County Expenditures.

When I vraa appointed to act a CgmmiEfiioner last "Winter there was noV a full sett of oar statutes in the 4-ttditoi'fl' office. It was not till after the. adjournment of the Legislature that they wera procured. The Commissieners came very near acting in some two or three instance* on statutes that had been repealed. In part we did make an allowance in one instance on a statute which the Supreme Court decided had been repealed by implication. In this case the old law hadnot been repealed in so many words, bat the Legislature had passed a law which the court said was repugnant to the old law and therefore repealed it. The old law had been acted upon for several years. No doubt in ignorance of its repeal. We have corrected the error. After obtaining a full copy of the statutes I prosecuted a more thorough examination of the laws pertaining to our duties. This examin* tion produced in our minds the convic-» tion, whether right or wrong let others decide, that a correct interpretation of our statutes would save some three thousand dollars a year to the county.

In the Auditor's office we made a change in three particulars, to-wit: we struck out the three dollars per day for attendance on the Commissioners during term ®f court also the one hundred dollar per annum for extra services, the law having boen repealed, also we changed the allowance from ten cents por order to ton cents por 100 words. In th9r Clerk's office the matter of allowances came to us in a somewhat embarrassing shape. The greater part of the money drawn from the Treasury by the Clerk hus been on allowances made by order of the Oirfcuit and Common Pleas Courts. Some of these allowanoes we thought were not authorized by the statute. They wore nevertheless orders of a Court of record. And the statute made it the duty of the Auditor to pay orders of a Court of liecord having a seal, without consulting the Commissioners. As the county was not a party to these orders or decrees, and would not therefore appeal from or reverse them. It therefore became an embarrassing question how we could correct what we thought an error.

Our Supremo Court had, however, in a case taken up by the Commissioners of Tippecanoe county, found in 6th Ind E., decided that the county was not absolutely bound by their orders of allowance That was,a case in which the court had appointed an attorney to defend a criminal and had allowed the attorney twentyflve dollars. The Auditor, under the direction of tho Commissioners, refused to draw his warrant on the Treasurer for that amount. The lawyer served out a writ of mandate against the Auditor, and 'ho court decided in favor of the attorney, and directed tho Auditor to issue his war rant on the Treasurer for that amount, and that if he refused to do so for the Sheriff to put him in jail. The CorUmis sioners appealed the case to the Supreme Court. That court reversed the decision of the court below, and decided that under tho existing law the court below had no authority to

lowance to the attorney. It may be that under the present statute the court could fix the amount of the allowance to an attorney in just such a case. This decision is cited to show that these eiparte orders of the Circuit and Common Pleas Courts although orders of a court of record, are not absolutely biiiding against the country. Understanding thestf views we di rectei the Anditor not to pay certain of these allowances, some of which we will speoiiy. One item is that of certificates of allowance issued mainly to jurymen, These certificates number from eighty to eighty-five each term of court—there being five terms of court a year. The Clerk charged fifty cents each for theie certificates, printed at the expense of the county. These certificates cost the county from thirty to forty dollars each term of the court for simply informing the county who sit on our juries and who were our Balills, &c. The Auditor is entitled by law to five cents for writing each paper. Now the Sheriffs report, which the Clork copios into the order book contains all tho information needed in the Auditor's office on this subject. Tho Clerk has two dollars for entering the Sheriff's report. A copy of which, paid4br!by the 100 words, would answer every purpose and save money to the county.

The Clerk also claims three dollars per day fur his attendance on the Circuit and Common fleas Court. This we think is not warranted by tho statute. Tho law under which it is claimed is found on page T9 of the acts of 1865. This act professes to regulato tho foes of Sheriffs. There is one paragraph in this fifth section next to tho last paragraph, in which the Clerk is named, giving the Clerk and Sheriff a right to compensation for extra services. In no other paragraph is the Clerk named. If it had been tho intention of the Legislature to give the Clerk threo dollars per day, all that would have boon necessary would have been a continuation of the above paragraph, to-wit: by saying, "And shall also receive three dollars per day for attendance on court." Not doing this, it ooenrs to me that they did m-t intend to include the Clork. The Tho paragraph that I shall quote is wholly independent of the above paragraph and in style and phraseology is like all the preceding paragraphs, in behalf o£.the Sheriff alone, and reads as follows "ifor attending court per day three dollars.'' The specific'fees of the Clerk are provided for in this fifth section. If the Legisla» ture had intended to include the Clerk in this paragraph, he should have been named in it. But the fact that the Clerk was named in the preceding paragraDh and "his name omitted in this,:' shows that they did not intend it for him. This con* struction is believed to be in accordance with established principles of interpreting statutes, and is materially strengthened by surrounding circumstances. The Clerk makes decidedly more per day by his own labor during term time than between terms of court. This is not the case with the Sheriff. His chief duty and labor during court is to keep order, occasionally

