15,023. Patrick Mcliulre et al. vs. state. Fulton C. C. Reversed. Olds, J. (1) A judgment of forfeiture or a recognizance bend, whether it be a continuing one or not, must be entered at the term when the bond Is defaulted and if entered at a subsequent term Is void, and will not sustain an action against the recognizors. (2) In an fiction upon a recognizance bond It Is necessary to prove that the bond was taken In the due prooess of law by a proper court or officer.

(1) In an action for seduction it Is not necessary to aver in direct terms that the promises of the seducer were relied on. A general statement of the means resorted to for the purpose of seducing an unmarried woman will make the complaint good as against a demurrer. (2) A woman of non-age may maintain an action under our statutes for her own seduction. (8) It was competent for the plaintiff to give evidence tending to show that she aud the defendant were together during the time in which Bhe alleges that he persuaded her to yield, and to show that they were in a place where It was likely the act might take place Nor Is she contined to one act or one time, but may give evidence covering many acts and a considerable period of time. (4) The plaint! it had a right to prove the consequences which resulted from the defendant's wrong, as bearing upon the damages.

In this case the charge Is that the female was taken to a room In the house of an Individual named, which room was occupied by one of the defendants. In the absence ot any further characterlzaUon of the place, this must mean the private apartment of one of the defendants, and Is not such a place as the statute contemplates. Nor, Is the charge that the female was taken to the place mentioned "for evil purposes," equivalent to the statutory words, viz: "for the purpose of prostitution ." The Indictment was bad.
