half-smoked cigar as he conversed good naturedly with Attorney Amea,of the defense. Mr. Ingham sauntered around the court-room in his usual restless, nervous manner, declining the proffered offers of a chair extended to him by the accommodating bailiffs. Ever and anon some inquisitive individual would appoach this legal lexion and endeavor to derive from his well-stored mind some information as to the possibilities of a complex verdict in a case of conspiracy where the evidence was so varied against the respective defendants. Mr. Forrest, too, showed up for the first time at 10 o'clock sharp. As usual he was taciturn, almost to the degree of moroseness, and the critical audience augured ill of the unfavorable demeanor of th'e leading advo cate of the defense.

At 11 p. m., the jury having failed 1o return a verdict, Judge McConnell announced that the court would take a recess until 10 o'clock to-morrow morning to give the ju 'ors further time for delib eration. Aftrr the adjournment of the court Judge McConnell was interviewed by an Associated Press representative as to the extent of his information in regard to the present mind of the jury. "I know nothing," said he, "except that they have conveyed to me the information that they thought it unlikely that they would be able to arrive at a verdict to-night. That really indicates nothing at all, as it was merely a kindly intimation to me that it was needless for me to remain up any longer, that I might as well repair to my home and my Blurubera. do not think that it reaily means a disagreement or a stubborn jury. It simply means that thus far the jury has arrived at no verdict—nothing else. It may mean they are deliberating upon the evidence or that they are interpreting the instructions. Certainly it cannot be reasonably interpreted as meaning disagreement. Do not jump at conclusions. There is a great deal for the jury to consider in this case. The court will meet at 10 o'clock to-morrow morning, at which time we will be ready to receive any further communication from the jury."
