In June last, Van Buren Cobb, of Morgan county, Indiana, was d^c,lared*a bankrupt by this Court. The matter wa§ then referred tc the proper Register and subsequently, on a meeting of his creditors, William B. Taylor was appointed his assignee.
Under the 14th Section of tae BanK rupt Act, the Assignee set apart to Cobb certain properly, as being excepted from the provisions of ihat act. Cobb had other property, which he claimed was also excepted from said provision oat the Assignee disallowed hia claim.: To this ruling of the Assignee the bankrupt ei cepted and the exception thus taken now before this Court for decision- ..
By the record, it appears that the de cision of the assignee was substantially follows: *!|fc fi/.ito*.! "I allow you to retain, as exempt from the provision of the 14th scotion of the act, "and also in connection therewith, and under and by virtue of'an act of the Legislature of the State of Indiana, to exempt property from sale in certain cases, the sum of three hundred pilars." "I allow you the nccesfary provision on hand, amounting to fifty^one dollars and fifty cents, as shown by the appraisement." "I refuse to allow you lo [retain more property of any dgpeription whatever, tor the following reasons, to-wit "1. Because your wife is owner in [lea of eighty acres of land in tlife, Morgan ceunty, of the value i.t $1,0(56. "Also, she is the owner in fee ofj house and lot—your residence—in Mjartinsville in £ald county, of tfio value of $2,000. By the record it also appears that the $300 allowed by the assignee to be retained by Cobb under the provi»io|i of the State law, "consisted of "rt'tule ciond which said Taylor, as life assignee, held against one John I)uekworth callifag for a deed to four towtnots in Martins^ villo." •. 'I
The record also s&ows that all the otler property of the bankrupt turned ovjer to the assignee, was of the value of $287, including household and kitchen farditure, which latter was appraised at $175. By the record it also spears that 'tbo $51 50 above followed to be retained Cobb consisted of prov^ios on hand,
It appears also that Cobb is a liouie holder in Martinsville arid that his family consists of a wife and three small chil (iron.
Cobb insists that the assignee ought to have allowed hipi to retainlall the household and kitchen furniture, amounting, as we liavo soen, to $175. He urges no other objection. Whetber^jtherefpro, under the 14th section -^jrob$Mbktfupt act, a bankrupt, being a householder, is absolutely entitled to retain necessary household and kitchon furniture to an amount not exceeding $600, is the ques« tion to bo decided. The provision of that section which touch this question arenas follows:. '10

In construing this provision of the Bunkrupt Act, I iuclino to think the following rules must prevail: 1. Every bankrupt who is a householder is absolutely entitled to have his necessary household and kitchen furniture exempted to any amount not exceeding $500.
It is truo that, undor thi9*rule, the furniture exempted must bo "necessary household and kitchen furniture. And'I think that the assignee must, in the first instance, judge what particular articles are "necessary" and. what aro natj *.j|ul his judgment must be controlled M&- a sound legal discretion and &V the spirit and intent of tho act under consideration. 1 think iho act intends that every bankrupt, householder shull bo permitted to res tain as much household and kitghea fur» nilure, up to the value of $500, as may be reasonably necessary to enable him to keep house in a plain and convenient manner. And I suppose that in such a case, tho tact that his wifo may hfive^ as her separato property, household Jtod kitchen furnituro in use in the hou§e in which he resides, can make no difterenco. By tho laws of Indi» ana, such separate property does not belong to him: he has no right to its possession or control and she may, at any moment and against bis will, remove arid dispose of it. 1 think, therefore, that tho assiguoe erred in takiDg into consideration tho property of tho wife, in deter* mining how much the husband should re•tain ot household and' kitchen furniture.
But, even if the wife's property in tho house oufjht to have been considered by tho assignee, still it seems to me that be erred in refusing to alldw thtf husband to! retain $175 worth of household and kitchen furniture. The wife property in the house was of little value—parlor funfiture worth $1"3—a bed and bedding worth $40—a sot of queensware $7—an ld bureau nnd tabic worth $10—in all, worth no more than $180. A court may, 1 think, judicially take notice that these articles did not compose all the "necessary'' household and kitchen furniture of a family consisting of a man and wife and throe small children. It to this the assignea had added the $175 worth of the bankrupt's household and kitchen furniture, ii only would have amo(juted to $355— surely little enough for the "necqp sary" furniture in the dwelling bpueeJpf such a family. And, if to all this we add tho $51 50 allowed by the assig^e^ is "provisions"' the whole will amou&t only to $406 50—$93 50 leas than the* act of Congress permits.

I do not. think thatMn an)- case the bankrupt law meant to exempt anything of niereHukury or ornament in fuvor ot a oankrupfi ButI#iippose that it is not tho policy or spirit ol the law to strip him ot his property to such an extent as to leave him and his family without the meat)a of keeping: house and remuining together, as a household. 3 In case of every bankrupt, who is householder jesident in the titate, he is absolutely entitled, over and above the exemption already considered, to retain, free from all claims of creditors under the bankrupt act, property, either personal or ra»l, to the value of *300. It soon became evident to me ..that landing in XJanada was out of tho question, and that all arrangements must bflttindo to be driven across the lakes.
The first thing that struck me was to drop tho grapnel to the full extent, 120 l'eet. This acted as a guide to the distance the balloon might be kept above the surfuce of the'wuter it being now dark, and, by placing one hand on the rope, the ell'ect of the grapnel striking tho witter Was distinctly felt With an open bag of,ballast on my knee, every tiitoe the grapnel struck the water,* a couple of haTidfufs^df' sarid were thrown out—and to this "plan alone I owe my own preservation and ^success. "The" ballast taken was about tnree hundred and fifty pounds. For threo ho.ura that plan was carried out, and then came on one of tho most drenching and merciless rains I ever felt. I could not see fifteen feet before me, and the noise of the rain on the balloon and the water was such as to entirely unnerve me. My hands became numb, and I was drenched to the skin. The rain was making tue balloon heavier every moment, and the ballast was thrown out more freely, till, jJjuut 10 o'clock, when *SSeT^Tigue overcame me. I fell into a stupor for ft few moments.- By this time tho balloon had descended to within mx reetmtho water, and instantly out went twenty-eight pounds of ballast. The effect Of this was that the balloon rose to an altitude of a mile, entirely through the rain-clouds, and then the moon shone brilliantly, and in this position it remained aBout a quarter'of an hour. The effect of the moon shining on tho cloud beneath was such as any artist might be proud of.
The shadow of the balloon was distinctly to lie seen traveling over the rough and turevon cldOTB,'giving the idea of a bal loooxuce^ ^Everything now became calm. No longer the hum of the lake or the rain. All was still, but whether the storm still raged ^eneath, was unknown. As tho tJallofen' Sesccftded, it was evident a change hatj. como over the scene. These proved to be the fields and hedgef, and they appeared to vanish a* quickly as objects passed when in an express train. A town was at last seen, and I hoard thousands of musical instruments. This afterwards-proved to be a little village near Cleveland. I then called out lustily the sounds of persons singing and playing music were heard. They at once set to work to pull the balloon out of the woods and convey it to a field, where it could be folded up. it was then 3 o'clock in the morning^
