The Terre Haute and Indianapolis Railroad Company are now engaged in the extension of their tfflfl 6f railroad to the line botween the States of Indiana and Illinois, and in doing so will be com polled to cross the following streets in the city of Terre Haute, to wit: Water, Linton,* First, Se«ond, Third, Fourth, Fifth, Sixth, Seventh. Eigth, Ninth and Tenth, in order to reach tbe Wabash river they, therefore, pray that permission may be given them to do so, upon such just and reasonable terms as shall be deemed necessary to secure the proper use of said streets by the public.

That the request made, in
writing bv the President of the Terre Hante and Indianapobs Bailroad Company, just read, be granted by this Common Council,' and that said Bailroad Company be authorized to construct and maintain Us track over the following streets and alleys in the city of Terre Haute, viz: Tenth, Ninth, Eighth, Seveth, Sixth, Fifth, Fourth, Third, Second, First, Lintoa and Water Streets, and the alleys embraced therein, and on the following conditions. That the said Railroad Company, in constructing their new track Ihall preserve the grades of said streeits, as now established, as far as tbe is practicable that its officers and managers shall Cause to be built stone gutters under their track at all street crossings where the same shall be necessary to cause the water to flow in its natural channel, as established by the city grade that ?bereA change of grade becomes absolutely necessary and unavoidable, as in the case of First and Seeond streets, the said Terre Haute and Indianapolis ®*ilrt»d Oompany ehaU regrade and re-gravel said street, or part of street, (where such streets have been heretofore graveled), free from all charge to the city, or to the owners of adjacent property, the object being to place the *ctfy and property owners in as good a con« dition aj^ec and as the new road Touna them, having iTproper regard for the great importance and value ot a new railroad, such as that now Building frooQ.
