Zack Compton, living at Tweety-fifth street and Ashland avenue, and who were later arrested, is given by the police as the cause for an accident about 9:30 o'clock Tuesday night on the West Terre Haute grade, which resulted in the aged mother of Mrs. "W. O. Morris, living at Marshall, 111., being painfully injured, and the buggy they were driving being slightly damaged.

The accident occurred near the crematory, west of the river bridge, and was caused when the team driven by Mrs. Morris, who was coming east to the city, became frightened at the approaching gravel train. The team bolted, but two men who gave their names as Thomas Meredith and Frank Evefett, who were sitting on the bridge, caught the frightened horses. Just as the two men caught the reins the old lady fell out as the buggy began to tip over.

She was severely shaken up and sustained a few cuts and bruises. She is 72 years old. Mrs. Morris told the police, when they were taken to headquarters in the police auto, that if the car was stopped when she called a warning to the crew that the accident would not have happened.

She said the car crew was coming west from the bridge as she nearer] the approach. She knew, she said, the team would become frightened and screamed to the conductor to Btop, but Instead he gave a signal with his lantern to go ahead. The signal was obeyed by the motorman, she said, and the team bolted.

The car men were operating a gravel train and were pushing three gravel cars ahead of the car which was being operated by the motorman. The conductor was on the head car.

Samuels said he believed if the car had been stopped when Mrs. Horris gave the signal, the accident would not have occurred.

Zack Compton, the motorman, said when they came off the bridge, the conductor gave him a "highball" to proceed which was followed almost immediately by a stop signal. He said he stopped his train and came back and helped get the horses on their feet and straighten out the ouss-y.

Manager T. F. Grover said: "These men should not have been arrested. If a person goes along carrying a lantern and something scares at it, is it right to put the fellow with the lantern in jail? I know that at no time was the car closer than fifteen feet to the verlcle. How can they be charged with assault and battery? That's what I would like to know." *c

both arrested following the statement of Mrs. Morris and later released on bond, signed at the jail. They were charged wlith assault and battery and through their attorney, Harry Wallace, pleaded not guilty in City Court Wednesday morning. On account of the absence of Mrs. Morris and her mother, the cases were continued until Friday afternoon.

The two men who stopped the team knew nothing of the accident until they heard the women scream. They told tho police they were too busy stopping the horses to give any heed to the lantern signals given by the conductor. They however, said the cars proceeded I on their journey, instead of stopping. I Charles Ward and Andrew Samuels, of St. Mary's, were behind the buggy and were coming to Tefre Kaute.

"Mr. Bingle's Melodrama," the film burlesque which will be shown at the Grand today and Thursday along with the sixth installment of "The Million Dollar Mystery." comes almost direct from the Vitagraph theater in New York, the home of high class film features. James Lackaye plays the part of a fat man who is so impressed by a melodrama which he witnesses that he decides to put on a similar show and play the hero. He makes the production, tries it out in a one night stand and has troubles a plenty. "Mr. Bingle's Melodrama" lasted four weeks at the fashionable Vitagraph theater on Broadway, where the prices of admission range from 25 cents to a dollar. One of the New York critics in a three quarter of a column review of this film insisted it was the funniest show on Broadway. In the cast are some of the best comic actors in filmdom. Charles W. Mr. Bowser tried in vain to get another sketch "just as good" as the old one and has very sensibly gone back to the vehicle which made him a real star in the two and three-a-day houses. Otto Meyer, the new manager cf the Varieties, is ranidlv petting his bearings and is quite sure be will soon be as much at home in Ttire Haute as he was in Evansville.
