AuBERRY SENTENCED 10 TERM IN PRISON
1 Given Prom Two to Fourteen Years ^on Plea of Guilty to Burglary Charge.
One of the saddest cases heard in the Circuit Court in many a day was that of Frank Auberry, a coal miner 26 years of age, who was sentenced Saturday to the state's prison for from two to fourteen years, on his plea of guilty of entering a house with hurgrlarous intent. He had ben indicted for burglary and for entering with intent, but he decided to enter a plea of guilty to the latter Charge in hope of having his sentence suspended. His attorney, E. H. Redman, made a strong plea for him, saying Auberry had until recently led an exemplary life, and had never given the authorities any trouble, but it developed that he had recently gone into the burglary business on the wholesale. The Immediate offense for which he was indicted was breaking into the house of Carl D. Fischer, of the Standard Wheel Co., and ta.klng a gold watch, which he pawned. When arrested it was discovered that he had broken into a number of houses* here as well as In Clinton, and that he was

wanted by the Vermillion authorities on the burglary charge. Judgre Colllver said he could not In justice to the community and the law release him on suspended sentence In the face of the conditions which were not disputed, and asked Auberry why he had committed the offenses. The reply was that he had been unable to find work, either at his trade, mining, or at any of the local establishments at which he had applied and that he had to have something to live on and therefore had committed the crimes.
Auberry was nicely dressed, neat and clean, and was one of the most decent appearing persons that has appeared before the court charged with a crime: His aged father and two brothers, from Linton, where he formerly lived, were in court, and were heartbroken when the sentence was imposed on him. He is married and his wife is at their former home, In Linton.
Charles W. Triplett, Indicted for forgery and passing fraudulent checks, pleaded guilty to the last charge and was given from one to fifteen years in Michigan City. He is 47 years of age.
