Notice is hereby given that the board of public works of the city of Terre Haute and W. P. Kappes, receiver of the Evansville & Indianapolis Railroad company, have determined, upon the exact form in which a certain contract, grant and franchise from the said city of Terre Haute to said W.' P. Kappes for the construction, and maintenance of a switching track in First street between Poplar street and Wabash avenue, is to be finally adopted, which said form of said contract, grant and franchise, as follows:

CONTRACT BETWEEN THE CITY OF TERRE HAUTE, INDIANA, ACTING BY AND THROUGH ITS BOARD OF PUBLIC WORKS AND WILLIAM P. KAPPES, AS RECEIVER OF THE EVANSVILLE & INDIANAPOLIS RAILROAD COMPANY.

This agreement, made and entered into this day of September 1-916, by and between the city of Terre Haute, Indiana, hereinafter. called the city, acting by and through its board of public wqrks, and William^'. Kappes as receivor of the Evansville & Indianapolis, Railroad company, a corporation organized and existing under the laws of the,state of Indiana, its successors and assigns, hereinafter called the receiver, witnesseth:

That whereas, the said city is a city of the second class of the state of Indiana, and such city, by and through its board of public works, is empowered to make contracts with railroad"] companies with reference to the placing and maintenance of tracks in the streets, alleys and public places in said city and

Whereas, said William P. Kappes is the duly appointed, qualified and acting receiver of the' Evansville & 'Indianapolis Railroad company, a railroad company organized and existing under and by virtue of the laws of the state of Indiana,'and engaged in the operation arid maintenance of a steam railroad'in the said city of Terre Haute Indiana and

Whereas, in the carrying on of such business, it is necessary for said company to construct and maintain in First street in said city, an additional tract, in order to properly serve the shippers residing in said city.

Now, therefore, in consideration of the promises and agreements hereinafter contained on the part of said receiver,. said city 'hereby gives and grants to said William P. Kappes, as receiver of the Evansville & Indian apolis Railroad company, his succcs sors and assigns, the right, franchiise and privilege of building an additional track in, over, along and across First street in said city from the north eiid of the second track on the west side of the main track between Walnut and Poplar streets north to a point forty (40) feet south of the south property line of Wabash avenue, the north end of such track to be stubbed or closed, together with the right to maintain said track and to use said track for railroad purposes, a plat of which said track is attached hereto and made a part hereof, marked "Exhibit A." Said right hereby granted to exist and continue so long as said receiver, his successors and assigns comply with the provisions of this contract.

In consideration, whereof, said receiver agrees and promises to install and maintain culverts wherever necessary under said track for proper drainage, and also to plank all street crossings, and other places necessary as ordered by the board of public works, so as not to interfere with or impede travel Across said tracks and also to Maintain said tracks at the present grade of First street, also intersecting streets, and to1 hereafter maintain said tracks at such grade as said city may, from time. to time, establish on said First street and intersecting streets, and also to install switches so that the same shall not obstruct or impede travel on said street, such switches to be buried.

Said receiver further agrees to hold said city harmless fr.om any and all damage done by it through streets, alleys and public places with said city, in the building and construction of said track and to comply with all laws and ordinances now in force governing the cutting and digging 4nto streets and alleys, all other regulations hereafter passed. Said receiver further agrees to indemnify and save said city harmless from any liability or expense resulting from the operation, construction, erection, mainteniarice or repair of said tracks, and to protect said city from all suits for damages by reason of any accident occurring by reason of the construction, maintenance or repair of said track.

The said board of public works fixes the 25th day of September, .1916, at 2 o'clock p. m. as the time when snch contract, grant and franchise will be finally considered by said board of public works at the offices of said boardof public works in the city building in the city of Terre Haute, Indiana, and at such time and place a public hearing will be held at which hearing anv taxpayer may appear and file protest against any or all of the provisions of said contract, grant and franchise.
