We see in this the same principle that induces a ladv to value a shawl, a dress or a hat more highly for ist having been purchased on Broadway, although slie might have procured a better aiticle for much less money within a stones throw of her own door. But there is, in this country, a kind of higher law" that overrides all statutes, and that higher law, public opinion, l(:is decreed that a man may, with impunity, kill the seducer of his wife, daughter ir sister. This decree has been confirmed t'\ innumerable verdicts in every State of the 1'nion. We do not say that it a right. Indeed we think it is a very deplorablc state of public morals that permits a man to dispense with judge, jurv and executioner, and strike his viclim down without any other warrant than that vengeance which belongs to Omnipotence. But reams of railing and acres of argument have not sufficed to change, in the slightest degree, the prevailing u«age. Thev have, rather, strengthened it, M» that the mere supposition that the slain was a seducer is held to justify the slayer. What may be the true remedy for this evil, we will not undertake to determine, but we don't believe it will be found in the adoption of this suggestion of the incinnati Commercial:
Would it not be more consonant to common sense to tix by law—what has already been established by public sentiment—the right of injured husbands to shoot at pleasure the invaders of their marital rights? Then let it be incumbent on them to prove that while acting in the triple capacity of judges, jurors and executioners, the facts warranted their action."
It appears to us that it is much better to sutler the disgrace of violated laws than to legalize crime. The State is not required to become responsible fur the crimes of individuals, as it certainly would be were it to put a dagger in the hands of every jealous husband with strong encouragement to use it freely.