It would be a poor excuse for a lawyer to say he was not ready to try his cause, bo" cause thecounty had not made this docket or memorandum book for him. If members of the bar would not furnish these duckets for 'themselves, or were unable to do so, and the want of them added expense to tho county, it would ue some excuse for paying for them out of the County Treasury

This is not understood to be tho casa' After what oxamina'tion I have been able to givo the subject, I come to the conduction thai the statute did not authorize them, and it was conferring benefits one class of citizens not enjoyed by others. On these views we acted. All th« members of the bar will have to do .will be to print or wrjte out these memoranda for themselves. The Judicial expenses of this county is a large item, and ought not to be unnecessarily increased.

We are happy to be able to state that neither the Circuit or Common Pleas Courts ordered bar dockets at their last terms.

Perhaps at some future time I may hint or poiut out how the Judicial expenses of the State may be lessened by some modi fication of the Judicial system. .. C. W.

He Wants to Know.

,, From the Lafayette (Ind.) Journal. We have a communication from a gentleman who signs himself "A Countryman" asking why it is that so many young married couples are obliged to lodge in second and third story: rooms, in offioes, over stores, etc. around the public square and the streets leading to it. He also relates an incident to illustrate another thing he don't understand. While awaiting a lato train at the market space a week or so ago, he observed a gentleman and lady going up into the second story of a building in tne neighborhood, and being of an inquisitive turn, he inquired who they v?9re and what they were doing out that timo of night, when he was informed that they were man and wife, and were simply going to their lodgings. The name was given him, and in the moonlight he had a fair view of the lady's face. On his return trip he stopped at an up-town hotel, and while awaiting tea was introduced by a friend to a lady as Mrs. the wife of a resident of the city. Ho at Once discovered that she was the same woman he had noticed by moonlight a short time before, in company with a man, who, if his introduction was correct, was not her husband. Our friend, «'A Countryman," is evidently a philanthropist, though rather verdant in city matters, and says that if there is not sufficient accommodations for the young married people in totfn without' being compelled to lodge about in public places, they had better go to the country, where they can be better provided for. He knows of plaoes where at least,» dozen young men and their wives can find good situations among the farmers. The old gentleman must undoubtedly be a Quaker, and being honest and virtuous himself, supposes everybody else must of course be so. We can only answer his queries by saying that if he will stop in the city a week or so, and keep his eyes open, he will find that there are more things in heaven and earth than are dreamod of in his philosophy. Wo would however remind him that "where ignorance is bliss it is folly to be wise," and advise him to stay at home, and beware of tho temptations of city life.

Patting on "Style."

The Dayton Journal tells tho following "yarn A few months ago a gentleman moved to this city, and purohased nice property, and, among other things, to contribute to bis convenience and comfort, procured a fine horse and a very genteel carriage. A "likely colored boy" was employed at a fair salary to take charge of the establishment, and discharge the numerous duties which(arisearound a well regulated homestead. For a time things went on smoothly with "Chores," but latterly he seemed out of spirits, and seldom smiled. A Leopard Killed toy a Tiger. In the end of March, 1865,1 was encamped in the Teraie and borders of the forest under the Himalaya hills. Some of my mahoots, who had gone out to cut fodder, heard the cries of an animal resembling those of a pig when in the claws of a tiger. They left the jungle at once, and reported the circumstance to me on their return to my camp. After break* fast we started for the jungle,but on beating it no trace of the pig or its remains could be found. We found, however, a very fine leopard, measuring over six feet, dead, but not yet cold. On examining it there were no marks of bullets visible. A portion of the skin of one hind leg had been torn off, and blood issued from the skull, which yielded to the pressure of the finger. On removing the skin the skull was found to be completely smashed in fractured, so much so that several portions o!" the bone came away with the skin

There were also two or three marks, auch as would be found on any animal that had been struck by a tiger's paw.— This is the first instance I ever heard of tiger killing a leopard, and can only ac count for it the following ways: 1. That the leopard, hearing the cries of the pig when seiaed by the tiger, approached incautiously, and was struck on the Lead bj the tiger's paw. 2. That the leopard was killing the pig when the tiger came up and look it away from him in doing so, doubtless a fight took place, ending in the death of the former. Our not finding the pig may have arisen from the pig making off when the tiger left him to attack tho leopard, or vice versa for on one occasion I saw a pig crawl away, though very severely hurt, after ho had been seized by tiger, which we put up in beating. this occasion we put up the tiger not one hundred yards from where the leopard was found dead, but, unfortunately, he was nut \—Breech Leader.
