All public Lamps and Lamp-posts and fittings and fixtures belonging thereto, wdl be provioed and erec ted at the vxjxmi e ol the city of Evanstille, and tho necessary service piies, leading to und connecting therew ith shall be supplied by and at the expense of tho said J cud Jettrey ek C o. and asxH-iates, their successors and assigns. The said John Jeffrey d Co, and associates, their successors and assigns shall at all times supply the inhabitants of the city of evansville for private use in the most approved manner with a s-itliciei.t quantity of Gas of the most approved quality, at as low u price cr cubic foot of gas consumed, as the same quantity of gas shall be furni.-hcd for the name piiroso to the inhabitants of any city or tow n in Ohio, Kentucky or Indiana or equal or greater jHpulatioii than the city of F vaiisvillc, similarly s.tuat jd. Provided, that the price to bo charged to the inhabitants of the city of Evansville for gas so provided snail iu no case exceed three dollars per thousand cubic feet of gascousumed. And provided, also, that the said John Jeuroy Ji Co. and associates, their successors und assigns, shall not be required to provide gas as aforesaid, lor private consumption to ersoiis whose premises are not within a reasonable diUnce of a supply pipe already laid, nor to any person w ho w ill not pay for gas monthly iu advance, if required; nor shall they be required after laying the three miles of pipe hereinafter pro mod for, to extend thu supply pipe unless the demand for gas to be supplied thereby, shall afford o reasonable prospect of Car remuneration. SEC. 7. The amount of pa consumed shall bo ascertained by Metre Measurement in the usual w ay . SEC. 4. If the Common Council should at any time w ish to light with gas, any street, public building or other place not adjacent to, or within a reasonable distance of any pipe, at the time already laid, and where the said John Jet! rey & Co. and associates, their successors and assigns, w ould not be required to lay pipe according to the true intent and meaning or this Ordinance; and the said John Jeffrey & Co. and associates, their successor and assigns, should refuse to lay and supply the necessary pipes for that pur(Kse, then the city Council shall have the privilege t extending tho gas pipes aud erecting such number of public gas lamps lor the purpose aforesaid, as they shall deem proper, and the said public lamps shall be furnished with gas oil the same terms, as the other public gas lamps of the city, and the main gut pipes laid dow u ut the expanse of the city, shall not directly or Indirectly be used for furnishing gas excel t for pubtic city use, nor shall other gas pipes be laid down within the same portion of said streets, lanes, alleys or other public grounds, by said John Jet! rey Ac Co. and associate, their successors or assigns, until the whole amount expended by the City Council in la) inj gus pipes be refunded to tho City Council, when the said pipes shall become the property of said John Jeffrey c Co. aud associates, their successors and assigns, SEC. 9. That the privilege granted by this ordinance, to said Jeffrey & Co. and soci:ites, their successors a..d sssijri- are ujxmi this condition, that they hall ou or be. fore tho 1st or January, 151, have completed the requisite apparatus for manufacturing gas, and shall have laid in connection therewith, three miles of main pipe in the streets or Evansville, and si all further lay from time to time additional main pipes each succeeding year thereafter In all streets and alleys wherever the same shall be required as above provided. SEG. 10. That tho work and operations of said Gas Works shall bo so constructed ami arranged that there shall be occasioned no injury to the bcalih or comfort of the citizens of Evansville. SEC. 11. That at any time after the expiration of thirty years from the first day of June, 102, the said City Council shall have tho right and privilege of purchasing of the said Jeffrey 6i Co. and associates, tlieir successors and as sign, all the pipes, buddings and apparatus constituting the Gas Works, at such prices as may be ascertained and determined by five disinterested persons, c tizens of Kentucky, two of w hom shall be chosen by tho city Council, and tw o by s t d Jeffrey At Co. and associates, their suecessors and assigns, and Ihe fiTlh by the four so chosen. SEC. Ii. 'I hat litis Ordinance shall take effect aud be binding ujkjii the city of Evansville, so soon as the said Jeffrey & Co. shall signify their assent thereto in writing. SEC. 13. The first section of this ordinance shall be so constructed that where gas pipes shall be laid in any part of the city w here Uie Krade and sewerage of the City, shall have been established at the tune, and U laid as not to interfere w ith the grade, sewerage or drainage so established; U the Council shall afterwards so change the grade, sewerage or drainage, as to thereby render necessary any alteration of the pijx'S, iu position or otherwise, the ex(eiise of making such change shall bo paid by tho tity of Evansvillh.
