Milton Herz Attending Convention in I ndianapolis. Milton Herz, of the A. Herz store, went to Indianapolis Tuesday to attend the first annual convention and banquet of the Indiana Retail Dry Goods association. A business session was on the program for the morning and afternoon and an informal dinner in the evening. The organization has for its purpose the study of the problems of the merchants with an idea to better them. The president of the association is Carl Wise, of Wilet & Wise, Logansport. G. A. Efroymson, of the H. P. Wasson & Co.. i3 vice president, and W. H. Block, of the W. H. Block Co., Indianapolis, Milton Herz Terre Haute, and Albert S. KATTTZ FOUND NOT GUILTY.

Court Sustains Motion for Ruling for Defendant. The trial of William E. KauLz, on the charge of embezzling $9.50 from the Hanley-Ruddell Tent and Awning Co. came to an end in the Circuit Court Tuesday morning. After two witnesses were examined on behalf of the state John Hanley, head of the company, and Joseph Fusco, of Sullivan, Ind., the customer who claims to have paid the money to Kautz, counsel for the defense moved the court to give the jury peremptory instructions to return a verdict for the defendant. The court sustained the motion and a verdict of not guilty entered. Prosecutor Werneke and Deputy Prosecutor P. O Colliver are appearing for the state while Kautz is being defended by D. V. Miller, Louis Reichman and Walter Ballard. Three similar indictments are pending against Kautz.

RED MEN STAGE PLAY.

"Prairie Rose," the playlet which drew large crowds to the Palace theatre at West Terre Haute when presented under the auspices of the lona •ribe, No. 104. Improved Order of Red Men. will be repeated Wednesday and Thursday nights. The play is expected to draw large crowds.

Be it known that on the 26th day of April, 1915, said plaintiff filed affidavit in due form, showing that the defendant. Gertrude I. Taylor, is a non-resi-dent of the state of Indiana and a necessary party to the complaint herein and that the object of said action is divorce. Said non-resident defendant is now, therefore hereby notified of the pendency of said action against her and that the same will stand for trial on the 22nd day of June, 1915, the same being the 14th judicial day of the June term, 1915, of said court, and unless said defendant appears and answers or demurs to said complaint at said date, the same will h-e heard and determined in her absence.
