WO-CENT PASSENGER RATES TO HEAR FATE

Case Before Supreme Court, Involving West Virginia Law, Will Have Wide Application.

WASHINGTON, Oct. 13.—The fate of scores of two cent passenger rates rests upon the outcome of arguments today before the supreme court of the validity of the West Virginia twocent passenger rate law.

One of the points at issue is whether state may compel railroads to carry passengers at a non-remunerative rate, allowing them to make up their los6 by Increased charges on freight business. Technically only the i-ates on the Nor|folk & Western railway are concerned, but the decision is expected to fix a standing for adjusting passenger and freight rates to one another throughout the country.

The argument of the rate case was the first scheduled for the term. Before it wus taken up dozens of motions were made in other cases on tlie docket. In the main, these motions

"were for the advancement of cases said to be of high importance, for the review of judgment in lower federal I courts not appealable to the court aa a matter of right, and for the dismissal of the appeal in other suits.

ARMED MASKED MEN CAPTURE PRISONER AND MURDER HIM

Sheriff Is Stopped On Road, His Charge Taken, And He Is Told To Move On.

PERCY, 111., Oct. 18.—An armed body jof masked men stopped Sheriff Bresner, of Willlsville, on the road last night, took Albert Ciazza, his prisoner,

from him, shot and Instantly killed Ciazza and warned Bresner away. Ciazza was an Italian miner, one of two brothers, who engaged in a revolver fight with two American miners, Willis Adam* and Ben Cooper. The fight began over a request for a cigarette. When it ended Sam Ciazza was dead and both the American miners badly 'wounded.

Sheriff Bresner was on his way to the county jail at Pinckneyville with Ciazza when the masked men sprang from the roadside. Three held the sheriff while the others marched the Italian ten paces down the roadside and shot him down.

There were fifteen wounds in his body. The maskers then \*c.rned the sheriff ,not to follow and vanished into the woods.

ALLIES SEEK SUPPLIES HERE.

Order Army Wagons, Blankets and Saddles in Chicago. CHICAGO, Oct. 13.—Negotiations fcr jjjtho purchase of several thousand army wagons, one million blankets, 200,000 :*addles and bridles, and a large supply 4'of rifle cartridges for the use of the •English and French armies were openel here today by representatives of those governments.

Representatives of the army purchasing departments asked for immediate bids on the wagon contracts, as a large number are wanted for quick delivery in Canada it was said. The remainder are to be delivered at future dates. Immediate delivery of blankets is demanded by the purchasers.

WOMAN ACCUSES ATTORNEY.

Sues Frank Kelley for $3,700 on Allegation of Fraud. Mrs. Ida M. Birney, of Cumberland county, Illinois, has sued Frank A. Kellty, of Miller & Kelley, attorneys, for '$3,700 damages, claiming that he secured possession of certain lots of hers in that county by securing her signature to what she believed was a trust deed to make good a loan from him, iwhen it was in fact a warranty deed, and that on the basis of the latter he took charge of her property, collected the rents, and by failing to turn over ithe property caused her to suffer other [financial losses. She is represented by

George Burkhart, an Indianapolis attorney.

Boston's formidable array was unchanged. Principal in thi®, the Athletics have found, is tow-headed Hank Gowdy, who in this series has supplanted Frank Baker aa a long distance hitter. No player who has ever taken pert in a world^s series has equalled the record of Gowdy, whose batting won Friday's game and prevailed again in yesterday's contest.

Macks Below Form.

Although the Athletics yesterday recovered some measure of their batting strength, they were still far form their true form. Their slump was a matter of deepest concern to the Philadelphlans. They pointed out that in fielding they excelled the Boston team in the three games thus far, and to their falling off in hitting alone do they attribute their three failures. The team has batted for an average of only .155 in three games in which they averaged five hits a game.

After today's game the players cease participating in world's series proceeds. Receipts for the first four games probably will total $225,000 on a total attendance of 110,000. The players' share of the money will be about $115,000, considerably less than two years ago and somewhat less than last year.

POLAND CLEAR OF GERMANS.

Provinces of Suwalki and Lomza In Russian Hands. LONDON, Oct. 13.—S:25 a. m.—A dispatch to the Central News from Rome says a telegram from Prtrogrnd to the Tribune states that no Germans remain in the provinces of Suwalki and Lomza, Russian Poland, that the Russian army continues to advance in East Prussia and that the entire district of Lyck is now occupied by the forces of Emperor Nicholas.

In addition the dispatch says that the Russians are maintaining their positions in Hungary Bukowina and Transylvania.

J. P. MORGAN IN CAPITAL.

Goes to Confer With Sec. Lane Regarding Alaskan Conditions. WASHINGTON, Oct. 13—J. Plerpont Morgan came to Washington today for a conference with Secretary Lane of the Interior, on conditions in Alaska with particular reference to railroads.

There have been reports that Morgan interests would offer to sell certain properties to the fffvernment for use in connection with the government railroad soon to be constructed in Alaska.

DETROIT, Mich., Oct. 13.—More than 1,300 missionaries and laymen from all parts of the world are in Detroit to attend the 105th annual meeting of the American Board of Commissioners for Foreign Missions which began today and will continue four day*.
