JITNEYS SAY TRACTION DOES'NT OBEY THELAW
Declare They Have No Monopoly Nor Any Purpose to Bankrupt Electric Lines. *v
Denying the allegations of the Fidelity Trust Company of New York, bond holders for the Terre Haute, lndic.iiapolis &. Eastern Traction company, in its suit against the jitney drivers of this city to obtain a permanent injunction restraining the operators from continuing their business until they 'comply with the restrictions under .which the traction company operates. Atty. Clarence A. Royse', counsel for the jitney men, filed an answer to the original complaint in the federal court at Indianapolis Tuesday.
The answer denies that the traction company has maintained a schedule as provided by ordinance that it furnished sufficient or competent means of transportation that any loss has come to the traction company through the advent of the jitney except that •which would naturally occur througli the ordinary course of competition that the jitneys do not exclusively operate on streets which are congested and that the company has failed to furnish sufficient cars or facilities for the proper means of street transportation.
With the answer were filed affidavits from a number of the men included in the suit and, made party defendants to it, setting out that they are not operating a jitney -bus and have not operated one. jj Eighteen File Answer.
Of the sixty men made parties to the suit, the answer states but eighteen are actively employed in the Industry. Thirty-eight of the number are not employed in driving a jitney and are 6ngaged in other business. The occupation of four others was not determined.
Those who made answer to the complaint were J. C. Holden, president of the jitney drivers' union Jesse Jackson, Earl Harkness, C. A. Burgess, H. H. Sutliffe, O. R. Best, J. W. Vaughn, Albert R. Stites, Frank C. Conway, John L. McNabb, John M. Coltrain, Roy Morrison, Corbin J. McMasters, Lee L. Kearon, Anthony J. Georgelas, B.-E. Walters and Edward Rice. Walters is said to be a taxicab driver.
Among the thirty-eight men named in the complaint, who do not oporate a jitney bus, are John McFall, Prof. W.

McBeth, Dr. F. E. Ward, Gerhardt Monninger, councilman, the receiver for the Central Union Telephone Company and the Nattkemper and Connelly company. Carrie A. Newkom was also named in the complaint as a driver of a jitney bus.
The jitney men set up that the right of franchise is public and not a matter of common right which cannot be lawfull exercised by'any person dr corporation unless granted to such party bv the state or the city.
Deny Nuisance Charge.
The deny that the exercise of this right is a public nuisance as charged in the traction complaint and that they have injured the rights or interests of the traction company in any way. They charge that the union of which the named parties are members was'created for the purpose of adhering to the laws of the state and city.
In the complaint of the traction company it was charged that there is existing in this city a boycott among the union men against the street cars in favor of the jitneys.' This allegation iB denied in the answer.
The jitney men further state they have not conhbined to any other purpose than to earn a living and that they have not intentionally injured the traction company or attempted to throw it in bankruptcy.

Final preparations for the opening of the Labor Temple fair next week in the German club rooms at Fourth strteet and Wabash avenue are being made by the fair committee. When the fair opens its doors Monday night the labor temple boosters expect to inaugurate one of the biggest gala weeks in the history of local organized labor. The committee hopes to raise several thousand dollars from the fair for the labor temple building.
The entire week of the fair will be filled with attractive events. During the afternoon there will be card parties for the women and at night there will be dancing for the young folks. Merchants have responded liberally with donations for the booths and attractive merchandise will be auctioned to those who attend. "The committee has met with encouragement from the merchants since the work of soliciting donations began," said John Chamberlain, president of the Labor Temple association Wednesday, "Everyone seems to realize the necessity of having a labor temple in Terre Haute and we are receiving encouragement on every hand. If the fair proves as successful as we hope, we intend to pay off the balance on t"he lot before January 1."
Many women have donated fancy pieces for the fair and the fancy work booth is expected to attract considerable attention. The fair will close on Saturday night.
SUES DRIVER OF AUTO.
Injured Man Asks $5,000 Damages As Result of Injury. Charging that through a violation of the traffic laws of this city, Floyd E. Marley drove his automobile over him when he alighted from a street car at Seventh street and Wabash avenue, May 17, John W. Heedwohl filed suit for $5,000 damages against Marley in the Superior Court Wednesday morning. He says the street car had come to a standstill at the corner and that as he crossed the intervening space between it and the sidewalk the Marley car struck him.
NEW LORD MAYOR OF LONDON.
LONDON", Sept 29.—Sir Charles Cheers Wakefield was elected lord mayor of London by the council today.
Sir Charles will succeed Sir Charles Johnston, whose term expires ir\ November. The mayor-elect is an alderman and has been decorated w'ch the order of the legion of honor.

WASHINGTON, D. C., Sept. 29.— The week was too cool and wet In the corn belt to the westward of the Mississippi river for rapid maturing of the cfop, which made little progress and which still requires from ten days to two weeks of favorable weather. The weather was more favorable in most sections to the eastward of the Mississippi and the crop is maturing rapidly and cutting progressing well. in eastern portions of the spring wheat belt rains hindered threshing, but the crop in most sections is progressing satisfactorily. Rapid progress was made in preparing the soil for seeding: in eastern districts and sowing is becoming general in northern and southern sections. The soil is too wet in most western districts and in many sections seeding is later than usual.
The tobacco crop Is nearly all gathered. Ranges, pastures and stock continue in good condition.
Indiana Conditions.
The early part of the week was cool and light frosts occurred in many localities on the twenty-second and twenty-third however, the damage from frost was slight. There was abundant sunshine during the week and no rain occurred until its close. Conditions generally were quite favorable for maturing1 crops and corn ripened well. In the southern and central divisions of the state much of the crop Is safe from frost. Corn nutting is now under way in the central and southern divisions. Preparation of the ground for wheat is about done and the soil is in excellent condition. Clover hulling is in progress the yield is reported light, with the seeds somewhat Inferior in quality. Pastures are good but need rain in the extreme southern counties.

POLICE COME NOBODY HOME.
Visit Places Where Gambling Was Wont to Hold Forth. Following the report to the superintendent of police that gambling was going on in Terre Haute, patrolmen visited all the places in the city Tuesday night, which at one time were said to have gambling paraphernalia and to allow gambling, but no arrests were made. It is said the police paid particular attention to places on Wabash avenue, but according to the reports there was no gambling and the places were closed.
