Court met, pursuant

Chamber. All tha members of the Pollee Board were present with the exception of Mr. Loomla, who aent word that he waa

too unwell to admit of hla attendance. Major Gordon entered a complaint that

the proeeontion had reason to believe the defense had entered upon a course of intimidation, by tramped up chsrgen against witnesses for the prosecution, and driving wltneaaea away; if each was to be the eourse the proeeontion wanted to know it, so they might be able to meet

it in the proper manner.

Mr. Hanna, as counsel for Mr. Duval, ■aid Duval nor himself had any knowledge that Mr. Baker waa to be arrested; he had not advised nor woald he advise or countenance, any proceeding of the kind; hoped the remarks of the gentleman were not made in order to prejudice the mind of the Court against his client. M^jor Gordon did not intend his remarks as being personal against tbs counsel for the defense, or for the purpose of creating prejudlca; most certainly the arrest of Mr. Baker bad been made by Interested parties, and bis remarks were general, and for the protection of

the prosecution.

Mr. Van Horn had, prior to the arrest, advised against suefi a measure, but contrary to his advice or knowledge, the arrest had been made; hoped the remarks were not intended to browbeat the counsel for the defense. M. M. Ray explained that their object waa to assure witnesses that they should be protected to the fall extent of the law in their evidence, and not to be dogged or intimidated by policemen; he did not think the Board would warrant such proceedings, nor would the public be gratified with the knowledge that their lives or libsrtios were at the mercy of the police, according to their caprice, as the unwarranted arrest of Mr. Baker would

tend to prove.

The President said the arrest was made without the collusion of the Board; the Board was willing to give the prosecution every favor they were entitled to, and all the protection la their power to

the witnesses.

The investigation of the charges against J. P. Duval were then proceeded with, Mr. Cottrell was sworn, and gave his testimony In relation to the eleventh charge as follows: Thomas Cottrell resides at 160 South New Jersey street; am a member of the Council trom the Seventh Ward; made the charges in his oapscity of Councilman, and upon informatian. lu April last had a black overcoat stolen from him wile in a saloon taking a glass of Deer with some friends; had laid the overcoat on a bagatelle table In the saloon; Informed Captain Wilson of the loss; J. P. Duval came to him a day or two afterward and said he knew where the coat was, and wanted to know how much would bo given for Its recovery; told Duval he would give f25 for the arrest of the thief; Duval replied that he could not get the thief, but knew where the coat was and could get itforfi; asked Duval how that was, and he replied that the coat was in pawn at a pawn brokers, and it would take JS to redeem it; told Duval If that w.ia the ease ho could get it without paying a cent for It; Duval then left him without telling at what pawn shop the Coat was; coat cost, when new, ft‘>; had worn It all one season. hi/ J><tfenne—Saloon where coat was stolen was at ti'J Mouth Delaware street; waa there with several friends conversing and drinking l>eer; was in the saloon fifteen or twenty minutes; man suspected of stealing the coat was in the saloon

On motion for adjournment, Major Oordon stated that eertal n Inflneno— were at work, that were taking a good portion of the witnesses for the prosecution away from the city, and on this account it waa neoeasary far them to push the investigation as rapidly as possible, and asked that when the Court adjourned it would be to meet on (this) Saturday morning. Mr. Hanna said he would be obliged to attend Court during the day, and would go bom# to Greeneastle in the evening. Mr. Hanna had business that would call him away from the city. Dr. Jameson bad to attend to his patients. Mr. Beldensticker proposed to start for Terre

Haute at once.

Mayor Macauley said he would use all the means In his power to prevent witnesses from leaving town, and so the Coart adjourned to meet on Monday, the 10th instant, at two p. m. The prosecution amended the charge by tho addition of full dates, and the words “nnknown persons,” and stated It was not In their power to do more than to adduce evidence In order to arrive at further facts. They were willing to let tho charge stand as it was, and If the Court refused an Investigation, the public would draw tbelr own inferences na to the truth of the chargo and tho conduct of the Board. Mr. Hanna commented on the nature of the charges, and said honest men would not permit themselves to be attacked and their characters impaired before tbe community, without seeking redress before a proper tribunal. The President decided that u one member of tbe Board was absent, the Board would take the odmlsaablllty of the charge under consideration, and render their decision at the next meeting of tbe

The prosecution then took up tbe tenth charge, but after the examination of two witnesses, Mr. Solomon, pawnbroker, and Mr. Bray, an ex-policeman, but no evidence being adduced to sustain It, tbe charge was withdrawn. This charge was against unknown policemen, for selling
