In testing one of the 20-inch guns just cast at tho Fort Pitt foundry, Pittsburgh, the charge was sixty pounds of powder, resembling nut«coal in tho size of its grain. Tho ball was so large that it requirrd six men to roll it to Ibe muzzle of tho piece.

The same house is preparing a superb edition of Whittier's "3«nt Boutid,'' which will bo issued as a Christmas boot, it is in quarto and profusely illustrated. The sketches are from life tnd nature, and reproduce the actual scenes pictured by the poem. Mr. Fenn visited everyplace described in the poem, and his faithful sketches are "done in wood with rare skill, by Mr. Anthony and Mr. "W. J. Linton, the English en-. gravers. The wood cuts are interspersed with the text. A "Diamond Edition" of Whittier's complete poems is in press.

The Buit of James F. Cummings against James Gordon Bennett for alleged libel has been dissmissed by Justice Barnard Tho Herald printed an article chargiog the complainant, who was a rebel, witn having swindled the rebel government, Judge Barnard closed his charge as follows "It appears that defendant, as tho proprietor and publisher of a newspaper of large circulation inserted therein a report only of a judicial proceeding. To hold that the proprietor of a newspaper can be sued by every one who may imagine he has boon damaged by a publication common to a court would be to prevent its usefulness as a journal. "There is no malice here—no desire to injure tho plaintiff or his business. To hold that this action would lie, would nffor and hold out a premium for individuals to commence suits for that which thoy might think damaging, but which no ono else would. "The object of a journal is information. That can only be obtained by publishing such items of fact as may be of general notoriety, or such public proceedings as may havo transpired before a body having authority to. act. Again, when two persons are engaged in a common criminal enterprise, one cannot take advantage of his ovvu wrong by bringing a suit for his share of tho prohts arising out of such criminal transaction. "In this caso it is charged that plaintiff, a rebel, swindled the rebel government and individual rebels.
