Under the present statute a divdrce may be obtained in this State, wbefebbt'h the plaintiff and the' defendant, at the time of the rendition ol the decree, are resident citizens of another State. True, the applicant must have been a resident of the county in which be commences suit at the da.te of the tiling of his peti tion, and he must have been a resident of the State for one year prior to that time, but tiie year having elap-ed, and .the pe tition being filed, his residence may tneti cease, he may return to the State from which he came, and his application for a divorce will be none the le« successful by rtaaon of his departure. Such a statute must be highly appreciated by divorce seekers from other States who cannot, afford to keep up the appearance of a residence in tiiL for mure than oneyear, but it is not calculated to give citi zensof Indiana a very exalted iiiea o! the righieo(i.-n%4 or wisdom of the Jegis lation of their own State. Even peima neni re-idents of our own Siate who ap ply for divorces are lavored by our prac tice above plaintiffs in other actions. The defendant in every other action purely personaj, if a resident ol thefefaie, must be sued in ilife county of hi* resi dence but in divorce cases, the applicant has the right to sue in the county in which he reside', and he can change his re.-iidence to attain success abroad, when failure would be certain at home.
I therefore recommend that the clansc of the statute which authorizes divoices for any cau-"e that the Court may deem sufficient, be repealed, and that the clau -.e making cruel r.auuent a good cause oi divorce be so amended as to lequiie the treatment to be cruel and inhuman, orcruel and barbarous. I further recommend that the ..practice in divorce cases be so. amended as. to embracfe the following provisions, viz 1st. Requiring the detendant, when a resident 01 the State, to be sued in the county of his or her residence. fed- Requiring the plaintiff not only to have been a resident of ihe State for one year prior to the filing ol his petition, but that he should continue to re 8ide in the State during the pendancy of theauit and until ihe case is tried. 3d. Vesting in the Circuit onrts exclusive jurisdiction lor applications for divorce 4th Requiring the petition in every divorce case to show where the causes 01 divorce relied on happened or accrued, and where the applicant resided at ihe time,and if they happened or accrued else whete than in this State, and at a time when the plaintiff was not a resident of this Slate, that no divorce shall be granted unless it be alleged in the petition and proved on the trial that the matters so lelied upon would be a good cau-e of divorce by the laws of the Staie, place or jurisdiction within which the same happened or accrued. 5th. Requiring the allegations as to the place where the cause or causes of divorce relied upon accrued and the place o' residence of the plaintiff al the time of their accruing to be verified.by affidavit appended to the petition, and also to be. proved on trial.
With such amendments as these we might well hope that Indiana divorces would soon cease to be advertised in any of the Atlantic cities as marketable commodities, and that refugees and fugitives from the justice of oilier States would no longer come to Indiana in' qheftt of divorces to be used on their return to iheir homes as licenses to violate the law.? of our sister States.
STATE PRISON'S.
So far as I am informed, the Slatp: Prisons are well managed ana in asati#factory condition. The tinancia! success of the present administration of the Northern Prison in making it self sustaining, without disregarding or neglecting the physical, moral or intellectual interests of the prisoners, i« worthy of the highest commendation.
The moral reformation that has been wrought in the affairs of the State Prison South, since the commencement of the administiatiou of the present Warden, has merited all the praise that has keen so generously bestowed upon it.
It is deeply to be regretted that under our system of officering these Insiitutions, the administration of their affairs is so liable to be changed with the mirations of political parties. Wisdom would dictate that considerable permanency of administration, coupled with a rigid responsibility on the part of those having ol such

I call your attention to the fact that there are insane prisoners, in one, or, perhaps, both of Qtir prisons, and some of these are dangerous io the other prisoners for the want of proper facilities for their care and treatment. Experience has shown in Ohio and other States that it is unwise to transfer such prisoners to the Insane Hospital, as placing those ton-' vicied of crime among the otfor itisarvapatient* has a bad influence on the latter, and the treatment which the insane prisoners receive from the other imnatfes of the Hospital,is nut such as to promote their recovery. In addition u» this, ihe Hospital is noL*Mifficicnt 1*.strong for such patients without preparing a uaid expressly for their accommodation. I therefore recommend that a ward be con structed within he walls of ihe Northern Prison expressly for insane p-isoners. and that provision be uiade for the transfer, from time to time, as occasion may require, of all insane prisoners in either of the prisons to such ward.
I invite your attention to the statements in the report of the directors and warden of the Southern Prison in relation to the fire that occurred in April last and the monev advanced to repair the damage done to the prison bv the fire. The nmount advanced was $1^000, and it was fuhiiitied by the Awdittfr of State out of tiie uninvested money of the Sinking Fund in his hands.
