to amend the Bankrupt act, will apply to section thirty-three of the present act.—1 It is now the law that a debt created by fraud or embezzlement, or by breach of trust while the party is acting in a fiduciary capacity, Bhall not be discharged. But the debt may be .fttoypd^ainst tbft estate, and tho c?e4itor^Eeceive hjjf dividend, which shall fee discharge for as much as is paid. Another clause enacts that a discharge under the bankrupt a&t shall not release er .affect any »other person jointly liable with the bankrupt for the same debt, as partner, joint contractor, indorsor or surety. i?he same sefction contains the important declaration that in all cases of bankruptcy where proceedings are commenced after ope year from the passage of the act (which time ex* pires March 2, 1868), the party should not be discharged unless his assets induce fifty per cent, upon his liabilities, or ho has the written assent of a majority in number atid value of his creditors. The changes, which Mr. Stkwabt proposes areas follows:—He would re-enact the portion of the law in reforence to the nondischarge of bankrupts as to fiduciary debts and etnboKzlements,-with the stipu-, lation that others jointly liable with the bankrupt shall not be released, but he would extend the fifty per cent, clause uutil one year after June, 1868, under the same regulations as are prescribed by the present law. It will be some tjme before both Houses of Congress will act upon this proposition. Andrkw Johnson has not proved successful revolutionist. Thus far the Executive conspirator has failed in every movo he has made towards carrying out his revolutionary programme. In the prosonco of an outraged Congress and an indignant people, determined at last to check his usurpations finally and forever^ he stands dismayed and irresolute. Find* ing himself without the support of the army, which he vainly hoped to use against! the people's Jrepresetitativ^s, he now sees the desperate character of the
coup d'etat
which he undoubtedly sought,
to effect. And finally, with a Cabinet no moro equal to the emergency than he himself is, and with only a halting and heartless support from his Democratic friends, Andrew Johnson, despite his periodical declamations of trust in the people, must feol to-day that he is in a defenceless attitude before his countrymen. He shows nono of that fearless confidence which iB born of the consciousness that he "hath his quarrel just," and can only content himself like Micawbib, with "wailing for something to turn up." "Emboldened by the reluctance of Congress to bring forward articles of impeachment, h6 determined to take one more and bolder step in his revolutionary progress. He took the step and it gives strong promise of prov* ing the fatal act which shall cause his official death and disgrace. His stubborn, blundering course has already lost him many Democratic friends, and will lose him what few he may have remaining in that party. AS we have often said, he hasn't the stuff in him to make a successful revolutionist, and, fortunately for the country, his Cabinet are unable to supply the deficiency. They are not revolutionists, anyof them, and ooosequenlily not the men for the "hour—or for his purposes —not the men to carry him through a boldly conceived campaign against Congress. .First, there is Sbwars. He demonstrated his incapacity to meet a great crisis whon the rebellion broke out. He was completely unmanned by it and trembled in the presence of the maddened, leaders of the conspiracy. And yet he seemed utterly incapable of appreciating' the startling fact that the country was in the midst of a groat civil waT and talked of it as a "political disturbance'' and an. insurrection," at though ft was something to be put down by a constable's posse. With indecent haste be made known to the powers of the Old Worlds that the suppression of the insurrection! would leave the status of all classes and! persons unchanged. According to this*
