Virginia, recently before the United States Supreme Court. Questions of this character, constituting, as they do, eisen Ual featurca of the political history of the country, lia^e an interest not confined to members of tha legal profession, but shared by all who doaira t.-) fca welUin formed upon events of national importance. The only question of interest involved in this case wt.B the constitutionality of a law transferring the counties of Jefferson and Berkley from the Oidbtate of Virginia to ths New State of West Virginia.
It will be remembered that the passage of this act occurred during the Admin ietration of Governor PIEHFONT, and when his administration at Alexandria, being the only loyal organization in Virginia was recognized to some extent as the government of that State. After tbe fall of the rebel power and the occupation of Richmond by the authorities of the United States, the seat of government was transferred to the old State capital, and-Gov. PIERPONT and his officers became the provisional government of the State.
As the readiest and perhaps the only practicable method of testing tha legality of the cession of the two counties a law was passed repealing the act of 1862 by virtue of which the transfer had been effected. Suit was then brought by Virginia in the Supreme Court for the recovery of the coveted territory, the fairest portion of her former domain. The coun« iel for the old State of Virginia submitted five points, as follows
First. That no State can, without the consent of Congress, enter into any agree* ment or compact with another State or foreign power. Tbe proposed transfer from the Commonwealth of Virginia of that part ef its territory and jurisdiction* now in question, to the State of West Virginia, could be effectually made only by a "compact or agreement," within the meaning of theco words in tbe ConBtilu•tion. One State cannot grant and another accept a cession of territory and jurisdto. tion without a compactor agreement and all such compacts and agreements have been uniformly received and treated by the judiciary and by Congress as witbin this provision of tba Constitution, and as requiring the assent of Congret'. The acts of States in refdrenoe to their territO'* ry are not to be interpreted by technlca1 rule?, nor evidenced by techuical words* The substance of tbe transaction and the real intent and effect are alone to be considered. If the thing proposed could take effect only by force of a compact or agreement between two States, that thing is prohibiied from taking effect until the as. sent of Congress is obtained.
Socond. The legislation of Virginia, as to the cession of these counties to the State of West Viiginia, wss only a propoial to become operative as a transfer of territory upon certain conditions so far as it depended upon the Commonwealth of Virginia to prescribe those condlt ons they are contained in its acts of legislation.— But&o proposals by one State to another State can amount to a concluded compact or agreement uotll the consent of Congres is given to it. Prior to that consent, any action of the State must be deemed a proposal only, which it may withdraw or oontinue, acoordicg to iu own sense of right.
Third. The Cummonwe<h of Virgin» ia had amply sufficient grounds and reasons for withdrawing its proposed agreement to a cession of part of its territory, and did withdraw. it before its proposal bad become operative as a concluded oon^pact or agreement.

light, up and down, to tbe right and left,1 divide the circle into quarters Away up toward the zenith of the heavens, a beautiful rainbow adds to the weird, wonder* ful beauty and brilliancy of the scene.— Down goes the mercury, 18 below, down down, until the night of January 12th it touches 35, below. During the day it rises to near zero, the sun shines out as bright and cheerful as May. Looking out from a warm room, you would think, save for the anow, that trees might bloom. Don't act on that belief my sanguine friends but wrap up well ere you venture cut, or Jaok Frost will nip your nose and toes. Tbe coldest weather in this climate is the stillest, and the quiet of nature is most profound. A sled may be heard creaking over the frosty snow for a long way, and your own foot makes merry music as you move with quick step.
Even with this cold, men don't stop their wcrk Teams and choppers are off to the woods, as all work in the timber is done during the winter. Children trudge to school t»nd man meet you with "a fine day,sir?" They are a perfect antidote for the blues, and add much to tbe curative qualities of this region. Let me give you some idea of tbe health of this town of throe thousand people. Since tbe first of April last, there has been but five deaths here—three infants, one child with croup, and that ia all. For two years no grows woman, single or married, haB died. Mind that, ye men who wish to retain yotfr present oonnubial partners all others are referred to the divorce laws of Indiana. It is easy enough to give statistics of the deaths. Not so with the births, there is always one more to be added, and the list can never be finished complete. Indeed, our M. D.'s say exoept for this branch of practice tbey would become a public charge, and giva this as a reason for their big charges.
For vigorous health, exuberant spirltii good soil, timber, water and the real elements of enjoyment this is the country.
But tbe country is poor in money.— Most of our farmers had more tow headed children than any thing eke when they came, and have had a hand to hand fight ever since, but day is breaking, and the

Extract frotn a letter written to a friend at the North by a.gentleman residing in one of the northern counties of Mississippi pi: "Our condition in this section is very distressing, From bad seasons and worse laborers, our planters have entirely failed) they made short crops, and for these they got the smallest prices. Cotton, for which they expected to get twenty cents, ia down to eight and erne. The largest majority of the planters are hopelessly ruined, and are taking advantage cf tbe bankrupt law, wiping out all indebted* nets, surrendering all their property to their creditors, and beginning afresh. Of oourae great rascality la developed in many of these transactions. There is much actual, suffering from the want of tbe prime necessaries of life and all feel the greatest anxiety about the wh erewlthal to sustain life. 7et. amidst all this, they are no humbler They have bad many takings down, (and these are still coming—every now and then,) but still they draw no nearer to God. I never saw a people ia a worse spiritual condition Their lack of true, vital, religion is ap palling to a minister, and one who loves tha cause of God. The most earnest-4i rect sermons seem thrown away and the fireside pleadings seem of no avail. All we can do is to pray to God to 'arise and defend his ewn cuuse.'
