LUCIEN LEMMON, well known as a merchant in this city fifteen or twenty years ago, while near the corner ®|$ourth and Main streets yesterday afternoon sud. denly fell to thp pavement. It was supposed he was affected by sun-stroke, and was carried into Chadwick's Livery Sta. ble. Physicians being called it was found that whisky instead of the sun had struck him. He was- placed upon a dray and removed to the old Court House, where he slept off the effects of the liquor.
JTJBISDICTION OF COMMON PLEAB PROSECUTOB,—A short time since District Attorney Holden, of tbo Common Pleas Oourt, wrote to the Attorney General, asking his opinion as to his right to prosecute before Magistrates, and submitted two propositions: First, whether the act creating the Criminal Circuit Court in this county, thereby taking away his criminal jurisdiction of Jhe Common Pleas Court in this county destroyed the Judicial District of which this county composed a part and, Second, whether he, as District Attorney, the old law remaining unchanged, had the sole or any right to appear before a Magistrate in cases of misdemeanor as District Attorney. The Attorney General replied that District- Attorney Holden's duties ceased" in the Common Pleas but not before Magistrates. This we consider settles the question, which has been one of dispute with the prosecutors.
THE S^NGERFKST PICNIC was not a success in the way of attendance. Some two or three hundred people were on the jjround, and enjoyed themselves, apparently as happily as if there had been thousands. In the atternoon brief addresses were made by Col. Thompson and
Dr. Max F. A. Hoffman. The T. H. & I. R. Co., to which the Mcennerchor had pledged a certain amonnt for the use of trains to and from the grounds, generously relieved the society from the pledge, and took only the receipts from the sale of tickets, after giving free t'ckets to the singers irom other cities.
We regret to learn tke entire Pestiyaj has not been a financial success. This is attributable alone to the intense heat which has prevailed. The entertainment has been of such a. character that hun-

dreds would have been pleased to have enjoyed, had it not been for this cause. It is a matter of regret that it was not convenient to bold it later in the season.
