ha^e&s corpus before district judge can, or ought to be carried by appeal to the Supreme Court of the United States.— When we reflect what an immense business might be throwa upon that court by transfer thither of case3 of whisky frauds and of ihe hundred other crimes and misdemeanors, punishable by Federal laws, we are entitled to doubt whether it was #rer Intended to deluge the Supreme Court with that sort of business. During all that period the interior Courts of the United States exercised the power of issuing writs of habeab

or writ of error. -Such has been the practice, alike under Federal, Democratic and Whig administration» of the National Government. No one pretended, that because there was no appeal to tho United States Supreme Court, from the decision of the lower Federal courts, any injustice waB done. It was reserved for Mr. JOHNSON to make that discovery upon a question of a repeal ofauch statute after one year's trial, and evidence that it could be put to fi dangerous and unexpected political use, as was attempted in the case of MOABDLE. A repeal of the act of 1867, does not take away the rights of citizens to the writ e/ habeas corpus, as it .always has existed under t*be Constitution before that act was passed. It is not a measure of hardship Or of oppression, but only ft question of expediency, arising under the construction of'a law fcnd with reference to the use to be made of it.

The Fourths Congressional District, under tlie apportionment made last win ter, is composed of the counties of H^n cofek, Shelby, £ueb, jj^ayne, Fayette, Union and franklin, and retains, it may be said, the soul of the old Fifth District Its Union majority^ as shown by recent elections, is between three and four thous and consequently a nomination there is equal to an election. The question In that community of counties is, who shall be the next representative in Congress And while the question cannot be answered with any considerable degree of prophet, ic accuracy, a sort of grim impresssion preyails. tbat Mr, -Geo. W. Julian will again be his own successor and that he has taken such deep root in the soil |of Eastern Indiana nothing short of a political hurricmrife %ill tear him out. Mr. Julian is an able Congressmen—a statement which &rth bis- Veteran enemies will* admit. His labor in Congress, nearly always in the right direction is unremit, ting, and-generally successful. Personally Mr. ulian is one of the most unpopular men in Indiana—ohe of those Whose friends are the truest, and whose enemies '.'ittuw are the worst.,- f,..

There are but three candidates, recognized as such, and they are all making efforts to get the nomination—-Capt John H. Farquhar, of Franklin county, Gen* T.W. Bennett, ot Union, and Hon. Geo. W. Julian, of Wayne. Judge J- M. Wil" son of Connersville wiil probably be In the field before the meeting of the Congressional convention. Capt. Farquhar's county, before the new apportionment was in the Fourth Distriat, Which he recently represented having been elected in 1864. Capt. Farquhar and Gen. Bennett are both strong and pop ulat men, and it is said by some that the race is really between them but the pol Itlcian who underrates Mr. Julian'i strength, or his pipe laying proflcienoy, will be apt to discover something before the RcyouroBM(nt of the District conveji tlon. Mr. Julian's reliance is considerably impaired by the formation ofthe new district, and It is thought by some who ought to know, that Gen. Bennett's chances, on tht whole, are boit. Tho Convention will be held at Connersvillp on the 30th of April.

TUB FXJTH DISTRICT-

In the Indianapolis District the Congressional nomination has, as yet provoked no controversy, and this ia construed as favorable to the re-nomination ot the present incumbent. Gen. Coburn is a hard working, efficient representative, and I think there is no doubt but he will be returned.

No overtures have yet passed between Governor Baker and Senator Hendrickl in regard to joint discussions, or the manner of addressing the people in the coming canvass—so far as the Gubernatorial

Fred. Douglass lectured here last week, at Morrison's Opera Hall, and, as is well known, tho thing was a failure. Mr. Douglass, I. learn, attributes his failure to the Young Men's Ohristjan Association

When here last year he insisted that'tha tti population should be allowed to sit anywhere in the Hall with white people, and by so doing Mr. Douglass made an ass of himself. He not only- injured and robbed himselfi but came near making a bankriigt of an estimable .colored individual who had rented a hall fn Terro Hante and Evansville, and perhaps one or two other place?, and was to pay Mr. Douglass a stipulated price for each lecture.— On account of the objections made to promiscuous sitting, the lectures were not delivered, and the contractor did not make anything by three or four hundred dollar?. Mr. Douglass will perhaps learn that the public cannot be forced into a modification of views on some subjects.

It is not every.city that has a Varieties Theatre. Wo have, and I hasten to say It is duly noticed by the daily papers, and the theatrical critics. They assnre the public that in Mozart Hall, i. e. the Varieties Theatre, nothing will be seen to offend tne mostjfastidious. They say it,' and it must be so. ihq assurance.doubtlesa induces many to go, or perhaps those who attend would go any how, and consequently the Varieties—otherwise the Vulgarities—draw well. I do not profess to be over-fastidious on the' subject of amusements, and think 1 can stand about us much of the "Black Crook," or "the Devil's Auction" as any other person in good health but public morality is not a myth, and the Varieties Theatre it a stern

reality. The anique establishment referred to was opened some weeks ago, and has done pretty good business—even while Forrest was here, and while Mrs. Waller playing in the beat of characters to a garly show of empty benches. With something of hankering to know what^was going on at MoZart Hall, I went and saw. The variety is all there, visible to the, naked eye.

One of the female artistes is a, singer— or perhaps a Wheeler & Wilson. She does airs from the opera, and popular mel odies, and some Of the latter tolerably well, but seldom in manBer that would assuage the grief of aboriginal bosoms— with perhaps one exception. The excep tion is the song in which are the lines, as Mademoiselle sings them: "OH! I'm lonely to-night, 1OT«, wilh-IHOUT you, My lot« I c»ti NKV-«r conceal, r.

In the rendition of that couplet the artiste deftly removes the fragmentary texture from the shrub, and the audience duly appreciates the consummation.

It is this feature of the Varieties that creates the draft—that makes the misnamed theatre draw.- Without it, would bo infinely worse than Hamlet with the character ot "Melancholy Dane left out—there would be eo Varietiesnothing but burnt cork and lager beer.: Therefore the Varieties have attraction and tho chaste and refined amusement con tinues. Not only performances nightly, but a matinee each Saturday afteroon for ladies and children. The announcement of the latter gives occasion for the quaint interrogatory, "How's that for cheek

THE METROPOLITAN.

The engagement of Mrs. Waller,, by the new management of tho Metropoli tan, was a disastrous failure, and will probably dislocate all the profits that ae crued from theengagement of Forrest, was unfortunate that .Mrs. Wallet follow ed the great tragedian. Aside, hOweter, from a growing dislike of such characters as "Meg Merrilies," the "Duchess Malfl" and Hamlet, by a woman, whiqh is in Mrs. Waller's reportoire, the public relishes now and then some first class comedy, and characters like "Major Wellington de Boots," John E. Owens in search of an "Apple-eass lawyer," and tbe like.
