Abstracts of Opinions Rendered Tuesday, May 7. 1889. -BAJLBOAD—IXJUKT TO KKPLOTB. ±12.543. Cincinnati, Indianapolis, St Louis Chicago railway company vs. Margaret Lang, administratrix. Dearborn C. C. Reversed. Elliott C. J.

Where a railroad company orders a section band to go to a certain place on tbe line of the road to perform a designated service, and while proceeding to t*e place upon a hand-car, and exercising due care, the employe is killed by reason of a wild train of the running of which he bad no notice, in the absence of more the company is liable but If the Injury is inflicted at a piaee beyond tbe point where tbe. deceased was directed by the order to go, or If the rules of the company require section men "to be prepared at ail times for special or Irregular trains," the company Is not liable. DRAINAGE—JCBISDICTIOH COT COLLATERAL

ATTACK.

13,724. The state ex rel. Wilcox vs. MaryS. Jackson etaL Tipton C. C. Reversed. Olds, Jf. Where a drain was ordered established by the circuit court of a county and assessments levied upon property within the limits of an Incorporated city, through which a part of the drain was constructed, tbe parties affected cannot. In a suit to collect assessments, question the Jurisdiction of the court to establish a ditch within the limits of the city. As against a collateral attack the ]-.dgment will stand and the ments to be enforceable. SEAL EST AT*—CONTRACT OB EXCHANGE—FRAUD, 13,697. Robert J. Craig vs. Moses C. Hamilton. Hamilton C.C. Reversed. Coffey, J.

One who represents that he Is the owner of onethlrdofreal estate of which an ancebtor died seized, conceals the fact that he had received advancements from the ancestor to the full value of bis interest in tbe estate, and thereby induces another who relies thereon to convey land to him in exchange for his supposed interest, which he conveys to the other by quit claim deed, is guilty of such fraud as gives a right of action. But if the representations were not relied on by tbe other party, and If tbe latter sought other sources of Information upon the subject and on his own judgment concluded to enter tbe contract and take his chances as to what he should get, there Is no right of action, as In such case there is no fraud. DEED—DELIVERY—DIVORC*—COLLUSIVE AGREE

MENT—ILLEGAL CONSIDERATION.

12,701. Milton W. Stokes vs. Andrew Anderson et al. St. Joseph C. C. Reversed. Berkshire, J. (1) Where a party signs a deed or bill of sale and throws it on the table, at tbe time saying nothing, and the other party takes the writing, this does not amount to a delivery, unless It is found that the paper was put where It was with the intent to bs delivered. If, after a party has signed papers and thus acted he Is to have the privilege of returning on the next day to examine them, for tbe purpose of havlRg corrections made If the papers were to be found erroneous there is no delivery. (2) A collusive agreement between a husband and wife, whereby the wife will Ignore the charge of Infidelity made by her against her husband and asks a decree upon another ground upon which she does not rely, be to make no resistance, but to aid In bringing about the decree and to pay costs and make certain settlements upon the wife, Is contrary to public policy and Illegal, and obligations executed by the husband as a part of tbe transactions are without a valid consideration.

LADING.

14,584. Louisville, Evansvllle 4 St. Louis R. R. R. Co.'vs. John H. Wilson et al. Vanderburgh C. C. Reversed. Mitchell, J.

The complaint of appellees seeks to recover from tbe railroad company overcharges of freight, made and collected by the company on 368 carloads of crosstles in disregard of an alleged oral agreement to carry plaintiffs' freight at a certain rata The evidence shows tbat the shipments were made pursuant to written and printed bills of lading, signed by tbe company's agent and delivered to tbe plaintiffs before the transportation began In each Instance. Held That it was not competent for the plaintiffs, wltbout alleging any fraud, concealment or mistake, to recover upon an oral contract made prior to the Issuing of the bills ot lading, but the rights of the parties must be determined by tbe express terms and legal import of these Instruments. If the rate of freight Is not stipulated In the bills the carrier Is entitled to recover reasonable and customary compensation. The complaint does not charge that tbe rates charged were unreasonable.

HUSBAND AND WIFE—JOINTURE—DESCENT. 14,201. Thomas Glass et aL vs. Elizabeth Davis et al. Howard C. C. Affirmed. Coffey, J.

A husband and wife conveyed certain land belonging to tbe husband to a third person In trust, the grantee Immediately to convey it to the wife In lieu of all her Interest and jointure In the other lands then owned or thereafter acquired by the husband. Tbe trustee conveyed to tbe wire as the deed stipulated. It was recited In the deeds that the wife agreed to accept tbe land so conveyed In full of all her Interest In her husband's estate. The husband afterward died, leaving neither children, nor father or mother. Held: That as it was evidently the Intention of the parties to make provision for the wife, merely by way of jointure In lieu of what she would take as widow in case she survived, sbe Is entitled under Section 2490 R. S., 1881, to take as belr what property the husband died seized of, as against the husband's, brothers and sisters of the half-blood.
