Grace W. Wheeler is unmarried, while two of the sons are married and have infant children, who are represented in the action by their guardian ad litem. The guardian opposed the form of the proposed order of the findings of a referee appointed to report concerning the interests of the infants in the six inches of ground it is desired to sell. It was contended that the petitioner had purchased the interests of Charlotte Eugenie Wheeler, and unless their future heirs have a contingent interest in th6 property there remains nothing to be sold.

Justice Goff held that the term for her heirs was used intentionally and that the grandchildren of Charlotte Eugenie Wheeler have a contingent interest in the property. He overrules any conclusion of the referee to the contrary and permits the sale of the property.

The property is a strip of land six inches in width and one hundred feet ong between lots at Nos. 132 and 134 VTest Forty-ninth street, this city. Justice Goff approves the findings of the referee which fixes the value of 'the six inches of land at $5,400, owing to the strategic position it occupies 'when added to either of the two lots on each side of it.

Inviting proposals for paving the following described streets, alleys and sidewalks. Sealed proposals will be received by the board of public works, of the city cf Terre Haute, IndUtna, at the office of said board of public Works of said city until 4 o'clock p. m. on the 8th day of July, 1914, at which time and place said bills will be publicly opened and duly considered for the construction of the following described improvements:

For the paving of the alley between Water and First streets from the south property line of Wabash avenue to the north property line of Ohio strtat. By grading and paving the roadway thereof with reinforced macadam.

For the improvement of the alley between Fifth and Sixth streets from the north line of Cherry street to the south line of Chestnut street. By grading and paving the roadway thereof with reinforced macadam.

For che improvement' of Linden street from the west line of Seventh street to the east line of Sixth street. By grading and curbing the uncurbed portions of the sidewalks thereof with Oolitic curbing, and by paving the sidewalks thereof with cement concrete.

For the Improvement of Fifth street from the south line of Cherry street to the south line of Tippecanoe street. By resurfacing the roadway thereof with asphalt.

For the improvement of Twenty-fifth street trom the north property line of Watash avenue to the south property line of Elm street. By curbing the uncurbed portions of the sidewalks thereof with reinforced concrete curb, and by grading and paving the roadway thereof with reinforced macadam.

As authorized by improvement resolutions Nos. 40, 43, 44, 45, 46, 48, 49, 50 and 51.

Said streets, alleys and sidewalks to be Improved, as authorised by the improvement resolutions Nos. 40, 43, 44, 45, 46. 48, 49, 50. passed and adopted by the board of public works, on the 19th day of May, 1414, and as authorized by improvement resolution No. 61, passed ana adopted by said board of public works, on the 26th day of May, 1914.

Said Improvements shall he constructed and made in accordance with said resolutions, and the maps, plats, plans, profiles ajid specifications for the same on file in the office of th« board of public works, of the city of Terre Halite, Indiana.
