STREET DEAL

APPROVED BY BOARD

Officials Say Traction Company Probably Anticipated Incessant Litigation In the Matter.

Referring to the dropping of the claim to Cherry street by the traction company, Charles P. Mancourt, city controller, and acting mayor, said Thursday morning: "In my estimation it was a very satisfactory settlement, and the only way out of the matter. It was action which should have been taken under the circumstances. The traction company is no better than any individual, and for that reason is entitled to no more privileges than any individual. It is my opinion that they foresaw litigation in the event they should have built a station, and used the street, as was proposed, for the question would ha/ve arisen as to the legality of the city turning a street over to anyone." "I feel that the citizens of Terre Haute have what thej want in the matter now," said President "William White, of the board of works, "for it became evident that the traction company did not intend t:o build a new terminal station on the site, and the time they promised to have the building up has long since elapsed."

Seek to Collect Taxes.

Following the setting aside of the vacation of the Cherry street by the agreed judgment County Treasurer Thomas J. Dailey Thursday said every effort would be made toy the treasurer's office to collect the delinquent taxes which the traction company has owed the city during the time that it has held the property. The total amount due the city from the traction company during the time that It has had possession is $3,833.20. This amount will be collected with the 1915 tax levy and in advent the company does not pay, will be regarded as a lien against the property of the company in this city.

The company has occupied Cherry street since 1911 and during this time has not paid a cent of tax on the property, in fact this has been the first year that a levy has been made on the property at all, Dailey said.

Louis P. Seeburger, county assessor, assessed the property recently and put it on the tax duplicate for the coming year.

Councilman Otto McVlck, who was a councilman during the Gerhardt administration, said Thursday he wished to correct the impression that Cherry street had been given to the traction company by the council, during the Gerhardt administration. Mr. McVlck declared the street had been given by the board of public works.

In the complaint filed In the Buit, which covered some fifty pages of closely typewritten matter, It was contended that the city owned and controlled its streets, Including Cherry street, and that this street was dedicated for a public purpose and belonged to the city for the use of all the citizens and could not be withdrawn from the purpose for which it had been dedicated, and given over to any person or to a corporation and that the act of the former board of works in declaring the street vacated had exceeded its authority and power, and that their action in so doing was null and void, and not binding upon the city, and he asked the court to declare the act null and void, and to officially declare Cherry street a part of the streets of the city of Terre Haute and not the property of the traction company. He also charged that If the action was legal In the beginning that it could only be based upon a contract of the traction company to build an interurban station on the ground and that the traction company had forfeited Its right to hold the street by violating the contract and asked for either a return of the street to the city or payment of damages in the sum of $50,000.00.

However, Mr. Batt always contended that there never was nor could there be any passing of Cherry street to the traction oDmpany, as he claimed the city possessed no power to give it to them.

PETITION FOB RECEIVER.

A petition for a receiver to collect all rents on some city property pending the time of the settlement of the partition suit brought by Edwin McKenzie and Herbert McKenzie against Alice McKenzie and Robert McKenzie was filed In the Circuit Court Thursday morning. The suit for the partition for the real estate was also filed Thursday morning.

FORTUNE SUED ON NOTE.

Charles M. Fortune^ former judge of the Circuit Court, was Thursday morning su«d on a note for $700 by A. Maxwell Hlxon. The complaint oharges that the principal and the interest are due and unpaid. It malm Clarence A. Kester and Harton Jones, sureties, also parties to the suit. Attorney fees and Interest Is asked.

STATE NORMAL NOTES.

Professor J. J. Schllchor spoke at chapel this morning on the subject, "The Establishment and Benefit of Historical Societies In a City."

A new lot of song books have been obtained by the sohool for use by the students In the chapel song service.

The members of the Eclectic Literary society met today and gave the following program: "BlognupJiy of Bret Hart«," Miss Mabel Cooper Karte's "Luck of Roaring Camp," Miss Garnet Orerpeck "Outcasts of Poker Flats," one of Harte's short stories, Miss Edith Shewmaker. Miss Ettlth Hhilts acted as critic for the meeting.

The German club assembled yesterday and were entertained by some very Interesting and Instructive motion pictures that were taken by Professor Mtatfcerer, when he was In Germany.

The members of the Daedalian Literary society met yesterday and gave a very interesting program: Luther Lockwood gave chaplain's talk on the subject, "The Greek Church a debate was held on the subject, "Resolved, That the United States Should Own and Operate All Railroads Within its Limits," the affirmative team consisting of Hale Piokett and Lawrence Hopper, won the deoision over the negative debaters, J. F. Paddock and Howard Bell Arle Sutton gave an Interesting talk at the dlose of the debate on the atfhjeot, "Natural Resources of Indiana." The following persons were voted Into active membership In the society: Clarence Orman, George Dix and Max Wheeler.

POLICE COURT DOCKET.

On her plea of guilty to the charge of intoxication, Mary winters, a very familiar polioe character, was fined $100 and given thirty days in the correctional department of the woman's prison by Judge Newton In City Court Thursday morning.

A charge of intoxication against Charles Stankcrish, a foreigner, was dtsmiHsed when he promised to quit drinking.

John MeGlone, owner of a livery stable between Third and Fourth streets on Chestnut street, was called to answer a charge of violating a city ordinance in permitting his wagons to stand on the city streets, but the case was continued until Saturday mornIn sr.
