14 y28. The state ex rel. Cornelius Corwin vs. Indiana and Ohio oil, gas and mining company. Jay C. C. Afllrmed. Elliott, C. .1.

The act of March 9. ISSi (Elliott's supplement, section 1,875). which makes it unlawful to pipe or conduct natural gas from this state to any point outside this state for use, and provides that any person, company or corporation so olTendlng shall forfeit any lands acquired by It for such purpose. Is unconstitutional and Invalid, because: (1) Natural gas Is an article of commerce, which mashe transported and bought and sold in the markets of the country, and the power to regulate commerce between the states Is exclusively In the federal congress, except in so- far as the states niav. In the exercise of the police power, legislate upon matters connected with Inter-state commerce, and the act In question can not be deemed a legitimate exercise of the police power. 'M As It Is apparent that the act was meant to prohibit the transportation of natural gas from the state by any person, natural or artlllclal.no matter whether the right to the gas and Its transportation be acquired by contract or condemnation, the argument that the legislature meant merelv to deny the right of eminent domain to persons desiring to transport natural gas from Indiana is not well taken. (8.) While the legislature mav regulate or restrict the business of foreign corporations within this state. Its authority with respect to them does not extend to matters of Inter-state commerce. (4.) It Is not In the power ol the legislature to prevent one citizen irom buying or another from selling property.

The rush on the druggists still continues nnd daily scores of people call for a bottle of Kemp's Balsam for the Throat and Ltfogs for tbe cure of CoughF, Colde, Bronchitis, Asthma and Consumption. Kemp's Balsam, the standard family remedy, is sold on a guarantee and never fails to give entire satisfaction. Price 50c and SI 00. Trial size free.

The best medical writers claim that the successful remedy for nasal catarrh must be non-irritatiDg, easy of application, and one that will reach all the remote sores and ulcerated surfaces. The history of the efforts to treat catarrh during the past obliges us to admit that only onei remedy has met these conditions, and that is Ely's Cream Balm. This pleasant remedy has mastered catarrh as nothing else has ever done, both phyeicians and patients freely concede this fact. The more distressing symptoms yield to it.

Interested IVople.

Advertising a patent medicine in tbe way in which the proprietor of Kemp's Balsam for Coughs and Colds does, is in deed wonderful. He authorizes all druggists to give those who call for it a sample bottle free, that, they may try it before purchasing. The large bottles are 50c and $1.00. We certainly would advise a trial. It may save you from consumption.
