time to brinir collateral heirs aro opposing her pretensions. 0OCol. The Editor of the Uockport Democrat, P.. SMIicks, Esq. who has been assistant clerk of the House during the present winter, and has therefore had the most favorable oppor tnUies of watching the course of events at pus. wr lonnins: a jusb estimate of those who exercise the Legislative power of the State, makes the following just and sensible comments on the evils we are now enduring from a factious and incompetent Legislature. , The session of the General Assembly is now drawing rapidly to a close and no bill of importance has paeJ; neither, will there be in our opinion. The Senate and at out one third of the House are composed of such dis cordant elements, that it is an utter impossi bility to bring them together on any question of legislation, squinting towards politics such as the apportionment bill, Temperance law or election of State oflicers. The republicans of both branches invariably thrust their fanat icism into every act of Legislation attempted by the Democracy to beneht the masses of the people. There remains but ten or eleven working days of this session and all bills of importance remain unacted upon. Twenty bills, or thereabout, is the sun total ol the work doi.e by this General Assembly, and these aro bills of no particular importance to the community. And to pass these little in significant enactments, it has cost the hard working joetnanry of the State not less than ?Qe hundred and fifty thousand dollars. crily things are coming to a pretty pass when labor has to be ground down to the dust hy heavy taxation to keep up such farce legis lation, but at whose door, are these evils to be laid? We answer, most unhesitatingly, to tho fac tious spirits in both of the rival parties. We concur heartily in the following remarks, ex cepting we do not care if the people will elect a majority of yoml men, to which party they belong, whether they be Republicans or Democrats: The Senate are doing but little or nothing; their time mainly being taken un by politi cal wranglings. I he House has passed many ats of importance to the pcopt.: but they sleep upon the files of the Senate, and their fate yet remains unknown. IT legislation is in future, to be cc n filed to such discordant matenils as compose the present General As sembly, it were better that tho State go without a Legislature in the future. 1 or all the good such asscmbbescan accomplish, will certainly im overbalanced by a squandering of the public funis. It would be much bet ter for the interests of the State, and redound to the credit of the people, if, they, hereafter should elect a majority of good Democrats to both branches of the assembly, and then there can lie no earthly motive or excuse for blocking the wheels of legislation. We have unlimited confidence, however, in the intcll: gence and capacity of the masses for self-gov ernment, and firmly believe that everything will como outright yet. Jelferson Davis's, or;an in New Orleans, tho Delta, has already began to utter 't anathemas, and threatens 'to crush his administration." It will become factious when the conservative character of the New Cabinet is known. Cobb the Southern Unionist, is more hateful to the (ire eaters, than a Northern Free Soilcr. Mr. Iluchanan's only safe course is to place himself tirmly upon conservative frrounds and rely on the good sense and patriotism of the country, and let the storms of faction and sectional passions expends themselves around him, unheeded.
