note enclosing that of J.H. Dooly, Treasurer of Boone county. We havo two distinct nets, or laws, for the construction of plank and gravel roads. The act of 1852. I. G. and H., p. 474, as amended in 1859, and as again amended in 1867, p. 169. Thh law reuires a subscription of stock equal to J800 per mile, n? a preliminary to the organisation of Bueh Company, and after said organization, if the money subscribed is not sufficient to complote said road, an assessment of benefits may be had on the lands within one and a half miles of said road. This assessment is paid in the annual payments to the Treasurer of the county. Under Urn law the payments made on the stock will operate as-a credit on tho assessment and the receipt of the Company presented to tho Treasurer is a good payment on the tax a»?088Pd. [[Section 4, acts 1867, p. 169.]
But this is not the case under tha law of 1865, p. 90. This law allows the construction of such roada without any subscription of stock. The action of the Board is bas ed on the petition of free holder?, owning end representing three-fifths of the real estate slong the line of the proposed road. I am respectfully, •. E. Williamson.
