Dr. Frank A. Tabor, city health officer, issued an order Thursday morning, closing the Harrison school at Seventh street and Third avenue until October 26, to forestall, if possible, and prevent an epidemic of diphtheria in that locality, where a number of «cases have developed, some resulting fatally. NANATMO, B. C., Oct. 5.—The (J*/ninety-ton gasoline launch Empress Ninth was captured by Canadian j, authorities yesterday at Comox Spit, in Union bay. The crew, two men and a woman, all giving the name of ^/-.Kohfe, were taken into custody. (ft The launch had about nine months' provisions and supplies aboard, carried fp'' three auxiliary engines and was '^"•equipped with .wireless apparatus with which it is supposed the crew were intercepting messages from the wireless station at Cape Lazo.

High French Official Declares That Latest Dispatches From Front Show Such Is Case.
BORDEAUX, France, Oct. 15.—1:15 p. m.—A high official of the FVench government declared this morning that the latest dispatches from the front showed that the military situation was about to develop more rapidly on the center, in the region of Berry-au-Bac and on the left in the LaBassee, Estaires and Bailleul district.
The allies continue to make progress, this official continues. Several hotly contested positions which had changed hands repeatedly during the past few weeks, were now held strongly by the French, and the Anglo-French situation was most encouraging.

CHOLERA NOW MAKING RAPED GAINS THROUGHOUT HUNGARY
Authorities Were Too Lax in Supervision of Prisoners' Camps—Austrians Need Clothes.
VENTCE, Italy (via Paris), Oct. 15.— 12:05 p. itl—According to reports reaching "Venice cholera is making rapid strides throughout Hungary and the progress of the disease is causing alarm among the people.
The Hungarian authorities, it now appears, were too lax in the beginning in the matter of the sanitary supervisions of prisoners' campe, which since have been placed under special control. Prisoners no longer are permitted to camp in the open air anrl now all suspect cases are being isolated in hospitals.
Other dispteches reaching Venice relate that the Austrian commissary department is breaking down so far an the equipment of new recruits is concernel. These men are suffering from a scarcity of clothing and boots, especially heavy winter garments.
FRANK DENIED NEW TRIAL.
Man Under Sentence for Murder Faces Noose. ATLANTA, Ga,., Oct. 15.—L/eo M. Frank, under sentence of death for the murder here in April, 1913, of Mary Phagan, an employee of the pencil factory of which Frank was superintendent, has been denied a new trial by the Georgia supreme court. The court held that Frank's showing of newly discovered evidence was insufficient.
This was Frank's fifth attempt to obtain a retrial or annulment of the verdict which was returned August 25, last year. He still has pending before the state supreme court an appeal from the lower court's denial of a motion to set aside the verdict on the ground that he was not in the court room when it was returned. It is expected arguments on the appeal will be made in about two weeks.
ESCAPES CONTEMPT CHARGE.
Cal Morgan Freed By Court In Case Brought By Sheriff. Cal Morgan, indicated for embezzlement in connection with the ownership of an auto claimed by William Davis, a South Fourth street baker, who is seeking to replevin the machine, was arraigned in the Circuit Court Thursday morning to answer questions under oath' and show cause why he should not be fined for contempt of court. The allegation was that when he was served with the replevin notice he refused to say anything regarding the machine. Deputy Sheriff Katzenbach testified that when Morgan was served with the writ in the sheriff's office he "stood mute," which was claimed constituted ,contemptous conduct. The court held that "standing mute" in the sheriff's office under such circumstances did not constitute contempt as it would in a proceeding in court, and freed the man of the contempt charge.
EDITOR COMMITS MURDER.
California Man Asserts Sportsman Attacked Him. SAN BERNARDINO, Cal., Oct. i5.— Howard E. Davis, secretary of the progressive county central committee and editor of the Evening Index, shot and instantly killed Ben Emerson, a local sportsman, last night. Davis said Emerson attacked him.
The shooting followed .a fist fight on the street at the entrance of progressive headquarters. Davis went to his office after the shooting and was arrested there. He exhibited marks on his face and said that he shot in selfdefense. Emerson's name had been used in the paper in connection with attacks on republican party leaders and he had demanded a retraction, it is said.

ROME (via Paris), Oct. 15.—1:02 a. m.—The Osservatore Romano publishes the official announcement of the appointment of Cardinal Merry Del Val, former papal secretary of state, as secretary of the congregation of the holy office.
ASSAULT CASE CONTINUED.
The case of Oscar Duplas, a onelegged man, charged with assault and battery on Henry Brinkman Wednesday afternoon, was continued in Police Court Thursday morning until October 16. Jack Leonard was fined $1 and costs for intoxication.

Self-Denial Week Ulls Xmas Week
The week of October 18-25 is to be set apart by the members of the First Methodist Sunday School as "Self Denial Week," during which they will prepare gifts for the Christmas 'ship which is to take holiday presents from American children and young people to those of the European countries now devastated by war. On Sunday, the 25th, the presents will be taken to Sunday school to be forwarded to New York for shipments to their destinations.
The attendance contest between the members of the First Methodist Sunday school and those of Centenary is arousing much interest, the first named now leading by a total of 349. The contest will close the last. Sunday of the year, when the wiliner will be announced. Two classes of State Normal students' living on the south side have been organized in the First Methodist, Rev. 1. B. Harper teaching the young men, and Charles F. Haupt, the young women. S. T. Needles is in charge of a teachers' training class which meets at 7 o'clock each Wednesday evening. An invitation to attend is extended to those interested In this work.

Mikado's Military Attache Says Country Would Welcome Plan. LONDON, Oct. 15.—5 a. m.—"General Oba, the Japanese military attache, with the commander-in-chief," says the Time Petrograd correspond ent, "after an imperial audience at Tsarkoe-Selo, gave a statement to the Bourse Gazette frankly expressing his earnest wish to convert the RussoJapanese entente into a formal alliance. Such a nalllance." General Oba said, "would be warmly welcomed by the Japanese government and people.
