Affidavits Are Filed With Motion for Retrial of Case of Convicted Mine Leader.
TRINIDAD, Col., July 9.—Charges that th* verdict by which John R. L-awson, international executive board member of the United Mine "Workers of America, was convicted of first degree murder, was secured through intimidation and jury tampering by a tourt bailiff, were aired in the district Court here today In the arguments on j-awson's motion for a new trial. The arguments were before Judge Granby Riilyer, who presided in the Lawson case. A motion to prohibit Judge Hillyer from hearing several additional Strike cases is pending in the Colorado supreme court.
Lawson was convicted May 3 of first degree murder In connection with the killing of John Nimmo, a deputy sheriff,. in a battle near Ludlow, Col., between deputies and striking coal miners.
The motion for a new trial filed by Lewson's attorney was accompanied by an affidavit signed by Grover Hall, a member of the jury which convicted the labor leader. In It Hall declares ho believes Lawson innocent.
Accuses Court Bailiff.
I He swears that during the more than forty hours of jury deliberation he was repeatedly told by Frank Gooden, the bailiff in charge of the jury, |hat his wife was dangerously ill. The Affidavit makes the further charge that *n May 3 the jury was not taken to luncheon at the usual hour and that Gooden informed Hall that Judge Hilljer had ordered the jurors to be lock«d in a room and given no food until they had agreed upon a verdict. Hall declares he agreed to vote for verdict which he believed was contrary to the evidence.
An affidavit by Bert Bramlet, who Served as bailiff in the murder trial of louis Zancanelli, preceding the Lawsin trial, stated that Gooden had boasted to him that he had "brought iressure to bear upon Grover Hall."
Berta Hall, wife of Grover Hall, in an affidavit offered when the hearing ipened, swore that during the Lawson tjml she had a cold. The affidavit Ciarges that on the evening of May 2 'One Zeke Martin waa In the house of aHant and insisted that affiant should hive a doctor that Martin finally ailed a physician who said Mrs. Hall Alas not seriously ill."
Zeke Martin at that time was understeriff. Other affidavits submitted are from nen alleged to have participated as nine (guards in the battle in which Nmmo w*as killed and purport to indrate that Nimmo was struck by a billet fired by one of the guards, rot strikers.

Gen. Botha Sucoeeds In Putting Down Rebellion .There Against England's Authority.
PRETORIA, South Africa, July 9.— General Botha, commander of the forces of the Union of South Africa, has accepted the surrender of all German military forces in German Southwest Africa.
After suppressing the rebellion against British authority in the Union of South Africa Gen. Botha took command of British operations against German Southwest Africa and headed an invasion of that territory late, in February. His operations were reported to be uniformly successful.
The forces under his command ca.ptured Olymbingue on May 4. Two days later it was announced that he had occupied the important railway junotlon of Karibib and other stations after a march of thirty-five miles over a waterless wa3te during which the troops suffered severely from heat, thirst and hunger.
The road to Windhoek, capital of the German territory, was opened by the occupation of Keetmanshop. Windhoek was taken May 23 without opposition. Martial law was proclaimed throughout the conquered territory.
ReportB from London recently have stated that the surrender of all the German forces was expected soon. British military experts have contended that General Botha has Conducted a masterly campaign.
German Southwest Africa is located on the west coast of Africa extending from the Orange river to the Cunenee river, about 800 miles. It lies between Portuguese West Africa and Cape Colony, extending eastward to the British sphere.
FRANK GREEN SUES.
Terre Haute Prisoner Hurt While Returning From Jail. Frank Green, of Terre Haute, who was injured in a flail from a freight train while trying to beat his way home June 25, has filed suit against the Big Four railroad company for $10,000 damages. Green had just been released from custody after serving sixty days in the Marion county jail for election conspiracy in the Terre Haute election cases. He alleges that he was kicked from the train, that he has had two toes amputated since, and that he was injured about the head and back. He alleges that he explained to the brakeman that he was without money and that he had to get home.

Also Reprimands Censor for Passing Attack on Wilson. VIENNA, July 9.—Formal apologj has been made by the Austro-Hungar-ian government to United States Ambassador Frederick C. Penfield because of an abusive articles printed in the Neuesviener Tagblatt attacking President Wilson and the American people in connection with the second note protesting against German methods of .submarine warfare.
As a rigid censorship is exercised aver Austrian papers, Ambassador Pen field had informally asked the foreign Office if the article represented the opinion of the Austrian government. The result was an apology and a sharp reprimand for the official censor.
