l^th, 10 p. Mj-r-To-night about 9:30, durring a large Democratic speaking, a horrible murder fas committed in this place.

DanMl Defiz, a batcher raiding on the National Road, in Harmony, cat his wife's throat Irom ear to ear, severing her windpipe. Every person being at the speaking, she was not discovered for twenty ^fr|i«toi» JTred Deitz, her brother-in-law, ^happening to go into the room, saw her' and immediately gave the alarm. The fe|jea1cer ceased speakingimmediately, and every one armed themselves to hunt the murderer.,

t/

After committing the deed he started to tte switch, calling for William Dickens, a man whom he had a grudgo against, and it is generally supposed he wanted to injure him, as he had the bhtchor knife, some eighteen inches long, with which he had cut his wife's throaty still in his haod-r

Dickens opened the dnor

an& SCtetmed out. He ran off then, but in whict^ diction could not be ascertained. Several persons got on board the train at 10:15 p. m. to take him if he goes to Brazil. High hopeB are entertained of bis arrest.

He is about five feet nine inches high) heavy built, red complexion, about 35 years old and very burly looking.

He was dressed in a grey suit when last seen. Is very much used to drinking and very quarrelsome and dangerous when drinking. His wife had him arrested and sent to jail last Friday, but he succeeded in getting bailed out at Bowling Qreen, and returned here. He seemed very quiet, and no one suspected he pre* meditated the horrible deed. At last accounts the woman jus thad life in her, and that was all.

W.

L. Holt and Brevet Lieutenant Colonel H. R. Alalcom. COLLECTOR FOR ALASKA.

Attorney General Evarts has rendered an opinion on the question of appointment of a Collector lor Alaska.

He says, "The office should be 69t in operation at once unless some legal impediment exists. I do not find it embraced with the tenure-of-office act, and under the accepted construction of the constitutional authority of the President, I have no doubt of his power to grant a commision to the Collector of Customs for Alaska, which shall expire at the end of the next session of the Senate."

COLLECTOR AT NEW ORLEANS. Attorney General Evrrts has given an opinion that the office of Collector at New Orleans is now vacant, becoming so by his resignation and complete installation as a member of the Senate.

The Constitution says the President shall have power to fill up all vacancies that may happen during the recess of the Senate, by granting commissions that shall expire at the end of their next session. The only doubt ever suggested on the construction of the clause of the Constitution has relation to the true interpretation of the phrase "that may happen during the recess of the Senate."

The subject was fully discussed by Mr. Wirt in the year 1823, and no view or argument that could shed light upon a correct decision whs omitted from his conx sideration of it. He arrived at the conclusion that the vacancy in office which might be filled by the President under this clause of the Constitution was not confined by it to vacancies originating during recess of the Senate, but embraces all vacancies that from any casualty happen to exist at a time when the Senate cannot be consulted as to filling them.

Mr. Evarts then proceeds to examine the tenure of office act, the 3d Section of which alone bears on the subjocf, and concludes that upon tho well considered and long continued interpretation of this clause of the Constitution the Prosident has the power to fill the vacancy in the offico of Collector at New Orleans, by granting a commission that shall expire at the end of the next session of the Senate, and that the tenure of office act does not in terms or intent, nor legislative construction of this clause affect this power of tho President in thecaso submitted for my opinion.
